ABELARDO C. LATUPAN JOSE L. ESCOBAR

Complainant AGAINST Respondent

This document records what transpired during the confrontation between the complainant and the
respondent before the Punong Barangay, as follows:

1. That on September 5, 2018, a SUMMON was served against Mr. Jose L. Escobar, regarding
the infringement on the Compromise Agreement (Civil Case No, 621-T) before the Regional
Trial Court, Second Judicial Region Tuao, Cagayan between Mr. Abelardo C. Latupan and
Rosa L. Escobar. A copy of the said compromise agreement was given to the office of the
Punong Barangay for reference.

2. The aforementioned Compromise Agreement states that the net income or fruits and other
properties of their predecessor, Jose Latupan shall be divided equally between Abelardo
Latupan and Rosa L. Escobar.

3. That according to Mr. Jose L. Escobar, he is fully aware of such Compromise Agreement as
they have in their possession a copy of said document.

4. However in August, 2018, Mr. Jose L. Escobar took from tenant, Mr. Narding Catubag all the
shares of the harvested rice and corn crops for both Abelardo Latupan and Rosa L. Escobar.

5. That during the confrontation, it was explained to Mr. Jose L. Escobar that only the
legitimate heirs, ABELARDO LATUPAN and ROSA L. ESCOBAR, who in fact entered into the
said Compromise Agreement before the Regional Trial Court have the right to receive all
income or shares from the harvest of Mr. Narding Catubag, and that no third parties are
liable to receive the shares in behalf of the legitimate heirs, Abelardo Latupan and Rosa L.
Escobar.

6. That Mr. Narding Catubag was also reminded to release the harvested rice and corn crops
only to ABELARDO LATUPAN and ROSA L. ESCOBAR.

7. That Mr. Jose L. Escobar fully understands the terms and conditions of the Compromise
Agreement between ABELARDO LATUPAN and ROSA L. ESCOBAR, and hereby promises to
abide by it.

In WITNESS THEREOF, the parties hereunto signed their names on this ___________ of September
2018 at Barangay Catom Tuao, Cagayan.
