PROCEEDINGS OF THE COUNTY BOARD OF JACKSON COUNTY, MINNESOTA

July 16, 2019

The County Board of Jackson County, Minnesota met in regular session, in the Jackson County
Courthouse Board Room, 405 Fourth Street, City of Jackson, Minnesota, on July 16, 2019. The
following members of the Jackson County Board of Commissioners were present: Catherine
Hohenstein, Don Wachal, Scott McClure, Jim Eigenberg and Philip Nasby. County Coordinator
Steven Duncan and Trish Schulz, Deputy County Coordinator, were also in attendance.

CALL TO ORDER

Chair Hohenstein called the meeting to order at approximately 9:00 a.m. and led the Pledge of
Allegiance.

Motion was made by Commissioner Nasby and seconded by Commissioner McClure to adopt the
agenda. The motion carried unanimously.

CONSENT AGENDA

Motion was made by Commissioner Wachal and seconded by Commissioner Eigenberg to


approve the consent agenda. The motion carried unanimously.

Board Action 19-178: Approve the July 2, 2019 Board of Commissioners regular meeting minutes.

Board Action 19-179: Approve all Commissioner disbursements in accordance with Minnesota Statutes
130.01, subd. 4(b), recorded on warrants numbered 88853 through 89018 in the amount of
$1,477,321.52. For the following funds: General Revenue, $130,334.78; Road & Bridge/Public Works,
$1,320,819.55; Ditch, $5,309.31; Agency, $2,962.50; Tax & Penalties, $8,309.39; and Forfeited Land,
$9,585.99. A detailed list of claims paid is available at the Auditor/Treasurer’s office upon request.

Board Action 19-180: Approve utility permits:

Iowa Lakes Electric Cooperative- bore conduit- CSAH9- Sioux Valley Township
Iowa Lakes Electric Cooperative - bore conduit – CSAH 29 – Petersburg Township
ITC Midwest- LLC- set crane in ditch for overhead work- CSAH24- Weimer Township
Nickel Construction – 18” intake in ditch – CSAH 24 – Weimer Township

Board Action 19-181: Approve use of IS Equipment reserve funds to purchase replacement PCs for
current Windows 7 units.

Board Action 19-182: Approve credit card limit increases, from $500 to $1,000, for Gary Reif,
Jail/Dispatch Administrator & Deputy EM Director; Brandon Hendrickson, Jailer/Dispatcher
Supervisor & Kelly Mitchell, Chief Deputy Sheriff of the Sheriff’s Office

Board Action 19-183: Approve authorizing the County Coordinator to fill part-time Sheriff’s Deputy
vacancies, up to a maximum of five positions, as needed.

MINNESOTA DEPARTMENT OF TRANSPORTATION

A presentation was given by representatives of the Minnesota Department of Transportation, regarding


Captial Highway Investment Plan Outreach.

JACKSON AREA CHAMBER OF COMMERCE

Motion was made by Commissioner Eigenberg and seconded by Commissioner Nasby to adopt
Board Action 19-184: Approve Jackson Area Chamber of Commerce/CVB/Jackson Lodging
Association FY 2020 budget appropriation request in the amount of $756.65 to cover 50% of
tourism/travel group memberships. The motion carried unanimously.

PUBLIC WORKS

Motion was made by Commissioner Wachal and seconded by Commissioner McClure to adopt
Board Action 19-185: Approve the purchase of two, model 115929-03 TDC-150 cm hand held GPS
handheld devices, for ditches, from Frontier Precision, Inc., in the amount of $15,470.00. The motion
carried unanimously.

HERON LAKE WATERSHED DISTRICT

Representatives of the Heron Lake Watershed District were in attendance with a request for Jackson
County to issue general obligation drainage bond on behalf of the Heron Lake Watershed District as the
costs to the County to bond, on their behalf, could be done more cheaply. There was discussion and
concerns expressed about the capabilities of the Heron Lake Watershed District to act as a drainage
authority, as evidenced by their inability to be able to obtain gap financing and bond as cheaply as the
County and provide the same level of staff to manage and maintain drainage improvements.

Motion was made by Commissioner Eigenberg and seconded by Commissioner Nasby to adopt
Board Action 19-186: Approve request for issuance of General Obligation Drainage Bond on behalf of
the Heron Lake Watershed District (as related to County Ditch #3). The motion failed with two “ayes”
(Eigenberg, Nasby) and three “nays” (Hohenstein, Wachal & McClure).

AUDITOR/TREASURER

Motion was made by Commissioner McClure and seconded by Commissioner Wachal to adopt
Board Action 19-187: Approve basic sale prices and authorization of Public Sale of Tax Forfeited
Land, as described on List of Tax Forfeited Land 2019-1, at 10:00 a.m., August 13, 2019, with the sale
to be held at the Jackson County Courthouse Board Room, 405 4 th Street, Jackson, Minnesota, and that
the conditions and terms of the public sale shall be described in the "Terms for the Sale of Tax-
Forfeited Land in Jackson County" and in "Facts You Should Know Before Purchasing Jackson County
Land Forfeited to the State of Minnesota for Non-Payment of Real Estate Taxes". The motion carried
unanimously.

LAND MANAGEMENT

Motion was made by Commissioner Hohenstein and seconded by Commissioner Eigenberg to


adopt Board Action 19-188: Approve the voluntary surrender of a conditional use permit, as issued to

Michael Roehrs, to construct a dry mill farm based ethanol plant in April of 2007, with the ethanol
plant never being built at the NE ¼ of the SE ¼ of Section 12 of Petersburg Township, Parcel
#14.012.0600. The motion carried unanimously.

COUNTY COORDINATOR

Discussion was held regarding building and grounds needs/structure. Chair Hohenstein directed the
Personnel Committee to meet with County Coordinator, Steve Duncan, and Public Works Director,
Tim Stahl.

Motion was made by Commissioner Eigenberg and seconded by Commissioner Wachal to adopt
Board Action 19-189: Approve Industrial Water Supply and Distribution Agreement (related to
Pipeline Repayment Agreement of 9/10/2003 between Jackson County, City of Heron Lake and
Minnesota Soybean Processors/Heron Lake BioEnergy, LLC) and authorize Vice Chair McClure to
execute the agreement. Commissioner Hohenstein recused herself from voting. The motion carried
with four “ayes’, no “nays,” and one “recuse” (Hohenstein).

BOARD REPORTS

Commissioner Nasby reported on meetings/events involving the Fair Association, Friends of the
Jackson County Trails and a water drainage conference.

Commissioner McClure reported on meetings/events involving One Watershed One Plan, Southwest
Mental Health Center, Des Moines Valley Health and Human Services (DVHHS) and the Southwest
Regional Development Commission (SRDC) annual meeting.

Commissioner Hohenstein reported on meetings/events involving Heron Lake Watershed District,


DVHHS, DVHHS Personnel Committee and the SRDC annual meeting.

Commissioner Eigenberg reported on meetings/events involving Heron Lake Watershed District, Fort
Belmont, Heron Lake City Council, DVHHS, Minnesota Department of Transportation meeting in
Heron Lake, Library Board and Okabena City Council.

Commissioner Wachal reported on meetings/events involving a Clean Energy Resource Team


(CERTS) webinar.

CLOSED MEETING

Motion was made by Commissioner Wachal and seconded by Commissioner McClure to close the
meeting, at 12:01 p.m., as permitted by Minnesota Statutes Section 13D.01 and 13D.03, to discuss
labor negotiations and strategy.

Motion was made by Commissioner Eigenberg and seconded by Commissioner Nasby to re-open
the meeting at 12:24 p.m.. The motion carried unanimously.
