EXTRA JUDICIAL SETTLEMENT OF

THE ESTATE OF BUDRICK BARRY BIAS

KNOW ALL MEN BY THESE PRESENTS:

This EXTRAJUDICIAL SETTLEMENT is made and executed by and

among:

1. MELCHORA PALER BIAS, of legal age, widow, Filipino

Citizen, with residence and postal address at Park Rubia Bandera Polanco,
Zamboanga del Norte;

2. JANET BEATRICE PALER BIAS, minor, born on 22 May 2009

to Melchora P. Bias and decedent, Budrick Barry Bias, duly represented
herein by her mother and legal guardian;

A copy of Certificate of Live Birth is attached hereto and made an

integral part hereof as Annex “A”;

And

3. JOHNATHAN BRYANT PALER BIAS, minor, born on 14

April 2008 to Melchora P. Bias and decedent, Budrick Barry Bias, duly
represented herein by her mother and legal guardian;

A copy of Certificate of Live Birth is attached hereto and made an

integral part hereof as Annex “B”;

WITNESSETH

1. That MELCHORA PALER BIAS is the legitimate spouse of

BUDRICK BARRY BIAS (“decedent”) who died on 19 April 2018 in
Turno, Dipolog City;

A copy of Certificate of Live Birth is attached hereto and made an

integral part hereof as Annex “C”;

2. That JANET BEATRICE PALER BIAS and JOHNATHAN

BRYANT PALER BIAS are the legitimate children of the above-mentioned
decedent;

3. That collectively, the parties herein are the only legitimate and
surviving heirs of the decedent who died intestate and left his share or the
aliquot portion in the co-ownership of the following real properties:

4. The decedent also left a personal bank account at Bank of the

Philippine Islands, Dipolog City Branch under ACCOUNT No. 001824-
0133-53, with a remaining balance of Four Thousand Sixty Five and 41/100
(Php 211,563.23) United States Dollars ($4,065.41), as of 04 May 2018.

WHEREAS, there are no known debts or obligation due against the

estate of said decedent;

WHEREAS, to the best knowledge and information of the

undersigned, the said deceased left no will;

WHEREAS, it is to the best interest of the parties hereto that the

above described real and personal property shall be PARTITIONEED,
ADJUDICATED and DIVIDED EQUALLY, among themselves the above-
mentioned properties, extra-judicially, in the manner and form hereinafter
set forth;

NOW THEREFORE; for and in consideration of the foregoing

premises, and invoking the provision of Sec. 1 Rule 74 of the Rules of
Court, the parties hereto have by these presents agreed as they hereby do
so agree to divide, partition and adjudicate the above-described real
property equally among themselves, adjudicating as they adjudicate in the
manner provided in the preceding provision;

Subject, however to the liabilities by Rule 74 Section 4 of the Rules of

Court, in favor of any other possible heirs, creditors and other persons who
might be deprived of their lawful participation in the estate of the
decedent, for a period of two (2) years;

That, in the remote event that any other property of the decedents
should ever be found which is not included herein-above, the parties
hereto further agree as they do so agree to settle and distribute the same in
like manner and proportion as herein established and disposed.

IN WITNESS WHEREOF, we have hereunto set our hands this
