3 SUSPENSION IR TERMINATION OF SERVICES

If circumstances arise for which the Civil Engineer is not responsible and which make it i

mpractical or impossible for the Civil Engineer to perform in whole or in part the Services in acc

ordance with their Agreement then the Civil Engineer shall promptly notify the Client of the sam

e.

If by reason a certain services had beed suspended , the time for their completion shall be

extended by the extent of the delay plus a reasonable period for their resumption, or if the speed

of performinf certain Services has to be reduced, the time for their completion shall be extended

as is necessary by reason of their circumstances.


Common Reasons for Project Delays

Regardless of your role in construction, you’ll have noticed that almost all the construction proj

ects don’t finish in their contractual finish date. In fact, a delayed project has become a very nor

mal thing to witness and at a certain point, it almost feels like it’s an unavoidable outcome. How

ever, delays in most construction projects delay could actually be avoided if a proper project stud

y was conducted.

● Inefficient Management
The construction knowledge we have today enables us to conduct proper manage

ment for construction projects to ensure the delivery of the desired quality within the requ

ired time. Without this management, the above-mentioned requirements cannot be achiev

ed. On the contrary, a more severe outcome might wait just around the corner if your con

struction management process wasn’t up to speed.

● Construction implementation failure

Executing a construction project requires the full knowledge of the method statem

ents made for each construction item/element; that’s why it’s essential for any contractor

to submit these method statements before the start of the project to ensure they are approv

ed and that they will enable the engineers to execute the construction works properly to m

eet the required quality and specifications.

Thus, one of the common causes of construction project delays is the contractor’s
failure to execute certain items properly which results in re-doing the whole process agai

n after discovering what went wrong in the execution. Each item must be studied accurate

ly to reach the specific construction method by which it can be constructed.

● Environmental Catastrophes/Unavoidable Events

Each construction project that lasts more than a year will definitely be exposed to

some unavoidable environmental events due to the change of seasons throughout the year.

For example, in the winter there are some heavy rainy days that make it absolutely impos

sible for workers to execute any construction activity (especially concrete).When such cir

cumstances take place, all the safety measures can do is protect the workers’ lives. Nevert

heless, safety cannot enable them to overpass these conditions and continue the execution

phase.
However, environmental catastrophes can be a lot of things other than rain. Here are a fe

w examples of the possible events:

● storms

● hurricanes

● earthquakes

● extreme temperature status, etc.

● Design Issues

Each construction project can be summed up in 3 phases that represent all the acti

vities required to finish the project from day one until the very last day of the project. In s

hort, these phases are:

Here we will talk mainly about the very first stage (Design). This stage can be a re

al threat to the timeline of the project as its problems mostly get discovered in the executi
on phase. No matter how well the design is revised or reviewed, the execution phase sho

ws you exactly what’s wrong with the design. It might actually be discovered in a very ha

rsh way where you, for example, construct a concrete element and then see it collapse or

deform within days from its construction.

The design issues are various and their number is so big that it can delay a project

for months once it’s discovered. Now we can understand the importance of the engineerin

g work (Shop-drawing) required before and within the execution phase. It does not only h

elp the execution team to implement the project properly, but it also helps to find the prob

lems in the design in the early stages of the project, giving us time to solve the problem b

efore the corrupted element execution time.

● Scope Increase

As we all know, any project’s main parties are:


● The owner (client)

● The engineer (consultant)

● The contractor

However, the owners usually start the projects without knowing the full details of

what or how they want it to be in the future. For instance, the owner decides that the proje

ct is going to consist of 4 buildings, 3 of them are designed but the 4th one is yet to be det

ermined/designed. So they start the project until they decide what to do with the rest of th

e project that the contractor is not aware of, in this case, the owner tells the contractor tha

t there is going to be an increase in their scope, which by default means an increase in the

project duration.

● Economical Changes

We all know that construction is after all an industry that gets affected by the econ

omic conditions of the country just like any other industry. Thus, if any country was subj
ected to an economic collapse or its currency value has changed, all the construction proj

ects will be affected in so many ways, one of them is “delay”. Due to the surprising chan

ge in the price of everything, the project cash flow becomes dull and no longer represents

the true valued/budgeted cost per time. This immediately drops a massive effect on the pr

oject’s timeline making it double or triple the original duration (maybe put the project on

hold or even exterminate it) unless both the contractor and the owner can find/afford a fin

ancial solution to the catastrophe.

● Failure in Coordination Between Time Schedule and Execution

One of the common mistakes made by contracting companies is neglecting the im

portance of a time schedule for the project. A proper time schedule enables the project to

be executed smoothly and according to the required time frame.

The Client may suspend all or part of the Services or terminate the Agreement by written

notice of not less than 30 days to the Civil Engineer who shall immediately make arrangements t
o stop the Services and minimize further expenditure.

The Civil Engineer by written notice of no less than 30 days may terminate the Agreemen

t or at his and or her discretion without prejudice to the right to terminate, suspend the performan

ce of the whole or part or the Services under the following conditions:

● When 30 days after the due date or payment of any account the Civil Engineer has not rec

eived payment of that part of which has not by that time been contested in writing, or

● When Services have been suspended for a period exceeding 6 calendars months, or if it is

clear to the Civil Engineer that it will be impossible or impractical to resume the suspend

ed Services before the period of suspension has exceededbsix months.


When the Services are suspended or terminated the Civil Engineer shall be entitled to paymen

t for the Services carried out including consequential costs, expenses and disruption fees incurred

as a result of the suspension or termination, and remobilization fees on resumption. Suspension

or termination of the Agreement shall not prejudice or affect accrued rights or claimes and liabili

ties of the parties.

1.3.5 SETTLEMENT OF DISPUTES

If a dispute arises on either party, then that party shall by notice in writing served on the o

ther party of the details of the dispute and request that the dispute be resolved by conciliation. If t

he matter in dispute is not resolved in consiliation between the parties within the prescribed time

then the matter im dispute shall be reffered to arbitration.

1.3.6 OWNERSHIP OF DATA L, DESIGNS, AND DOCUMENTS


The design analyses, drawings, specifications and reproductions thereof are instrumentsbof s

ervice owned by the Professional Engineer and shall be used only for the specific project covered

by the agreement between the client and Engineer.
