Item Description:- Hiring of Truck of loading capacity 4.5 MT and running upto 2000 km per month (with 24

. SPECIAL CONDITIONS & SCOPE OF WORK Name of the work :- Hiring of

Truck/Lorry should be made available round the clock in the premises of


SSE/Br/SUR's Depot at SUR respectively or at place nominated by Engineer's
Representative. During non-working hours, Truck/Lorry is to be stabled at a
place nominated by Engineer's Representative. The Truck is required for
movement between any station to any station within SUR division for
inspection and maintenance of bridges and also during breakdowns.
Occasionally truck will be sent at places outside SUR division preferably within
the Jurisdiction of Central railway including overnight journey and stay at night.
No separate payment will be made for such movement. BSL, NGP, PA,
MUMBAI, MMR are some major places where the truck will be deputed as per
the need and directives of Engineer-in-charge. The vehicle should be in good
working condition should not be more than 5 years old at the time of issue of
acceptance letter. Its road worthiness should have been certified by RTO
officials. The performance of engine and other components should be
satisfactory. Before commencement of contract the vehicle proposed shall be
presented to Engineer or his representative for judging its overall condition. If
in the opinion of Engineer certain improvements are required, the same will be
carried out before induction. In case the vehicle cannot be improved, another

vehicle has to be inducted. The decision on acceptability or otherwise by
Railway shall be final and contractor will bound to replace the vehicle if it goes
frequently out of order. It should not be owned by any railway officer/staff or by
their family members in full or part share basis. It should be compatible for
entry in Mumbai city area. Contractor should obtain permit to carry Railway
employees to work spot for maintenance of various bridges located in the
concerned division. During the currency of the contract the truck shall be
provided at SSE(Br)SUR's depot. Normally, the truck/Lorry along with
competent Driver & Assistant shall be readily available between 7.30 hrs to
19.00 hrs on all working days. If there is any change of timing, decision will be
intimated one day in advance. No additional/extra payment will be made in
case of any extra working hours. In case of Break downs/Disruption of
Traffic/Emergencies/Urgent situations, if required by Railway, the Truck along
with Driver and Assistant shall be ready within 30 minutes from the receipt of
telephonic communication from Railway Representative on any of the specified
numbers of Contractor/Driver. The driver should daily make necessary entry of
arrival and departure time in the log sheet with "On duty staff" of SSE(Br)SUR
depot.

The monthly unit rate per Truck shall include overall distance of 2000 kms per
month for SSE(Br)SUR depot, including cost of fuel, oil and other consumable,
salary of Driver & Assistant , road tax, repair and servicing charges, insurance
charges etc. For SSE(Br)SUR 's depot, the overall monthly ceiling of 2000 kms
will be worked out on quarterly basis. The rate shall be all inclusive and no
other additional payment upto 2000 kms per month adjustable once in quarter
i.e. 6000 kms per quarter will be paid. The contractor shall provide truck with
competent driver and Assistant. They should be suitably dressed, well
mannered and well acquainted with the area. They shall attend the duty on
time in proper and clean uniform with name badge and with valid driving
license suitable for the vehicle. The contractor shall ensure that driver shall not
be in an intoxicated state and in such cases Railways shall be at the liberty of
cancelling the truck and imposing penalty for truck not provided. During the
course of duties, they shall behave in a courteous and disciplined manner and
not act in any manner, which can cause loss of material/property/reputation of
railway. The lunch timings of truck driver shall be flexible and will be decided
by the concerned Railway representative. Proof of address of driver, assistant
and owner of the truck/lorry should be furnished. The driver once nominated to
hired truck/lorry should not be changed without the advance notice of three
days/except in break downs/emergencies. Contractor shall ensure cleanliness
of the truck/lorry on daily basis as per instructions of Engineer's

representative. All repairs, consumables, maintenance taxes, driver's salary/
Bhatta etc. to be at contractor's account. Sufficient imprest must be given to
driver to take care of en-route refueling and breakdowns. On every day the
fuel tank of truck/lorry shall be filled to its full capacity. It is expected that
whenever fuel tank reaches to 50% of capacity. It should be refilled again to
100% capacity. In no case the truck shall be stabled en-route on this account.
Non-availability of truck due to any reason, for a period beyond 3hrs will be
treated as truck not provided for whole day (absentee). Absence of
driver/assistant for more than 3 hrs will also be treated as truck not provided
for a whole day. One day weekly rest will be permitted for truck. All repairs,
maintenance schedules, must be planned on the weekly rest day or a holiday
with prior approval of Engineer's representative and be completed timely. For
major repairs/maintenance schedule consecutive three days for every six
months will be permitted. The contractor along with offer shall produce one
land line number and one mobile no. available for 24 hrs to enable the railway
representative to communicate easily. In addition to that, the contractor shall
ensure that Driver has live mobile connection, during the currency of contract,
so that he is directly contactable wherever required. Truck must carry proper
sticker of "ON GOVT OF INDIA DUTY" on front and back side only during
railway working. Minimum wages to driver/assistant and other statutory
obligations shall be met by the contractor at his own cost.

The contractor in addition to the indemnity provided by law shall indemnify the
railway administration against all liability whatsoever to pay compensation
under workmen compensation act as mentioned from time to time in respect of
any accident/injury to any labour employed by him under this contractor or
compensation in respect of any claim arising out of or in the course of
employment under this contract. The contract should not assign or sublet the
contract or any part there of or allow any person to become interested there in
any manner what so ever without the permission in writing of the Railway. Any
breach of this condition shall entitle the Railway to rescind the contract and
also render the contract liable for payment to the Railway of any loss or
damage arising or ensuring from such cancellation. The truck should be
insured against accident etc as per State Govt Rules and statutory obligations.
Accidents occurring during the course of Railway work should inform
immediately by the contractor to Engineer's representative. This should be
followed by a detailed written report from the contractor. If there is delay in
reporting which is not justified in the solemn opinion of the railway, the Railway
shall be at liberty to make claim for the cost of entire consignment including
termination of contract and forfeiture of security deposit and Performance
Guarantee. The contractor is responsible for any accident or mishap and
compensation etc. Railways will not responsible for any liability whatsoever in
such matters including third party liability. Safety of Railway materials loaded in
truck as mentioned in the documents of Railway for transporting to destination
4 is the responsibility of the contractor. The contractor will be responsible and No No Not Allowed
shall have to compensate the Railway for loss or shortages of RLY materials.
Whenever advised by Engineer's representative, truck shall be provided with
removable cover (Tarpaulin) for protection of loaded material from weather.
Availability of current vehicle fitness certificate obtained from RTO should be
made available for verification at any movement. The tendered may please
note that no escalation/ extra payment on account of increase in rates of other
consumables and labour etc and will be made and the rated quoted shall be
firm and final during the currency of the contract. The driver the truck
nominated by the contractor shall maintain the daily log-sheets at own cost as
per specimen to be approved by the Engineer's representative, showing the
distance travelled in each trip and kilometer reading at the beginning and at
the end of journey and obtain signature of the officials /Employee using the
truck. Though the contract is awarded for 24 months, from the railway
administration has an every right to terminate the contract even before 24
months, with all consequences of risk and cost achieved as per clause 62 of
GCC with a notice of 15 days. The contractor is fully responsible for safe
running of vehicle. Central railway will not be responsible for any loss,
damage, repairs, maintenance or accident to the vehicle or driver. Central
railway administration in no case is responsible for any legal matter arising
breach rules/Acts/Laws of any state / Central Govt/local body in the matter of
employment of the driver by the owner of vehicle or in respect of any other
matter such as conduct and working of the driver etc.

Proof address of driver, cleaner and owner of the vehicle should be furnished.
The persons once selected will not be changed without the approval of railway.
Any illegal article/material transported, any time in the vehicle will result in
termination of contract. The SD available will stand forfeited. No
correspondence in this matter will be entertained. The quantities shown in the
schedule are approximate and meant to give the tenderer an idea of the
quantities of work done is involved. The railway reserves the right to
add/delete any items/and to increase/decrease the quantities by 25%.
However, the contractor will be required to execute the work at the same rate,
and terms and conditions up to a variation of 25% as per variation clause in
contract quantities. Standard GCC of Central Railway along with latest Railway
Board's directives will be applicable in this contract. Earnest money, security
Deposit and performance Guarantee shall be recovered as per rules. A fine at
the rate of double the daily hiring charges (to be worked out on pro-rata basis
of accepted monthly rate) shall be levied for first three absentees in each
month. For subsequent absentee in that month, fine at the rate of 5 (Five)
times the daily hiring charges will be imposed. Vehicle should be used only for
railway purpose during the contract period. If any other outside material is
found/ being transported a penalty of Rs.20,000/- for each such incident will be
levied and recovered . Any illegal article/material transported, any time in the

truck may result in termination of contract. The security deposit & performance
guarantee available shall stand forfeited. The decision of Engineer in this
matter will be final. No correspondence in this matter will be entertained. In
case of non-availability of vehicle due to any reason, Railway shall be at liberty
to hire the vehicle from alternative sources and the expenses made shall be
recovered from the outstanding bills. In case of default/delay of en-route
repairs, Railway official can undertake the repairs and expenses will be
recovered from outstanding bills including overhead charges as per extant
rule. If such breakdown/absentee occurs for three or more occasions in a
month, the railway reserves the right to insist for replacement of another
reliable truck and thereafter if the failures persist, to terminate the contract with
forfeiting the security deposit and performance guarantee. The decision of
railway in this respect is final and binding on the part of contractor. The
recovery of penalty/fine shall be made from the payment due/bills. Not with
standing anything contained in the other clause of the agreement. In the event
of unsatisfactory services or any failure/ breach at any time by the contractor
of the terms and provision of the agreement, the Contract shall by terminated
forfeiting the deposits of the contractor and contractor shall have no claim
whatsoever against the administration in consequence of such termination of
contract.

48.Where the road vehicle and or machinery are required to work in the close
vicinity of the railway line, the work shall be carried out such that there is no
infringement to the railways schedule of dimensions even for short period. For
this purpose, the area where road vehicle and or machinery are required to ply
shall demarcated and acknowledge by the contractor. Special care shall be
taken for turning/reversal of road vehicle machinery without infringing the
running track. Barricading shall be provided as per site conditions.
49.Contractor will ensure completion of work as per tender specification only.
SSE(Br)SUR will carry out the work required for satisfactory completion of work
but not in the tender. 50.Engineer's Representative: For this work SSE(Br)SUR
will be the Engineer's Representative. Loading & unloading: Loading &
unloading of all materials will be carried out by Railway. Completion period:
The hiring shall be for a period of 24 months from the date of induction after
approval of presented vehicle. The successful tenderer. Shall present the truck
within 15 days from the date of issue of letter of acceptance, to the Engineer's
Representative at SUR shown above respectively, for judging its overall
condition and approval for induction. 51.The contractor will not ply his vehicle
for transport of material crossing the track or very close to the track, which is

suitable penalized. 52.The rates quoted by the tenderer and accepted by
Railway shall hold good till completion of work and no additional individual
claim will be admissible on account of fluctuation in markets rates, increase in
taxes/ levies/toll etc. 53.Work shall be carried out as per tender schedule,
specification/ explanatory notes. 54.No claim for idle labour & ible machinery
etc. on any account will be entertained. Similarly no claims shall be entertained
for business loss or any such loss. 55.NO ambiguity, once the offer is
submitted is allowed. 56.The above list is only indicative and all contractors
must ensure protective and safety measures given in contract agreement and
the relevant acts, codes & manuals of railway and civil authority. 57.Scope of
work, detailed tender technical specification for schedule items is attached
herewith. However, in case of changes needed as per site condition
permission from SSE (Br) SUR is needed before the work is done. 58.The
president of India has the right to accept the lowest or any tender without
giving any reason for doing so. Note:- i) Whenever there is any conflict
between the General Condition of Contract and Special Conditions of Contract,
the latter shall prevail. ii) GST Registration number is made mandatory for all
bidders and to be submitted with the offer.
