AFFIDAVIT OF WITNESS

I, ARTURO S. VERTOSO , of legal age, Filipino, resident at Brgy

Ampayon, Butuan City, after having been duly sworn to law, hereby
depose and state:

1. That I have a piece of personal knowledge about the person of

JOSE A. GONZALEZ, who is the respondent of a criminal complaint filed
by ROGER DIMAAMPAO on behalf of his girlfriend AREOLA MARRIE L.
MALIBUGAN because he is my neighbor at the said place and my co-
workmate in the PNP PRO 13 CARAGA Butuan City since 2016-2018.

2. That the precise year allege in the complaint, that was 2016 to
2018, respondent PO1 JOSE A. GONZALEZ was being assigned in the
Office of Police Station in Butuan City of which I am his co-workmate in
the said office.

3. That PO1 and I, know the girl name AREOLA MARRIE L.

MALIBUGAN who is a claimed victim of the said case because she is one
of my friend from Surigao City. She is not a minor looking but a claimed
lady during that time.

4. That further, I remembered having accompanied with Jose

Gonzalez and that lady to Surigao City bringing her to Gaisano Capital
Surigao to go shopping.

5. That it is false to accuse JOSE with Rape because they cant go

anywhere without me and he is not done anything wrong against the
said woman. On the other hand, He has shown his sincere regard to the
lady and very well performed his responsibilities like that of a true
friend to her. And that was the only time that JOSE and ARIOLA MARRIE
meet and see each other. further, I didn’t even hear that they have a
relationship with each other.

6. That we execute this affidavit to attest to the truth of the

foregoing statements to request the investigating Counsel to dismiss the
case against the respondent and for whatever legal purpose it may
serve.
