AFFIDAVIT

I, SPO1 JOSE GUILLER PAMPLONA, of legal age, with

the residence at 100 Happy Homes, Baguio City, and a
Philippine National Police Officer assigned to the Scene of the
Crime Operatives (SOCO), Baguio City division, after having
been duly sworn to in accordance with law, do hereby depose
and state that:

1. I am a forensic police officer assigned to do duty for

SOCO, Baguio City.

2. My assigned time of duty for the whole month of

December 2019 is from twelve o’clock in the afternoon
(12:00 pm) up to eight o’clock in the evening (8:00 pm).
However, due to the nature of a forensic police officer’s
work, we can be called to respond at any time of the day.

3. My duties at the police station include responding to calls

for crime scene investigation.

4. On December 30, 2019, at about three o’clock in the

afternoon (3:00pm) while I was on-duty, SPO1 INGRID
CALIMLIM of police station no.6 located at Aurora Hill,
Baguio City relayed to us that a certain MR. MANOY
VILLAR called their station to report that they found
human remains already in skeletal form while they were
excavating the piece of lot where they are intending to
build an improvement.

5. After asking SPO1 Calimlim of the address where they

found the human remains, we proceeded to go to 123
Aurora Hill, Baguio City, the address where the human
remains were found. My colleague, SPO1 JOSE
MASARETE and I went to investigate.

6. We arrived at 123 Aurora Hill Baguio City at around four

thirty in the afternoon (4:30 pm). We were welcomed by
SPO1 Calimlim and her colleagues, Mr. Villar and two of
his employees working on the project who introduced
themselves as Mr. JOSE RIZAL and Mr. ANDRES

 BONIFACIO. We then proceeded to the excavated parcel
of lot were the human remains were found.

7. SPO1 Masarete and I went on to conduct our standard

operating procedure and protocols for crime scene
investigation in accordance with Standard Operating
Procedure No. ODIDM-2011-008.

8. We have the property and surrounding perimeter of

the crime scene photographed. The photographs taken
are attached to this affidavit as ANNEX “”

9. We then proceeded to tape the perimeter of where the

remains lie and proceeded to take photographs and to
collect physical evidence and recording of the same
attached to this affidavit as ANNEX “” to ANNEX “”

8. After taking photographs and collecting physical

evidence, we then briefed SPO1 Calimlim and her
colleagues on the initial results of our investigation. We
then accomplished CSI form 4 and furnished SPO1
Calimlim a copy thereof. A copy of CSI form 4 is herein
attached as ANNEX “”

9. We then left the crime scene and proceeded to submit

a copy of the photographs and samples of the collected
physical evidence to the Baguio Crime Laboratory
services in order to ascertain the identity of the remains.

10. On January 15,2020, SPO1 Calimlim went to us and

with her is Mr. MARK LUPIT. He claimed to be the father
of one of the previous owner of the property, Ms.
JENNIFER LUPIT, who he had no contact with for twenty
years (20 yrs.). He further claimed that she is missing
and is interested to have the remains be tested for DNA
analysis and agreed for the collection of his own DNA.
The sworn statement of Mr. Lupit as well as the request
for DNA analysis is attached to this affidavit as ANNEX “”

11. In the DNA results, it was confirmed that the remains

belong to Ms. Jennifer Lupit. The DNA analysis report is
herein attached as ____________________
