¾›=ƒÄåÁ c=y=M ›y=Âi” vKYM×”” ¾lØ WHEREAS, it is desirable to consolidate and


Ø`' ¾›e}ÇÅ`' ¾‚¡’>¡“ ¾›S^` wnƒ uTÖ modernize the aviation laws to bring them to international
“Ÿ`“ ¾}hK ¾c=y=M ›y=Âi” lØØ` ”Ç=•` standards with a view to strengthening the regulatory,
uTÉ[Ó ÅI”’~ ¾}Öuk' ŸT”—¨<U eÒƒ ’í administrative, technical and supervisory capabilities of the
¾J’' SÅu—' wnƒ ÁK¨<“ ›=¢•T>Á© ¾J’ ¾c= Ethiopian Civil Aviation Authority for better regulation of
y=M ›y=Âi” Y`¯ƒ” ¾Teð” õLÑAƒ” TTELƒ civil aviation to meet the needs for a safe, secure, regular,

SÅÑõ ”Ç=G<U Ÿ²=G< Ò` }ÁÁ»’ƒ ÁL†¨<” Organization and it is necessary to provide for the
K?KA‹ }Óva‹” TŸ“¨” uTeðKÑ<& promotion and continuous development of civil aviation
regulation and for other purposes incidental thereto;

Proclamation No 616/2008”.

2. ƒ`ÕT@ 2. Definitions

¾nK< ›Ñvw K?L ƒ`Ñ<U ¾T>ÁcÖ¨< "MJ’ In this Proclamation, unless the context otherwise
ue}k` u²=I ›ªÏ ¨<eØ& requires:

1/ &›ÅÒ& TKƒ ›”É c¨< u›¨<aፕL” KS 1/ “accident” means an occurrence associated with
H@É uTcw u›¨<aፕL” Ÿ}dð[uƒ Ñ>²? the operation of an aircraft, which takes place
ËUa eŸT>¨`ድuƒ É[e vK¨< Ñ>²? between the time any person boards the aircraft
¨<eØ Ÿ›¨<aፕL’< ”penc? Ò` Ó”–<’ƒ with the intention of flight until the time such
ÁK¨< J•' person has disembarked, in which:

G( u}ðØa U¡”Áƒ' u^c< ¨ÃU uK?KA‹ a) the person is injured as a result of:
c−‹ É`Ñ>ƒ U¡”Áƒ ¨ÃU KS”ÑÅ™‹
¨ÃU K›¨<aፕL” W^}™‹ ŸT>Ñv¨< x
¨<ß uÉwp c=Õ´ ከT>Å`euƒ Ñ<ǃ

(1) u›¨<aፕL’< ¨<eØ uSJ’<


(1) being in the aircraft;
(2) Ÿ›¨<aፕL’< ›"M ¨ÃU ከ›¨aፕL’<
ከ}Ñ’ÖK< ›"Lƒ Ò` uk؁ uS’" (2) detached from the aircraft, or

(3) K˃ õ”ǁ uk؁ uSÒKÖ<' (3) direct exposure to jet blast;

¾T>ÁÒØS¨< Ñ<ǃ' except when the injuries are from natural causes,
self inflicted or inflicted by other persons, or when
the injuries are to stowaways hiding outside the
K( uV}\ "¨<K=”Óe ¨ÃU ›v] ¡õKA‡ Là areas normally available to passengers and crew;
ከT>¨c” ¾V}` wMiƒ ¨ÃU u}iŸ`"]
›"K<' u›”‚“¨<' uÔT¨< ¨ÃU uõ_’< (b) the aircraft sustains damage or structural

e”Øq‹ ue}k` ¾›¨<aፕL’<”'
(1) adversely affects the structural
(1) ›"L© Ø”"_ ¨ÃU ¾u[^ wnƒ strength or performance of the
¾T>Ád×' “ aircraft; and

(2) would normally require major repair or


(2) ¾}ÑAǨ< ¡õM ŸvÉ ØÑ“ ”Ç= replacement of the affected component,
Å[ÓKƒ ¨ÃU ”Ç=K¨Ø ¾T>Áe except for engine failure or damage, when
ÑÉÉ' the damage is limited to the engine, its

¨ÃU limited to propellers, wing tips, antennas,
tires or brakes failings or small dents or
puncture holes in the aircraft skin; or

¾TÃÅ[euƒ SJ”' c) the aircraft is missing or is completely
’¨<& inaccessible.

2/ &›?`ÁM Y^& TKƒ ›”É” ›¨<aፕL” 2/ “aerial work” means an aircraft operation in which
”Å `h' Ó”v' ö„ T”dƒ' p¾d' an aircraft is used for specialized services such as
p˜ƒ' ðMÔ TÇ”' ¾›?`ÁM Te¨mÁ“ agriculture, construction, photography, surveying,
uSdcK< M¿ ›ÑMÓKA„‹ Là ¾T>ÁሰT^ observation and patrol, search and rescue or aerial
¾›¨<aፕL” *ፕ_i” ’¨<& advertisement;

3/ “aerodrome” means an area of land or water


3/ &›¨<aፕL” T[òÁ& TKƒ uS_ƒU J’ intended to be used wholly or in part for the
u¨<H Là uŸòMU J’ uS<K< K›¨<aፕL” landing, take-off, movement or servicing of
T[òÁ' S’h' S”kdkh ¨ÃU SÑMÑÁ aircraft and includes buildings, installations and
¾}ŸKK x c=J” u²=G< ¡MM ¨<eØ“ equipment on or adjacent to such area used for
u›ªd–< K’²=G< }Óva‹ ¾T>¨<K< Q”é these purposes;

^M& 4/ “air carrier” means an air operator that engages in
the provision of transportation services by aircraft
4/ &¾›¾` ›ÕÕ»& TKƒ uSÅu— ¨ÃU for remuneration or hire, whether directly or
u‰`}` uk؁ ¨ÃU k؁ vMJ’ Ÿ=^Ã
indirectly by lease or other arrangements, on
¨ÃU uK?KA‹ eUU’„‹ u›¨<aፕL”
schedule or charter basis;
¾ƒ^”eþ`ƒ ›ÑMÓKA„‹” u¡õÁ ¨ÃU
uŸ=^Ã KSeÖƒ ¾}cT^ ¾›¾` *ፕ_}`
’¨<&
5/ “aircraft” means any vehicle that can derive
support in the atmosphere from the reactions of the

KS”dðõ ¾T>Áe‹K¨<” ÉÒõ ŸS_~ air other than the reactions of the air against the
Ñê dÃJ”' Ÿ›¾\ G<’@ ¾T>Áј T”— earth's surface;
¨<U u^] SX]Á ’¨<&
6/ “aircraft engine” means any engine used, or
6/ &¾›¨<aፕL” V}`& TKƒ uØpU Là intended to be used, for propulsion of aircraft and
¾ªK ¨ÃU K=¨<M ¾cu ¾›¨<aፕL’< includes all parts, appurtenances and accessories
T”kdkh V}`“ T“†¨<U ¾²=G< ¡õM“ thereof other than propellers;
›"M c=J” ¨<MwMu=ƒ” ›ÃÚU`U&
7/ “aircraft operator” means any person engaged in
7/ &¾›¨<aፕL” *ø_}`& TKƒ u›¨<aፕL” an aircraft operation;
*ፕ_i” ¾}cT^ T”—¨<U c¨< ’¨<&
8/ “air navigation” means the operation of guiding an
8/ &የAየር “y=Ñ@i”& TKƒ ›¨<aፕL”” Ÿ›”É aircraft from one place to another, and includes the
x ¨Å K?L x SU^ƒ c=J”' ›¨<a fixing of the position of an aircraft;
ፕL’< u›¾` Là vK Ñ>²? ƒ¡¡K— x¨<”
¾T¨p }Óv`” ÃÚU^M&
9/ “air navigation facility” means any area, lights,
9/ &¾›¾` “y=Ñ@i” SÑMÑÁ& TKƒ ›¨<ሮፕL” apparatus or equipment for disseminating weather
c=u`' c=Á`õ ¨ÃU c=’d KSq×Ö` information, signaling, radio directional finding,
¾T>ÁÑKÓM T”—¨<U x' ¾w`H” radio communication or any other facility for
SX]Á' ¾›¾` G<’@ S[Í Tc^Ý' guiding or controlling flight in the air or the
¾c=Ó“M' ¾›p×Ý SðKÑ>Á ¨ÃU ¾_Ç=Ä landing and take-off of aircraft;

SÑMÑÁ ’¨<&
10/ ''air route” means the airspace designated by the
0/ &¾u[^ SeS`& TKƒ uvKYM×’< K›¾` Authority for air navigation;
“y=Ñ@i” ¾}SÅu ¾›¾` ¡MM ’¨<&
11/ "air service" means an air transport service or an
01/ &¾›¾` ›ÑMÓKAƒ& TKƒ uSÅu—’ƒU J’ aerial work service, whether regular or casual;
›Mö ›Mö ¾T>cØ ¾›¾` ƒ^”eþ`ƒ
¨ÃU ¾›?`ÁM Y^ ›ÑMÓKAƒ ’¨<&
12/ “air traffic control service” means provision of
02/ &¾›¾` ƒ^ò¡ lØØ` ›ÑMÓKAƒ& TKƒ
service to prevent collisions between aircrafts or
›¨<aፕL” Ÿ›¨<aፕL” ¨ÃU Ÿ›Å“nò with obstructions, and for expediting and
’Ñ` Ò` Ó߃ ”ÇÃÅ`euƒ“ ¾›¾`
maintaining of an orderly flow of air traffic;

”Ç=Öup ¾TÉ[Ó ›ÑMÓKAƒ ’¨<&

03/ &Ku[^ wl SJ”& TKƒ uvKYM×’< u} 13/ “airworthiness” means the ability of an aircraft,
¨c’¨< SW[ƒ ›”É ›¨<aፕL” Ÿ›eðLÑ> with all its necessary components and
›"L© ¡õKA‡“ }Ñ×T> °n−‡ Ò` }Ó accessories, to perform its function satisfactorily
v\” uum G<’@ TŸ“¨” S‰M ’¨<& as determined by the Authority;

04/ &›ፕK=Á”e& TKƒ uu[^ Là LK ›¨<aፕL” 14/ ''appliances'' means instruments, equipment,
“y=Ñ@i”' *ø_i” ¨ÃU lØØ` ¾T>ÁÑKÓK< apparatus, parts or accessories which are used or
¨ÃU KTÑMÑM ¾kÆ SX]Á−‹' °n−‹' intended to be used, in the navigation, operation
SÑMÑÁ−‹' ¾›¨<aýL” ¡õKA‹ ¨ÃU }Ñ
×T> ›"Lƒ c=J’<' û^g<„‹”“ ¾›¨<aýL’<' or control of aircraft in flight including
¾V}a‡ ¨ÃU ¾¨<MwK=u=„‡ ¡õKA‹ ÁMJ’< parachutes and communication equipment and
uu[^ ¨pƒ Ÿ›¨<aýL’< Ò` ¾}ÑÖS< ¨ÃU any other mechanism installed in or attached to
¾}ÁÁ²< ¾SÑ“— SX]Á−‹”“ K?KA‹ Y` aircraft during flight, and which are not parts of
¯„‹” ÃÚU ^M& aircraft, aircraft engines or propellers;

05/ ¾}k’c ´p}— ¾Ÿõ SKÁÁ ¾›¾` ¡MM$
TKƒ ukד¨< ¾›¾` “y=Ñ@i” eUU’ƒ SW
15/ “reduced vertical separation minimum airspace”
means airspace where, based on regional air
[ƒ u›¨<aፕL•‹ S"ŸM ¾3) T@ƒ` ¨ÃU
navigation agreement, a vertical separation
የ1ሺ ÝT SKÁÁ }Óv^© ¾J’uƒ ¾›¾`
¡MM ’¨<:: minimum of 300 meter or 1000 feet applies ;

06/ &¾›y=Âi” vKS<Á& TKƒ ¾c=y=M ›y=Â 16/ “aviation personnel” means any individual who

G( u›³» ûÃKƒ’ƒ' uûÃKƒ’ƒ' uS" a) any individual who engages as pilot in


’>¡’ƒ ¨ÃU uu[^ W^}™‹ ›vM’ƒ command, pilot, mechanic or member of the
¾T>W^ ¨ÃU ›¨<aፕL’<” uu[^ Là crew, or who navigates an aircraft while the
ÁK ¾T>S^ T”—¨<”U c¨<& aircraft is underway;

K( u›¨<aፕL”' u›¨<aፕL” V}a‹ ¨ÃU b) any individual in charge of the inspection or


¨<MwMu=„‹ ¨ÃU ›ፕK=Á”f‹ ¾‚¡’>¡ maintenance of aircraft, aircraft engines or
lØØ` ¨ÃU ØÑ“ }Óv` Là uLò’ƒ propellers or appliances; or
¾T>c^ T”—¨<”U c¨<' ¨ÃU

N( uu[^ }q××]’ƒ' ¾›¾` ƒ^ò¡ c) any individual who serves in the capacity of
}q××] ¨ÃU u›¨<aፕL” Ç=eû†` flight controller, air traffic controller or
S¢””’ƒ ¾T>c^ T”—¨<”U c¨<' aircraft dispatcher officer;

17/ “civil aireraft” means aircraft other than state
07/ &c=y=M ›¨<aፕL”& TKƒ T”—¨<U ¾S” aircraft;
Óeƒ ÁMJ’ K?L ›¨<aፕL” ’¨<&

08/ &¾”ÓÉ u[^& ¨ÃU &¾”ÓÉ ›¾` 18/ “commercial flight” or “Commercial air
ƒ^”eþ`ƒ& TKƒ S”ÑÅ™‹”' ß’ƒ” transport” means an aircraft operation involving
¨ÃU þe” u¡õÁ ¨ÃU uŸ=^à the transport of passengers, cargo or mail for
¾T>ÁSLMe ¾›¨<aፕL” *ø_i” ’¨<& remuneration or hire;

09/ &¾u[^ ›vM& TKƒ uu[^ Là vK ›¨<a 19/ “crew member” means a person assigned by the
ፕL” ¨<eØ ¾}¨c’< }Óva‹” ”Ç= operator to perform specific duties in aircraft in
ÁŸ“¨<” u*ፕ_}\ ¾}SÅu c¨< ’¨<& flight;

!/ &›ÅÑ— ¡MM& TKƒ u›”É u}¨c’ ¾›¾` 20/ “danger area” means an airspace of defined
¡MM“ ¾}¨c’ Ñ>²? ¨<eØ K›¨<aፕL” dimensions within which activities dangerous to
u[^ ›ÅÑ— ¾J’< ”penc?−‹ ¾T>"H@ the flight of aircraft may exist at specified times;

¨pƒ KÖ?“' Ku[^ ÅI”’ƒ ¨ÃU posing risk to health, safety or property when
K”w[ƒ ›eÑ> G<’@” ¾T>ðØ` T”—¨<U transported by air;

!2/ &¾GÑ` ¨<eØ ¾›¾` ƒ^”eþ`ƒ& TKƒ 22/ “domestic air transportation” means transportation
u›=ƒÄåÁ ¨<eØ vK< x−‹ SHŸM by air carried out between places in Ethiopia;
¾T>Ÿ“¨” ¾›¾` TSLKe }Óv` ’¨<&
23/ “Ethiopian aircraft” means any aircraft registered
!3/ &¾›=ƒÄåÁ ›¨<a–L”& TKƒ u›=ƒÄåÁ in Ethiopia;
¾}S²Ñu T”—¨<U ›¨<a–L” ’¨<&
24/ “flight crew member” means licensed crew
!4/ &¾u[^ W^}™‹ ›vM& TKƒ uu[^ member charged with duties essential to the
¨pƒ K›¨<a–L” u[^ Y^ }ðLÑ> uJ’<
operation of an aircraft during a flight duty
}Óva‹ LÃ ¾}SÅu ðnÉ ÁK¨< ¾u[^
W^}— ’¨<& period;

!5/ &¾u[^ ¨pƒ& TKƒ ›”É ¾u[^ W^} 25/ “flight duty period” means the total time from the
™‹ ›vM Y^¨<” ŸT>ËU`uƒ Ñ>²? ËUa moment a flight crewmember commences duty
›”É” u[^ ¨ÃU }ŸÃ u[^−‡” to the moment the he is relieved of all duties
›Ö“pq ŸG<K<U }Óva‹ ’í eŸT>J”uƒ having completed such flight or series of flights;
ÁK¨< Ñ>²? ’¨<&

!6/ &¾¨<ß ›Ñ` ›¨<aፕL”& TKƒ u›=ƒÄåÁ 26/ “foreign aircraft” means any aircraft not
¨<eØ ÁM}S²Ñu T”—¨<U ›¨<aፕL” registered in Ethiopia;

!7/ &¾¨<ß ›Ñ` ›¾` ›ÕÕ»& TKƒ u›=ƒÄ 27/ “foreign air carrier” means an air carrier, not
åÁ Ó³ƒ ¨ÃU ¾›¾` ¡MM ¨<eØ u”ÓÉ being an Ethiopian air operator engaged in
›¾` ƒ^”eþ`ƒ }Óv` LÃ ¾}cT^ commercial air transport operations within the
›=ƒÄåÁ© ÁMJ’ ¾›¾` ›ÕÕ» ’¨<& borders or airspace of Ethiopia;

!8/ &ÖpLL ¾›y=Âi” ›ÑMÓKAƒ& TKƒ u¡õÁ


¨ÃU uŸ=^à ከT>cØ SÅu—“ SÅu— 28/ “general aviation services” means all civil aviation
"MJ’ ¾›¾` ƒ^”eþ`ƒ *ø_i” ¨<Ü operations other than scheduled air services and
ÁK ¾c=y=M ›y=Âi” ›ÑMÓKAƒ ’¨<& non-scheduled air transport operations for
remuneration and hire;

!9/ &uu[^ LÃ& TKƒ S”ÑÅ™‹ Ÿ}dð\ 29/ “in flight” means at any time from the moment
u%EL ¾›¨<aፕL’< ¾¨<ß ua‹ ከT>²Ñ<uƒ when the external doors of an aircraft are closed
Ñ>²? ËUa ua‡ S”ÑÅ™‡” KT^Ñõ following embarkation until the moment when
eŸT>Ÿð~uƒ É[e ÁK Ñ>²? ’¨<& vM} any such door is opened for disembarkation;
Öuk G<’@ KT[õ uT>ÑÅÉuƒ Ñ>²? Ó” in the case of forced landing, the flight shall be
¾T>SKŸ†¨< vKYMדƒ K›¨<aፕL’<“ deemed to continue until the competent
u›¨<aፕL’< ¨<eØ LK< c−‹“ ”w[ƒ authorities take over responsibility for the
Lò’ƒ eŸ T>¨eÆuƒ Ñ>²? É[e u[^¨< aircraft and for the persons and property aboard;

"/ &›KU ›kõ ›¾` ƒ^”eþ`ƒ& TKƒ 30/ “international air transportation” means
Ÿ}¨c’ ¾›=ƒÄåÁ x ¨Å }¨c’ ¾¨<ß transportation by air between a place in Ethiopia
›Ñ` x ¨ÃU Ÿ›=ƒÄåÁ }’e„ u¨<ß and a place outside thereof, or from and to a
HÑ` uT[õ ¨Å ›=ƒÄåÁ ¾T>Å[Ó ¾›¾`
place in Ethiopia with a stopping outside

thereof;

04. u˃ 14. Budget

1/ ¾²=I ›”kê ”®<e ›”kê (2) É”ÒÑ@ ”Å 1/ Without prejudice to the provisions of sub-article (2) of
}Öuk J• ¾vKYM×’< u˃ uS”ÓYƒ this Article, the Authority's budget shall be drawn from

1/ Upon registration of an aircraft, the Authority

¾U´Ñv Ue¡` ¨[kƒ Ãc×M:: registration.

2/ ¾›¨<a–L” vKu?ƒ’ƒ” uT>SKŸƒ uT>’d 2/ A certificate of registration shall raise a


¡`¡` ¾U´Ñv Ue¡` ¨[kƒ ¾vKu?ƒ’ƒ presumption of ownership of an aircraft in any

3/ A certificate of registration of an aircraft may be

The validity of any registered document, unless the

c=vM ÏÓ u×U Ÿõ}— ¾ÅI”’ƒ possible degree of safety in the public interest.

24. Airworthiness Certificate

1/ No person shall fly an aircraft within the airspace
1/ T”—¨<U c¨< u²=I ›ªÏ ¨ÃU u}S of Ethiopia unless it has a valid certificate of
²Ñuuƒ ›Ñ` QÓ SW[ƒ ¾u[^ wl’ƒ airworthiness issued under this Proclamation or
¾Ue¡` ¨[kƒ ÁM}cÖ¨<” ›¨<aፕL” under the laws of the state in which the aircraft is
u›=ƒÄåÁ ¾›¾` ¡MM ¨<eØ Tw[` registered.
›Ã‹MU::
2/ In case of an aircraft registered in another state, the
2/ uK?L ›Ñ` ¾}S²Ñu ›¨<a–L”” u}SK certificate of airworthiness shall be recognized as

¾Y^ G<’@†¨<” ¾T>SKŸ~ SS]Á− schools and to issue licenses to such facilities and

". lØØ` eKTÉ[Ó 30. Inspection

1/ vKYM×’<' 1/ The Authority shall have the power and duty to:

G( uT”—¨<U ¾c=y=M ›¨<aፕL” *ø_}` a) inspect aircrafts and aircraft engines,


ØpU Là ¾T>¨<K< ›¨<aፕL•‹“ ¾›¨<a propellers and appliances used by any
ፕL” V}a‹' ¨<MwK=u=„‹“ ›ፕK=Á”f‹ operator of civil aircraft, including any records
ÅI”’†¨< u}Öuk G<’@ SÑ–†¨<” pertaining thereto, to determine that they are
KT[ÒÑØ ’²=I’< uT>SKŸ~ W’Ê‹ Là maintaining in safe condition; and
ßU` lØØ` ¾TÉ[Ó' “

K( ¾’²=I” °n−‹ lØØ`“ Édƒ b) advise each operator in the inspection and
u}SKŸ} Á”ǔƔ *ø_}` ¾T TŸ`'
YM×”“ Lò’ƒ Õ[ªM:: maintenance of these items.

2/ vKYM×’< uT”—¨<U *ø_}` Kc= y=M 2/ When the Authority finds that any aircraft or
›y=Âi” ØpU Là ¾ªK ¨ÃU ”Ç=¨<M ¾cu aircraft engine, propeller, or appliance used or

u¾Ñ>²?¨< ”ÅÑ“ K=ፈƒ” ËLM:: under this Proclamation.

"1. lØØ` KTÉ[Ó ¾SÓvƒ Swƒ 31. Right of Access for Inspection

1/ u›Óvu< ¾}¨ŸK T”—¨<U ¾vKYM×’< 1/ Any duly authorized inspector of the Authority shall, for
›=”eü¡}` u²=I ›ªÏ ›”kê " SW[ƒ the purpose of conducting inspection under Article 30 of
KT>Å[Ó lØØ` ¯LT' this Proclamation, be allowed access to:

G( u›=ƒÄåÁ ¨<eØ u›ÑMÓKAƒ Là ¨Å›K a) any civil aircraft operated within Ethiopia;

b) any civil aircraft registered in Ethiopia and
K( u¾ƒ—¨<U x u›ÑMÓKAƒ Là ¨Å›K operated anywhere;

N( ¨Å T”—¨<U ¾›¾` *ø_}` õ' c) the premises of any air operator;

S( ¨Å T”—¨<U ¾ØÑ“ }sU ¨ÃU d) any maintenance facility or training school;

W( ¨Å T“†¨<U ›¨<aýL” T[òÁ' e) any aerodrome, air navigation facility or

SÓvƒ ËLM::

2/ Any inspector shall show the identification card


2/ T”—¨<U ›=’>eü¡}` u²=I ›”kê ”®<e issued to him by the Authority to get access to any
›”kê (1) ¨Å}Ökc¨< ›¨<a–L” ¨ÃU aircraft or premises referred to in sub-article (1) of

S¨mÁ ¨[kƒ Td¾ƒ ›Kuƒ::
3/ Any person involved in the services referred to in

32. Suspension and Revocation of Certificates and

If, as a result of any inspection or re-examination conducted

under Article 30 of this Proclamation or if, as a result of any

other investigation, the Authority determines that safety in
¯Ã’ƒ U`S^ U¡”Áƒ Kc=y=M ›y=Âi” civil aviation requires, it may, in accordance with provisions
ÅI”’ƒ ›eðLÑ> J• c=ÁÑ–¨< u²=I ›ªÏ of Part Eight of this Proclamation, issue an order suspending
SW[ƒ ¾}cÖ” T”—¨<”U ¾Ue¡` ¨[kƒ or revoking, in whole or in part, any certificate issued under
uS<K<U J’ uŸòM u²=I ›ªÏ ¡õM eU”ƒ this Proclamation.

The Authority may, in the discharge of certification,

"4. u[^” eKSŸMŸM 34. Prevention of Flight

vKYM×’< ¾T>Ÿ}K<ƒ G<’@−‹ c=ÁÒØS< The Authority may prevent an operator or a member of
›”É” *ø_}` ¨ÃU ¾u[^ W^}— ›¨<a– flight crew from operating an aircraft in situations
L”” *ፕ_ƒ ŸTÉ[Ó KSŸMŸM ËLM& where:

1/ ›¨<a–L’< Ku[^ wl "MJ’& 1/ the aircraft is not airworthy;

2/ ¾u[^ W^}—¨< u[^¨<” KTŸ“¨” 2/ the flight crew member is not qualified or is
wnƒ ŸK?K¨< ¨ÃU ¾›"K< ¨ÃU ¾› physically or mentally incapable to conduct the
Ua¨< G<’@ ¾TÁe‹K¨< ŸJ’& flight;

3/ *ø_i’< u›¨<aýL” ¨<eØ ¨ÃU uS_ƒ


Là vK< c−‹ ¨ÃU ”w[ƒ Là ›ÅÒ 3/ the operation may cause imminent danger to
”ÅT>ÁÅ`e ¾T>ÁcÒ ŸJ’& persons or property in the aircraft or on the
ground;
4/ ¾²=I” ›ªÏ É”ÒÑ@−‹ ¨ÃU u²=I ›ªÏ
SW[ƒ ¾¨Ö< Å”x‹”' SS]Á−‹” 4/ detention of the aircraft or flight crew is necessary
¨ÃU ƒ°³µ‹” KTeŸu` ¨ÃU uT”— to secure compliance with any of the provisions of
¨<U õ`É u?ƒ ¾}cÖ” ƒ°³´ KTeðçU this Proclamation or regulations, directives or
›¨<aýL’<” ¨ÃU ¾u[^ W^}—” orders issued hereunder or to implement any order
”ÇÔkdke TÉ[Ó ›eðLÑ> ŸJ’:: made by any court.
"5. ¡MŸL 35. Prohibitions
1/ T”—¨<U c¨< ¾T>Ÿ}K<ƒ” ከðìS QÑ ¨Ø
}Óv` ”ÅðìS ÃqÖ^M&
1/ It shall be unlawful for any person to:

*ø_ƒ TÉ[Ó& violation of the terms of any such certificate;

1/ T”—¨<U ¾›¨<aፕL” ›³» ûÃKƒ ¾›=ƒ 1/ Any pilot-in-command of an aircraft flying over or
ÄåÁ” ¾›¾` ¡MM ›s`Ù c=u` ¨ÃU u›¾` maneuvering within the Ethiopian airspace shall
¡MK< ¨<eØ c=”kdke uvKYM×’< ¾}¨c’<ƒ” adhere to the air routes as established by the
¾›¾` SeSa‹ SŸ}M“ ¨Å}ŸKŸK<' ÑÅw
¨Å}Å[Ñv†¨< ¨ÃU ›ÅÑ— }wK¨< ¨Å}c Authority and shall avoid those areas designated as
¾S< ¡MKA‹ ¨<eØ ŸSÓvƒ Skw ›Kuƒ:: prohibited, restricted or danger areas.

2/ Ÿ}ðkƃ ¾›¾` SeSa‹ ¾¨× ¨ÃU 2/ Any aircraft deviating from an established air route
¨Å}ŸKŸK' ÑÅw ¨Å}Å[Ñuƒ ¨ÃU ›ÅÑ— or entering a prohibited, restricted or danger area
¨Å}vK ¡MM ¾Ñv ›¨<aፕL” ÁM}ðkÅ shall be considered as unauthorized operation. The

Airspace

1/ Any foreign civil aircraft not engaged in scheduled

2/ No foreign air carrier shall conduct scheduled

3/ u²=I ›”kê ”®<e ›”kê (1) ¨ÃU (2) 3/ Foreign civil aircraft found to have violated sub-
¾}Å’ÑѨ<” ¾}LK𠾨<ß ›Ñ` c=y=M article (1) or (2) of this Article may be intercepted
›¨<aýL” u›=ƒÄåÁ ›¾` ÃM }ÑÊ by the Ethiopian Air Force aircraft and be

u²=I ›ªÏ ¡õM eU”ƒ É”ÒÑ@−‹ conditions of operations shall be punishable in
SW[ƒ Áek×M:: accordance with the provisions of Part Eight of this
Proclamation.
#2. ›ÅÑ— u[^
42. Dangerous Flying
T”—¨<U ›¨<aýL” uT”—¨<U c¨< ¨ÃU
”w[ƒ Là ›ÅÒ K=ÁÅ`e uT>‹M ›"D%E” Where an aircraft is flown in such a manner as to cause

Vertical Separation Minimum Airspace

1/ An operator shall not operate foreign aircraft in
defined portions of reduced vertical separation
minimum airspace in Ethiopia unless:

45. Aviation Personnel Certificates

1/ Any person having the requisite qualifications may

2/ Where the Authority finds, after investigation, that

¨<” ÚUa K›y=Âi” vKS<Á−‹ ¾T>c including personnel in charge of training and
Ö<ƒ” ¾Ue¡` ¨[k„‹ ¯Ã’ƒ“ ¾T>c inspection of crew members or personnel engaged
Ö<uƒ” SYð`ƒ ¾T>¨e” Y`¯ƒ in the maintenance of aircraft, aircraft engines,

6/ uK?L ›Ñ` ¾}cÖ ¾›y=Âi” vKS<Á ¾U 6/ The Authority may issue certificate of validation
e¡` ¨[kƒ” u}SKŸ} vKeM×’< ¾T with respect to an aviation personnel certificate
êÅmÁ ¾Ue¡` ¨[kƒ K=cØ Ã‹LM:: issued by another state.

#6. ¡MŸL 46. Prohibition

1/ T”—¨<U c¨< u²=I ›ªÏ SW[ƒ ¾}cÖ


¨ÃU ¾ìÅk ¾›y=Âi” vKS<Á ¾Ue¡` 1/ No person shall fly as a crewmember of an aircraft
¨[kƒ "MÁ² ue}k` u›=ƒÄåÁ u}S registered in Ethiopia unless he is the holder of an
²Ñu ›¨<aፕL” ¾u[^ ›vM J• Sw[` aviation personnel certificate issued or validated in
›Ã‹MU:: accordance with this Proclamation.

2/ T”—¨<U c¨<' 2/ No person shall fly in the airspace of Ethiopia as a


crewmember of an aircraft registered in another
state unless:

applicable within the territory of Ethiopia,

ðnÉ ¨<eØ u}SKŸ~ƒ É”ÒÑ@−‹“ organ and an operating license issue by the
ÑÅx‹ SW[ƒ "MJ’ ue}k` ¾›¨<aፕL” Authority and except in accordance with the terms
T[òÁ *ø_ƒ K=ÁÅ`Ó ›Ã‹MU:: and conditions of such permit and license.

2/ u›¨<aፕL” T[òÁ ›=”yeƒ KTÉ[Ó 2/ Any person entitled to invest in an aerodrome

G<’@−‹ }Óv^© KTÉ[Ó ¾T>Áe‹K< Y`¯ and protection of the environment and adopt

rules to implement these requirements.

3/ designate certain aerodromes as international

ÃJ“M:: international air transport services.

3/ ¾›?`ÁM Y^ ðnÉ ¾T>cÖ¨< u²=I ›ªÏ 3/ Aerial work service license shall be issued for
›”kê 2 ”®<e ›”kê (2) u}S services covered by the definition provided for in
KŸ}¨< ƒ`ÕT@ KT>gð’< ›ÑMÓKA„‹ ÃJ“M& sub-article (2) of Article 2 of this Proclamation;
J•U T”—¨<”U "T@^ õ ¾T>u` provided, however, that prior security clearance

63. Conditions for Issuance of License

›ªÏ SW[ƒ u¨× Å”w “ ›Óvw’ƒ Proclamation shall secure an insurance policy that

T[òÁ x−‹” SÓKê "M}‰K u[^¨< scheduled or charter basis, it shall be allowed to

3/ uvKYM×’< ”Ç=S²Ñu "M}Å[Ñ ue} 3/ No air carrier or agent thereof may conclude an
k` T”—¨<U ¾›¾` ›ÕÕ» ¨ÃU ¨Ÿ=K< agreement in respect of the transportation of any
T”—¨<”U S”ÑÅ— ¨ÃU °n TÕÕ´” persons or goods by the air carrier whereby such
›eSM¡„ u¨p~ Y^ Là uªK¨< ]õ persons or goods to be transported at a toll that
Là Ÿ}Ökc¨< ¡õÁ u}K¾ ¾ªÒ SÖ” differs from that specified in the tariffs then in
¨ÃU u]ñ ¨<eØ Ÿ}kSÖ¨< É”ÒÑ@ force or under terms or conditions of carriage other
¨ÃU G<’@ ¨<ß KTÕÕ´ eUU’ƒ than those set out in such tariffs, except it is filed

%5. ¾]õ U´Ñv“ ÓÉ 65. Registration and Suspension of Tariffs

1/ uQÓ uK?L ›"D%E” "M}¨c’ ue}k` T”— 1/ Unless provided otherwise by law, tariffs shall be

on the Ground

b) operates a portable electronic device when such

¾›?K?¡ƒa’>¡e °n−‹” c=ÖkU u=ј' shall be liable to a fine not exceeding Birr15,000 or

¨<cÉ Accident

T”—¨<U c¨< J” wKA“ YM×” dÃcÖ¨< Any person who intentionally and without authority
›ÅÒ ¾Å[cuƒ” ¾c=y=M ›¨<aýL” T”—¨<”U removes, conceals or withholds any part of a civil

¨<eØ ¾’u[ T”—¨<”U ”w[ƒ u=Á’d' u=Åwp was aboard such aircraft at the time of the accident,

2/ SÁ´ ÁKuƒ” ]¢`É vKYM×’< u¨c’¨< 2/ fails to keep records in the form and manner

&7. ÖpLL 77. General

1/ ›e}ÇÅ^© `UÍ ¾²=I” ›ªÏ É”Ò 1/ Administrative sanctions include the imposition of

Without prejudice to criminal liability under the

u?ƒ' ¾›¨<aýL” ØÑ“ }sU' ¾›¨< maintenance organization, aircraft owner
aýL” vKu?ƒ ¨ÃU }Ÿ^Ã' ¾›y=Âi” or hirer, or aviation personnel who violates
vKS<Á ¨ÃU u›y=Âi” Y`¯ƒ ¨<eØ any provision of this Proclamation or
¾Lò’ƒ É`h ÁK¨< T”—¨<U c¨<
regulations, directives or orders issued
¾²=I” ›ªÏ É”ÒÑ@ ¨ÃU u²=I ›ªÏ
SW[ƒ ¾¨×” Å”w' SS]Á ¨ÃU hereunder shall, depending on the gravity
ƒ°³´ }LMö c=ј ”ÅØó~ ¡wŃ of violation, be liable to a fine of not less
¾¾ Ÿw` $ሺ uTÁ”e “ Ÿw` 1)ሺ than Birr50,000; and not exceeding Birr
uTÃuMØ ¾Ñ”²w Skà Ãk×M& ¾²=I 100,000. If any such violation is a

¾²=I” ›ªÏ É”ÒÑ@ ¨ÃU u²=I ›ªÏ provision of this Proclamation or regulations,
SW[ƒ ¾¨×” Å”w' SS]Á ¨ÃU directives or orders issued hereunder shall,
ƒ°³´ }LMö c=ј ”ÅØó~ ¡wŃ depending on the gravity of violation, be liable to a
¾¾ Ÿw` 1)ሺ uTÁ”e “ Ÿw` 1)$ሺ fine not less than Birr100,000 and not exceeding
uTÃuMØ ¾Ñ”²w Skà Ãk×M& ¾²=I Birr 150,000. If any such violation is a continuing
¯Ã’~ S}LKõ k×Ã’ƒ "K¨< Á”Ç”Æ one, each day of such violation shall constitute a

&9. KvYM×’< eKT>k`w p_“ 79. Complaints to and Investigations by the

ƒ°³´ uS}LKõ uT”—¨<U c¨< ¾}ðçS complaint with respect to any act or omission of
¨ÃU SðçU c=Ñv¨< dÃðçU ¾k[ Ñ<ÇÔ any person in contravention of any provisions of
›eSM¡„ p_¨<” KvKYM×’< Tp[w this Proclamation or regulations, directives or
ËLM:: orders issued hereunder.

2/ vKYM×’< ¾k[u¨< p_ U`S^ ¨ÃU 2/ Whenever the Authority is of the opinion that any
`UÍ KS¨<cÉ ¾T>Áun U¡”Áƒ” complaint does not state facts that warrant an
›ÃÑMêU wKA c=ÁU” }ÚT] T×^ƒ investigation or action, it may summarily dismiss

4/ The findings of facts by the Authority, if supported

vKu?ƒ ¨ÃU ¾²=Á ›Ñ` vKYMדƒ registered in another state, the Authority may
G<’@−‹ ¾T>ÖÃlƒ” ›eðLÑ> ¾`ǁ permit the owner of the aircraft or the authorities
`UÍ−‹ G<K< ”Ç=¨eÆ vKeM×’< of such other state to provide such measures of
K=ðpÉ Ã‹LM:: J•U ¾T>cÖ¨< assistance as may be required under the

×T> U`S^ Ò` ¾}ÁÁ² ¾vKYM×’< accident or incident investigation or any part
]þ`ƒ ¨ÃU ¾]þ`ƒ ¡õM u]þ`~ thereof, shall not be admitted as evidence in any
¨<eØ ¾}Ökc” Ñ<ÇÃ ›eSM¡„ suit for damages arising out of any matter
KT>k`w ¾"d ¡õÁ ¡e ”ÅTe[Í J• mentioned in such report.
K=k`w ›Ã‹MU::
4/ Notwithstanding any other provision of this

¨ÃU K=ÔÇ ¾T>‹M T”—¨<U ›Ò affect the safety of civil aviation; and

c) any aircraft accident.
N( T”—¨<U ¾›¨<a–L” ›ÅÒ c=ÁÒØU'

2/ The Authority shall promptly investigate any

“y=Ñ@i” ›ÑMÓKA„‹ vKYM×’< ¾›ÑM Ethiopian airspace.
ÓKAƒ ¡õÁ K=ÁeŸõM ËLM::

2/ u²=I ›”kê ”®<e ›”kê (1) SW[ƒ 2/ The charges to be collected in accordance with
¾T>Ö¾k¨< ¡õÁ uvKYM×’< ¨ÃU sub-article (1) of this Article may relate to any
uvKYM×’< eU' service provided by or on behalf of the Authority:

a) during flight in Ethiopia or when flight

¨ÃU u[^¨< u›=ƒÄåÁ ¨<eØ originates or terminates in Ethiopia or during

¾T>SKŸƒ K=J” ËLM& 3/ License fees to be collected by the Authority may
relate to the issuance, renewal, amendment or

hereunder.
¨ÃU TêÅp” ¾T>SKŸƒ K=J” ËLM::
4/ The registered owner and operator of an aircraft
4/ ¾}S²Ñu<ƒ ¾›¨<a–L” vKu?ƒ“ *ø_}` shall, jointly and severally, be liable for payment
›¨<a–L’<” ›eSM¡„ K}cÖ ›ÑMÓKAƒ of charges for services provided with respect to the
¡õÁ u›”É’ƒ“ u}“ÖM Lò ÃJ“K<:: aircraft.

5/ vKYM×’< K}S²Ñu¨< ¾›¨<aýL’< vK 5/ The Authority may seize and detain an aircraft where the
u?ƒ ¨ÃU *ø_}` ¡õÁ¨<” Ÿ’¨KÆ registered owner or operator of the aircraft fails to settle
”Ç=ðêU uêOõ "e¨k¨< u%EL any charges and interests payable thereon within a
uTe¨mÁ¨< u}ÑKç¨< Ñ>²? ¨<eØ period specified in a written notice it has issued to such
vK°Ç¨< Óȁ¨<” "M}¨× ›¨<aýL’<” owner or operator.
õ K=Áq¾¨< ËLM::
6/ The Authority shall release the aircraft seized and
6/ vK°Ç¨<' detained pursuant to sub-article (5) of this Article
where:

G( ¡õÁ¨<” uØ_ Ñ”²w ¨ÃU u}[ÒÑÖ a) the debtor settles the amount in cash or
Š¡ c=ðêU' ¨ÃU certified check; or

K( vKYM×’< uT>kuK¨< ö`U SW[ƒ b) a bond or other security in a form satisfactory

Article 27 of the Convention where it is making

2/ ¾›¨<a–L’< vKu?ƒ ŸvKÑ<Ç¿ Ò` eUU’ƒ 2/ The detention of an aircraft under sub-article (1) of

(2. Å”w“ SS]Á ¾T¨<׃ YM×” 92. Power to issue Regulations and Directives

¾T>ÁeðMÑ< Y`¯„‹”“ Å[Í−‹” ÁÁ²< rules and standards necessary for the proper
SS]Á−‹” K=Á¨× ËLM:: implementation this Proclamation.
93. Issuance and Publication of Directives
(3. ¾SS]Á−‹ ›¨×Ø“ QƒSƒ
1/ The Authority shall, before issuing any directive

SS]Á ŸT¨<×~ uòƒ' under this Proclamation, consult such persons as
appear to it to be representatives of:
G( ¾›=ƒÄåÁ ¾c=y=M ›¾` ƒ^”eþ`ƒ
›=”Æeƒ]”' a) the civil air transport industry of Ethiopia;

K( ¾›¾` ƒ^”eþ`ƒ ›ÑMÓKAƒ }ÖnT> b) users of air transport services; and

N( ¾T>SKŸ†¨< K?KA‹ ›"Lƒ”' c) other stakeholders.


K=¨¡K< ËLK< wKA ¾T>ÑU†¨<” c−‹
TTŸ` ›Kuƒ::

2/ vKYM×’< u¾Ñ>²?¨< ¾T>Á¨×†¨<” 2/ The Authority shall have the duty to publish the
SS]Á−‹ ¾Td}U Lò’ƒ ›Kuƒ:: directives it issues from time to time.

3/ u²=I ›”kê ”®<e ›”kê (2) SW[ƒ 3/ The manner of publication of any directive under
T”—¨<U SS]Á ¾T>}Uuƒ G<’@ sub-article (2) of this Article shall be as the
vKYM×’< uT>¨e’¨< SW[ƒ ÃJ“M:: Authority may determine.

u²=I ›ªÏ }ibM:: hereby repealed.

2/ Ÿ²=I ›ªÏ Ò` ¾T>n[” T”—¨<U QÓ' 2/ No law, regulation, directive, order or practice
Å”w' SS]Á' ƒ°³´ ¨ÃU ¾›W^` shall, in so far as it is inconsistent with this
MUÉ u²=I ›ªÏ ¨<eØ u}gð’< Ñ<ÇÄ‹ Proclamation, be applicable with respect to matters

(5. አዋጁ የ‫ג‬ፀናበُ ጊዜ 95. Effective Date

ይֱ አዋጅ በፌዴ‫ ָף‬ነጋ‫ ُע‬ጋዜጣ ٍُ‫ז‬ This Proclamation shall enter into force up on the date
