HISTORY OF KENDRAPARA JUDGESHIP

Kendrapara is popularly known as ‘Tulsi Khetra’ with Sri Sri Sidha Baladev
Jew as its presiding deity located alongside the coast of the Bay of Bengal at a
distance of 85 Kms. from the State Capital, Bhubaneswar blessed with unique
natural heritage at Bhitara Kanika with wild life sanctuary, Gahirmatha, the largest
natural breeding place of Olive ridley sea turtles’ in the world and the historical
monuments of False Point, Light House, Hukitola.
The Judgeship of Cuttack was created in the year 1912 and much prior to it,
in the year 1831 British rulers had established five Munsif Courts in Orissa out of
which one was established at Kendrapara. When India got independence in the
year 1947, one Munsif Court and one Sub-Divisional Magistrate(S.D.M.) court
were functioning at Kendrapara. After Independence ,the Court of Subordinate
Judge was established on 20.01.1966. In the year 1984 one court of Addl. Civil
Judge(Jr.Divn.)-cum-J.M.F.C. was established at Kendrapara. Addl. District
Judge, Kendrapara and Chief Judicial Magistrate Kendrapara were
established in the year, 1990 and 1993 respectively and the court of Addl.
Senior Civil Judge Court at Kendrapara was established in the year 2017. The
Court of Judicial Magistrate First Class was established at Pattamundai in the
year, 2000. The Court of Judicial Magistrate, First Class was established at
Aul in the year, 2011. The Gram Nyayalaya at Rajnagar was opened in the
year, 2011. Finally the District & Sessions Court of Kendrapara was separated
from Cuttack and established on 26.06.2012. At present the sanction strength
of Courts in the judgeship of Kendrapara is 16 including newly created

Details of Courts
Judgeship Separation/ Establishment Notification
In exercise of the powers conferred by sub section (1) of Section 9, read with
Section 10 of the Orissa Civil Courts Act, 1984 ( Odisha Act 18 of 1984) and by
sub section (2) of section 7 of the Code of Criminal Procedure, 1973 (Act-II of
1974) and in partial modification of the Notification No.1688/L dated 19 th
December 1994 of the Govt. of Odisha in the Law Department and Home
Department Notification No. 766/ HS dated 6th January’ 1995, Government of
Odisha vide Extraordinary Gazettee Notification No.1112 dt.15.07.2010 read with
S.R.O.No.285 of 2010 in Law Department Notification dated, the 12th July, 2010 in
consultation with the High Court constituted the revenue District of Kendrapara
into a District Judgeship and Sessions Division with headquarters at Kendrapara.
The court and office of the District & Sessions Judge, Kendrapara was made
functional on 26.06.2012.

POWERS
The District & Sessions Judge, Kendrapara has been appointed as the
Presiding Officer of Special Court to try offences under the Scheduled Castes and
Scheduled Tribes (Prevention of Atrocities) Act, 1989 (33 of 1989) within the
revenue District of Kendrapara as per the provision of section 14 of the Scheduled
Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, and in
supersession of all notifications issued this regard, vide Government of Odisha
(Home Department), Notification No.38416/CHR-CRTN2-0001/2012/ C&HR
dated 27.09.2012. As per Section 14 of the Scheduled Castes and Scheduled Tribes
(Prevention of Atrocities) Amendment Act, 2015 (1 of 2016), the Special Court
shall have power to directly receive charge sheet and take cognizance of the
offences of the said Act communicated to the Sub-Ordinate courts vide Court’s
Letter No. 4272(30) dated 13.05.2016.
The District and Sessions Judge has been authorized by the High Court to
hear and dispose of the cases U/s.36-D of N.D.P.S. Act, 1985, and he alone shall
receive complaint or police reports U/s.36-A(1)(d) of the N.D.P.S. Act, and will
deal with them according to law vide Court’s Letter No.7254(30) dated the 16 th
August, 2013.
By virtue of Government of Odisha, Commerce and Transport (Transport)
Department Notification No.7644 dated 6.11.2013 and in supersession of the
Notification Nos. 5990/T dated the 14th September, 2012 and 3156/T dated the 2nd
April, 2013 forwarded to this court vide Court’s Memo No.9447(120) dated

8.11.2013, the District Judge has been appointed as the 1 st Motor Accident Claims
Tribunal within the revenue district of Kendrapara for the purpose of adjudication
upon claims for compensation in respect of accidents involving the death of, or
bodily injury to persons arising out of the use of motor vehicles, or damages to any
property of a third party so arising, or both.
In exercise of powers conferred by Section 30 of the Protection of Human
Rights Act, 1993, (10 of 1994) and in partial modification of the Notification No.
602/HRPC(N)295/12 dated, the 4th January, 2013 of the Government of Odisha in
the Home Department the Government of Odisha in consultation with the High
Court specified the court of the District and Sessions Judge, Kendrapara to be the
Human Rights Courts for the purpose of providing speedy trial of offences arising
out of the violation of human rights under the said Act, and the notification is
forwarded to the District and Sessions Judge, Kendrapara vide Memo No. 27961
dated 31.07.2013.
In exercise of the power conferred by section 74 of the Employees State
Insurance Act, 1948 (Act No. 34 of 1948) Government of Odisha in Labour and
Employment Department Notification No. IV5/B-26/84 2392/LE dated 17.2.1987
have constituted the Employees Insurance Court for each of the district in the state
and declared all the District and Sessions Judges as the Employees Insurance
Court within their respective jurisdiction.
As per the provision U/s.9 (2) (a) of the Legal Services Authorities Act,
1987, the District and Sessions Judge is the Ex-Officio Chairman of District Legal
Services Authority, Kendrapara.

As per Hon’ble Court’s Notification No.678/A dt.06.12.2016, the Addl.

District & Sessions Judge, Kendrapara have been empowered for speedy trial of
the offences against children or of violation of Child Rights under Section 25 of the
Commissions for Protection of Child Rights Act, 2005 (04 of 2006) within the
local limits.

As per Home Department Govt. of Odisha Notification No.23743/HOME-

CHR-MISC-0248-2017/CP&M dt.28.05.2018, the Addl. District & Sessions Judge,
Kendrapara has been empowered for trial of the offences under the rights of
persons with Disabilities Act, 2016 (49 of 2016).

Besides that, the Addl. District & Sessions Judge, Kendrapara has been
vested with powers to deal with cases under Scheduled Caste and Schedule Tribes
(P.A.) Act, N.D. &P.S. Act and adjudication of claims for compensation as Tribunal
under Motor Vehicles Act.

 As per Hon’ble Court’s Letter No.703(27)/XVIII-7/2003 dated 21st January,
2013, the Registrar, Civil Courts, Kendrapara has been appointed as Assistant
Sessions Judge to deal with cases relating to offices against women in the
headquarters in addition to his own duties.

As per Hon’ble Court’s Letter No.XI-20/2013/ 5059 dated 09.05.2013, the

Registrar, Civil Courts, Kendrapara has been nominated as the Principal
Magistrate, Juvenile Justice Board, Kendrapara U/s 4(2) of the JJ (CPC) Act, 2015.

The Senior Civil Judge, Kendrapara and Pattamundai have been vested with
special powers to deal with cases under Orissa Grama Panchayat Samiti Act,
Indian Succession Act and Land Acquisition Act within their local limits.

The Civil Judge, Kendrapara, Pattamundai and Aul have vested with Special
Powers to deal with cases under Gram Panchayat Act.

The SDJM, Kendrapara has been vested with power to deal with cases U/s
15 of Payment of Wages Act.

New Court establishment notification

1) As per Law Department Govt. of Odisha Letter No.1771/L dt.17.02.2014,
one court of Addl. Civil Judge-cum-JMFC has been created for Kendrapara
District.
2) As per Home Department Govt. of Odisha Notification No.28791/HS
dt.17.08.2016, in exercise of the powers conferred by Sub-Section (1) of Section
11 of the Code of Criminal Procedure, 1973 (Act-II of 1974), the State
Government, after consultation with the High Court of Orissa, do hereby establish
a court of Judicial Magistrate of the First Class at Pattamundai in the District of
Kendrapara with the headquarters at Pattamundai with effect from the date of the
said court functions.
3) As per Memo No.3413/L dt.20.04.2016 of Law Department Govt. of
Odisha regarding establishment of the court of Civil Judge-cum-JMFC at
Pattamundai with effect from the date, the posts are actually filled up until further
orders.
4) As per Law Department Govt. of Odisha Notification No.6013/L
dt.25.06.2016, in exercise of powers conferred by Section 3 and Sub-Section (1) of
Section 9 read with section 10 of the Odisha Civil Courts, 1984 ( Odisha Act 18 of
1984) and in consultation with the High Court of Orissa, the Statement
Government do hereby establish a court of Additional Civil Judge (Junior
Division) at Pattamundai, in addition to the existing number of such courts in the

Judgeship of Kendrapara with effect from the date of said court functions with the
local limits of jurisdiction co-extensive with the local limits of jurisdiction of the
existing court of Civil Judge (Junior Division), Pattamundai and fix the place of
sitting of the said court at Pattamundai.
5) As per Law Department Govt. of Odisha Notification No.9816/L
dt.20.09.2019, in exercise of the powers conferred by Section 3 and Sub-Section
(1) of section 9 readwith Section 10 of the Odisha Civil Courts Act, 1984 (Odisha
Act 18 of 1984), the State Government, in consultation with the High Court of
Orissa, do hereby establish the Court of Additional District Judge at Kendrapara in
addition to the existing number of such courts at Kendrapara and fix the place of
sitting at Kendrapara within the local limit of jurisdiction.

(i) Status of Project, status of construction & status of ongoing

projects :

Kendrapara Station :-

Non – Residential :- District Court Building, Kendrapara :- The Civil

Work has been completed. Electrical works such as VRF AC and LAN work is
pending.
Residential :- “B” type quarter meant for District Judge, Kendrapara
in which the building is structurally completed. At present the pillar work and
Boundary wall alongwith with brick work is in progress. Simultaneously the
construction of residential office and Guard room is also under construction.
Gram Nyayalaya, Rajnagar Sation :-
Non – Residential :- Gramnyayalaya Court Building, Rajnagar:- The
construction of the Court Building is kept in abeyance as per Hon’ble Court
direction in letter no 912(3) dtd 21.01.2019. .
(ii) Use of existing and proposed building etc:-

At present the Courts are functioning in the exisitng building. After

shifting of Courts to the proposed building the existing building will function as
Office of District Legal Services Authority, Mediation centres, front office and
Juvenile Justice Board.

Data entry in CIS, NJDG, data entry in office computers in the uncovered Courts,
provision of connectivity etc.

Data entry in CIS

1. All the Courts of the Headquarter Station, Kendrapara is covered under
eCourts, Project and Filing, Allocation and Registration of a Fresh Filing
is done at Judicial Service Center.
2. Backlog data entry of SDJM Court is done at Judicial Service Center.
3. Judgment and Interim Orders are Uploading on regular basis on NJDG.
4. Dairy Forwarding of all the Court on NJDG is been done on daily basis.

In the Court Complex, Aul, Pattamundai and Rajnagar all the Hardware
items are received but not functioning due to non availability of Server.

NJDG
1. All the data of Headquarter Stations Kendrapara are reflected on NJDG.

Provision of Connectivity
1. MPLS Connection has been done at all the Court Complex, i.e. at Civil
Court Complex, Kendrapara, Court Complex, Aul, Court Complex,
Pattamundai and at Court Complex, Rajnagar.
