Details of Courts
Judgeship Separation/ Establishment Notification
In exercise of the powers conferred by sub section (1) of Section 9, read with
Section 10 of the Orissa Civil Courts Act, 1984 ( Odisha Act 18 of 1984) and by
sub section (2) of section 7 of the Code of Criminal Procedure, 1973 (Act-II of
1974) and in partial modification of the Notification No.1688/L dated 19 th
December 1994 of the Govt. of Odisha in the Law Department and Home
Department Notification No. 766/ HS dated 6th January’ 1995, Government of
Odisha vide Extraordinary Gazettee Notification No.1112 dt.15.07.2010 read with
S.R.O.No.285 of 2010 in Law Department Notification dated, the 12th July, 2010 in
consultation with the High Court constituted the revenue District of Kendrapara
into a District Judgeship and Sessions Division with headquarters at Kendrapara.
The court and office of the District & Sessions Judge, Kendrapara was made
functional on 26.06.2012.
1) The Court of District & Sessions Judge and office of Registrar, Civil Courts at
Kendrapara have been created vide Law Department Govt. of Odisha Letter
No.1727/L dt.17.02.2010 and functioning since 26.06.2012.
2) The Court of Judge, Family Court, Kendrapara has been created vide Law
Department Govt. Odisha Letter No.10724/L dt.26.06.2012 and functioning since
5.7.2013.
3) The Court of Additional District & Sessions Judge, Kendrapara has been
created vide Home Department Govt. of Odisha Letter No.12915/HS, Dt.30.3.2013
and functioning since 7.7.2013.
4) The Court of Chief Judicial Magistrate, Kendrapara has been created vide Home
Department Govt. of Odisha Letter No.48169/HC Dtd.25.09.93.
5) The Court of Senior Civil Judge, Kendrapara has been created vide G.O.
No.555/Judl. Dtd.20.01.66 made permanent vide G.O. No.4076/Judl.Dtd.04.04.73.
6) The court of Senior Civil Judge, Pattamundai has been created vide Law
Department Govt. of Odisha Letter No.3113/L dtd.15.3.13 & Notification No.2894
dtd.13.3.2013 & made permanent on 5.12.2015 vide Law Department Govt. of

POWERS
The District & Sessions Judge, Kendrapara has been appointed as the
Presiding Officer of Special Court to try offences under the Scheduled Castes and
Scheduled Tribes (Prevention of Atrocities) Act, 1989 (33 of 1989) within the
revenue District of Kendrapara as per the provision of section 14 of the Scheduled
Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, and in
supersession of all notifications issued this regard, vide Government of Odisha
(Home Department), Notification No.38416/CHR-CRTN2-0001/2012/ C&HR
dated 27.09.2012. As per Section 14 of the Scheduled Castes and Scheduled Tribes
(Prevention of Atrocities) Amendment Act, 2015 (1 of 2016), the Special Court
shall have power to directly receive charge sheet and take cognizance of the
offences of the said Act communicated to the Sub-Ordinate courts vide Court’s
Letter No. 4272(30) dated 13.05.2016.
The District and Sessions Judge has been authorized by the High Court to
hear and dispose of the cases U/s.36-D of N.D.P.S. Act, 1985, and he alone shall
receive complaint or police reports U/s.36-A(1)(d) of the N.D.P.S. Act, and will
deal with them according to law vide Court’s Letter No.7254(30) dated the 16 th
August, 2013.
By virtue of Government of Odisha, Commerce and Transport (Transport)
Department Notification No.7644 dated 6.11.2013 and in supersession of the
Notification Nos. 5990/T dated the 14th September, 2012 and 3156/T dated the 2nd
April, 2013 forwarded to this court vide Court’s Memo No.9447(120) dated

8.11.2013, the District Judge has been appointed as the 1 st Motor Accident Claims
Tribunal within the revenue district of Kendrapara for the purpose of adjudication
upon claims for compensation in respect of accidents involving the death of, or
bodily injury to persons arising out of the use of motor vehicles, or damages to any
property of a third party so arising, or both.
In exercise of powers conferred by Section 30 of the Protection of Human
Rights Act, 1993, (10 of 1994) and in partial modification of the Notification No.
602/HRPC(N)295/12 dated, the 4th January, 2013 of the Government of Odisha in
the Home Department the Government of Odisha in consultation with the High
Court specified the court of the District and Sessions Judge, Kendrapara to be the
Human Rights Courts for the purpose of providing speedy trial of offences arising
out of the violation of human rights under the said Act, and the notification is
forwarded to the District and Sessions Judge, Kendrapara vide Memo No. 27961
dated 31.07.2013.
In exercise of the power conferred by section 74 of the Employees State
Insurance Act, 1948 (Act No. 34 of 1948) Government of Odisha in Labour and
Employment Department Notification No. IV5/B-26/84 2392/LE dated 17.2.1987
have constituted the Employees Insurance Court for each of the district in the state
and declared all the District and Sessions Judges as the Employees Insurance
Court within their respective jurisdiction.
As per the provision U/s.9 (2) (a) of the Legal Services Authorities Act,
1987, the District and Sessions Judge is the Ex-Officio Chairman of District Legal
Services Authority, Kendrapara.
Besides that, the Addl. District & Sessions Judge, Kendrapara has been
vested with powers to deal with cases under Scheduled Caste and Schedule Tribes
(P.A.) Act, N.D. &P.S. Act and adjudication of claims for compensation as Tribunal
under Motor Vehicles Act.

As per Hon’ble Court’s Letter No.703(27)/XVIII-7/2003 dated 21st January,
2013, the Registrar, Civil Courts, Kendrapara has been appointed as Assistant
Sessions Judge to deal with cases relating to offices against women in the
headquarters in addition to his own duties.
The Senior Civil Judge, Kendrapara and Pattamundai have been vested with
special powers to deal with cases under Orissa Grama Panchayat Samiti Act,
Indian Succession Act and Land Acquisition Act within their local limits.
The Civil Judge, Kendrapara, Pattamundai and Aul have vested with Special
Powers to deal with cases under Gram Panchayat Act.
The SDJM, Kendrapara has been vested with power to deal with cases U/s
15 of Payment of Wages Act.

Judgeship of Kendrapara with effect from the date of said court functions with the
local limits of jurisdiction co-extensive with the local limits of jurisdiction of the
existing court of Civil Judge (Junior Division), Pattamundai and fix the place of
sitting of the said court at Pattamundai.
5) As per Law Department Govt. of Odisha Notification No.9816/L
dt.20.09.2019, in exercise of the powers conferred by Section 3 and Sub-Section
(1) of section 9 readwith Section 10 of the Odisha Civil Courts Act, 1984 (Odisha
Act 18 of 1984), the State Government, in consultation with the High Court of
Orissa, do hereby establish the Court of Additional District Judge at Kendrapara in
addition to the existing number of such courts at Kendrapara and fix the place of
sitting at Kendrapara within the local limit of jurisdiction.
