Immediate Release filed by the accused, through counsel, on January 31, 2019. He claims that he has now fully served his sentence and is now entitled to be released following his successful rehabilitation at the Mega Drug Abuse Treatment and Rehabilitation Center (“Mega DATRC”, for brevity). In support thereof, he attached the Letter of Recommendation for Temporary Release issued by the OIC-Medical Center Chief of Mega DATRC and the Certificate of Completion of his In-House Rehabilitation and Treatment at the said center.
The motion shows that the Office of the City Prosecutor
was furnished with a copy of the said motion on January 31, 2019. The same was likewise set for hearing on February 4, 2019. Up to this time, however, no pleading, comment or objection is filed by the City Prosecutor.
After a careful evaluation, the Court finds merit to the
motion. Accordingly, the same is hereby GRANTED.
The OIC-Medical Center Chief of the Mega DATRC is
hereby ordered to temporarily release subject to the following conditions: (a) that the said drug dependent shall report to the City Health Office of Cabanatuan for aftercare and follow-up treatment, including urine testing for a period of eighteen (18) months; (b) if anytime during the after- care and follow-up period, the drug dependent is certified to be rehabilitated, he may be discharged by the Court; and (c) should the City Health Office finds that during the initial after-care and follow-up program of eighteen (18) months, the drug dependent requires further treatment and rehabilitation in the Center, he shall be recommitted to the Center for Confinement.
The City Health Office of Cabanatuan is hereby directed
to submit to this court a periodic report relative to the after care and follow-up program conducted to SO ORDERED. Cabanatuan City, February 11, 2019.
