1 General
The special conditions of contract (SCC) stipulated herein shall be read and
construed along with the enclosed GCC, but if there is any conflict and/or
inconsistency between provisions hereof and those stipulated in GCC, the conditions
stipulated in this document shall prevail.
The erection of the transmission line shall comply with the requirements of Indian
Electricity Act 2003 and Indian Electricity Rules 1956 made there under as amended
from time to time and regulations/ specification of the authorities of Post and
Telegraph department, Roadways or Navigation or Aviation authorities, Local
Governing Bodies. Defence, PTCC, Forest department, Mining Department etc.
whichever is applicable. The construction of the transmission line shall also comply
with relevant Indian Standard and/ or Specification of the Purchaser in all respect.
The materials, design and workmanship shall satisfy the relevant Standards and
specifications as contained herein. Where the job specifications stipulate requirements
in addition to those contained in the Standard codes, these additional requirements
shall also be satisfied. In the absence of any Standard or specification for any part of
the work covered in this tender, the instructions/directions of Engg-in-Charge will be
binding on the Contractor.
Normally, unless otherwise stated, in case of an irreconcilable conflict in the terms
and conditions, the following shall prevail in order of precedence:
1. Letter of Award / Purchase Order / Work Order
2. Special Conditions of Contract
3. General Conditions of Contract
In case of an irreconcilable conflict in the technical details, the following shall
prevail in order of precedence:
1. Approved GTP & Drawings
2. Technical specifications
3. Indian Standards /Other applicable Standards
It will be the Contractor’s responsibility to bring to the notice of the Engg-in-
Charge any irreconcilable conflict in the contract documents before starting the work
or making the supply with reference to which the conflict exists.
In the absence of any specification covering any material, design or work the same
shall be performed/ supplied/ executed in accordance with standard engineering
practice as per the instructions/ directions of the Engg-in-Charge.

2. Name of the Work


Design, Supply, Erection, Testing & Commissioning of following
Transmission Lines
1. Single Circuit loop in loop out connection from existing D/C 220 KV Kalyaneswari
– Mejia Transmission line to 220 KV Burnpur Sub Stn. – 18.5 KM (approx.)
2. D/C 220KV interconnecting transmission line between DVC 220 KV Burnpur
Sub -Station and SAIL, IISCO Steel Plant (ISP) – 1.2 KM (approx.)

3. Site
3.1 Project Location
Burnpur, being in the District of Burdwan, is located approx 3 km from Asansol
Rly Station.
MTPS, being in the district of Bankura, W.B. is located approximately 200 Km
away from Kolkata.
3.2 Environmental Conditions
Weather : Industrial, smoky and polluted.
Temperature : from 40 in peak winter to 450 in peak summer
Wind : 47m/sec
The daily average ambient temperature throughout the year varies between
4ºC to 50ºC. The ambient peak is 50ºC.
The relative humidity is between 10% in dry season and 100% (Maximum)
during monsoon.
The daily rainfall ranges from 25mm to 75mm per day during the monsoon.
Average yearly rainfall is 1560mm. (approx.).
Terrain is more or less plain level span.
4 Completion Time
Completion time will be considered from the date of issuance of LOA
1. Single Circuit loop in loop out connection from existing D/C 220 KV
Kalyaneswari - Mejia Transmission line to 220 KV Burnpur Sub Stn 12 months
2. D/C 220KV interconnecting transmission line between DVC 220 KV
Burnpur Sub -Station and SAIL, IISCO Steel Plant (ISP) 9 months

Time is the essence of this Contract. The work shall be executed strictly as per the time of

completion indicated. The period of completion includes the time required for mobilisation
as well as testing, rectifications, if any, retesting, de-mobilisation and completion in all
respects to the satisfaction of the Engg-in-charge.

5 Scope of Work
For
1. Single Circuit loop in loop out connection from existing D/C 220 KV Kalyaneswari
– Mejia Transmission line to 220 KV Burnpur Sub Stn. – 18.5 KM (approx.)
2. D/C 220KV interconnecting transmission line between DVC 220 KV Burnpur
Sub -Station and SAIL, IISCO Steel Plant (ISP) – 1.2 KM (approx.)

(a) Fabrication and supply of 220 KV D/C Tower and Tower Accessories, supply
of All Alloy Aluminium conductor (61/3.31mm) (AAAC), supply of 70 KN and 160
KN DISC insulators, supply of 7/3.15 mm GI Earthwires, supply of Hardware and
Accessories and supply of Earthing Materials as per quantities enlisted.
(b) Complete Erection, Testing and Commissioning of 220 KV D/C Koderma-
Giridih and Dhanbad-Giridih line .
At this stage, the necessity of Detail and Forest Survey have is not felt. However,
to meet the eventualities few Kms of the lines may be needed for detail survey and
forest survey. The contractor has to do the job as per rate quoted under these heads.

A. SUPPLY PART :-

i) Fabrication & supply of complete Towers along with extensions (as detailed
in the spec, plotted in the profile) after approval of successful Proto assembly.
Necessary accessories & stubs for each tower are to be supplied along with towers.
Specified no. of muff boxes & templates are also to be supplied along with towers.
The relevant drawings in duplicate for all the towers and their extensions shall be
furnished to the Contractor by DVC which shall include Structural/Erection
drawings with required fabrication details or Shop fabrication drawing, BOM and
foundation drawing. Before fabrication of Proto assembly tower, the Contractor has
to ensure the correctness of shop fabrication drawing supplied by DVC.
ii) Supply of Tower accessories and Earthing materials as per DVC drawing.

iii) Submission of 70 KN & 160 KN insulator Drgs and GTP as per spec and
getting approval from DVC. Supply of materials after successful completion of
Acceptance Tests and on receipt of written despatch clearance.

iv) Submission of Drgs and GTP for Insulator fittings and Line Hardware &
accessories, Vibration dampers as per specification and getting approval from DVC.

Supply of materials after successful completion of Acceptance Tests and on receipt


of despatch clearance.

v) Submission of GTP and Drum drawing for AAAC ZEBRA (61/3.31mm) and
GI Earthwire (7/3.15 mm), getting approval from DVC. Supply of materials after
successful completion of Acceptance Tests and on receipt of despatch clearance.

vi) Supply of Barbed wire for anticlimbing device of Tower, danger plates,
number plates , phase plates and circuit pates after successful completion of
Acceptance Tests and on receipt of despatch clearance.

xi) All civil materials like M.S. Rod, Cement, sand, Stone chips and other
materials for construction.

All supply items shall be as per approved drawings/GTP.

B. ERECTION PART :-

i) Collection of topo sheet and Plotting of tentative route allignment drawings


on topo sheet of the concerned lines

ii) Check Survey of the total route length including detailed survey & forest
survey (if applicable) of a few Km, if felt necessary, preparation and submission of
Survey Sheet and line chart, Tower schedules plotting of towers in route profile etc.
and getting approval. of the portion for which detailed survey is required.

iii) Excavation of Pits for foundation.

iv) Stub setting and concreting and backfilling.

v) Earthing of Tower bases.

vi) Erection of Super structure checking, punching and tack welding up to


bottom X-arm.

vii) Fixing of insulators with hardwares.

viii) Stringing of power conductors and earthwire including fixing of preformed


armour rod and vibration dampers.

ix) Fixing of anticlimbing devices, phase plates, circuit platse, number plates,
danger plates and bird guards.

x) Right of way, tree cutting, Jungle clearance, Rly clearance, PTCC clearance,
forest clearance etc..

xi) Testing and commissioning of the transmission line to the satisfaction of


DVC.

xii) Handing over the erected line to the Engineer-in-charge along with return and
reconciliation of the balance un-utilised materials to the specified DVC stores as
mentioned.

6. Contract Documents
The following documents shall constitute the contract:
1. Contract Agreement
2. Tender documents along with its amendments
3. Letter of Award
4. Purchase and Work Orders
5. All correspondence relating to the contract.
6. Project Schedule

7. PRICE
7.01 The bidder shall quote on divisible contract basis separately for
Supply and for Erection, Testing & Commissioning for which separate orders shall
be placed.

7.02 Price shall be FIRM of all the items except items for which the
respective Price Variation formula is mentioned in Price Variation clause no.8. For
such items for which price variation formulae have been indicated, prices shall be
quoted on variable basis. No price variation will be applicable on the portion of price
paid as advance.
7.03 The prices for execution of the entire works covered under the scope
of this specification shall be quoted by the bidder in the manner specified in the Price
bid.
7.04 The bidder shall also enclose all the deviation Schedules with
corresponding withdrawal prices for each type of deviation along with price bid. This
withdrawal price will be taken into consideration for the purpose of bid evaluation. If
the deviation taken by the bidder is not acceptable to DVC and it is decided to award
the contract on such bidder, only then the said amount shall be included in the award
price. The offer with deviation but without cost of withdrawal will be rejected. In this
connection Clause 13 of GCC may please be referred to.
7.05 The bidders are also advised to include storage-cum-erection insurance
charges of all the items (supplied by either Contractor or DVC as the case may be) in
the quoted rates for erection items. Insurance coverage during transit/ storage/erection

etc. is to be provided by the contractors at their own cost during the tenure of the
contract inclusive of extended/delayed period, irrespective of the reason for such
delay. No premium charges to cover Insurance for original period or extended period
will be paid / reimbursed by the Purchaser.
No extra charge for handling / transportation from contractor’s stores to actual
site, storing & security of the tools & plants and of the materials issued by DVC shall
be claimed by the contractor. The rate tendered shall cover all these aspects.
7.06 The bidder shall quote the erection price considering the following:
i)Forest Clearance & Payment Towards Service Charge For Obtaining Forest
Clearance :
At this stage necessity of preparation of necessary drawing/schedules for
submission of the proposals to the State Govt./Central Govt. authorities is not felt.
However to meet eventualities, the provision of preparation of forest clearance
proposal is kept which includes Identification & demarcation of Forest land plotting,
preparation of necessary drawing/schedules, liaison with forest department for early
forest clearance. The contractor should quote the above item separately under head of
“Service charge for forest clearance.” However, if any statutory compensation is
required to be paid for getting necessary forest clearance, it will be paid by DVC at
actual.
The contractor shall be responsible for felling down of trees and removal in
the forest as per guidelines of the forest authority. Clearance of site and other
associated work for taking up the construction activities inside the forest after
approval of forest clearance proposal.This shall be included in the quoted erection
price.
ii) Right Of Way :
a)Any right of way including ROW approval which may be required by the
contractor for erection of tower and stringing of conductor shall be arranged by him.
Their erection rates should be inclusive of necessary service charge required for
obtaining right of way. DVC will bear statutory charges, if required, at actual.
No compensation whatsoever (i.e. idle charges, rate escalation, any other losses)
will be granted to the contractor on the ground of non availability of right of way.
b)The access roads to the work site including any compensation such as tree
cutting, standing crop etc. if needed shall be arranged by the contractor at his own
cost.
c) Payment towards perpetual use of land for tower bases, tree cutting
compensation and crop compensation to the private owners if required to execute for
erection of the line will be paid by DVC directly to the owners or reimbursed
separately to the contractor on the basis of documentary evidence. The felling down
of the above trees / crops etc. is the responsibility of the contractor and to be done by
him at his own cost for which no extra payment will be made. The contractor shall
take all responsible steps to minimise damage of standing crops as far as practicable.
The contractor shall also ensure steps for maintaining healthy relation with local
people/ authorities. However, the overall responsibility to resolve the ROW problem

will lie with the contractor.


d)During process of erection, if any obstruction is encountered from the
villagers/outsiders, the contractor shall resolve the same at his own end and means.
e) Railway Clearance—The contractor shall be responsible for collection &
submission of data to facilitate preparation of drawings/schedules and submission of
Railway crossing proposal as per requirement of Railway to the appropriate Railway
authorities at appropriate time. Persuasion with Railways and obtaining final
clearance at appropriate time shall be the responsibility of the contractor. Payment
will be made towards service charge to the contractor for preparation, submission,
persuasion and obtaining final clearance from Railway authorities as per quoted rates.
Rate of stringing and sagging of power conductor and earthwire quoted in the
schedule of works shall cover the stringing and sagging over the Railway line, river,
road etc. along the transmission line route.
Traffic Block /way leave charges and other charges, if claimed by Railway will be
paid by DVC.
f) PTCC Clearance :
For PTCC clearance, the contractor should prepare all drawings including route
map, obtain soil resistivity data as per requirement of PTCC and submit PTCC
proposals to PTCC authorities at appropriate time.
The contractor will not be paid separately for this. This will be included in service
charges for PTCC clearance. The cost of compensation if required for strengthening
protection of Telecom lines from inductive interference from power lines will
however be paid by DVC to appropriate authorities at actual.
g)Unauthorised Construction :The contractor shall ensure during check
survey that the line does not traverse over temporary/permanent dwellings and shall
maintain adequate clearance as per relevant Indian Electricity Rules in respect of
electrical clearance.
In the event of any unauthorised construction/dwelling is encountered across
the transmission line, the contractor will have to take necessary measures to remove
these obstructions at his cost to facilitate construction.
The contractor will take all possible measures so that there is no delay in the
execution on account of ROW problem. No compensation / escalation of price will be
granted because of such delay. However, reasonable extension of time may be granted
in such cases strictly on merit.
7.07 The approval from any authority required as per statutory rules and
regulations of Central/ State Governments shall be the Contractor’s responsibility
unless otherwise specified in this specification. The Contractor shall co-ordinate with
Electrical Inspector and other Govt. agencies as required for obtaining the necessary
clearance for charging the new line. However, the statutory charges will be
reimbursed by DVC at actuals on production of documentary evidence. Contractor
shall bear all incidental expenses for the liaison work involving the Electrical
Inspector/ other Govt. agencies as and when required. No extra payment will be made
to the Contractor on this account.

7.08 Change of quantity:


After award of the contract and during execution of the work DVC reserves the
right to vary the quantities of the items or group of items as specified in the schedule
of work (both supply &Erection) as may be necessary during detail
engineering/execution stage as per site condition. Such variation will be limited to
(+/-) 25% of order value and will be paid as per the original quoted rates. However
such variation for individual item may go up to any extent including deletion of any
item.
7.09 New Item(s)
New item not included in the price schedule, if required to be supplied /
executed during execution of the contract the same will be carried out by the
contractor at mutually agreed rates arrived based on prevailing market rate.

7.10 Optional Items


DVC reserves the right to execute optional items by the Contractor as per unit
rate mentioned in the order. Optional item will not be considered for the purpose of
ranking during evaluation.
In absence of QAP (refer clause 15 of GCC) furnished with bid documents,
type test charge included as mandatory item shall be considered for the purpose of
ranking. Type test charges indicated as optional item will not be considered for
purpose of ranking during evaluation. DVC reserves the right to execute the job at the
quoted rate at their discretion.

7.11 Return Of Materials: -


All materials shall be reconciled and excess material shall be returned to
DVC specified stores at Maithon/ Kalyaneswari/ Mejia/ Burnpur or any other
specified store (as instructed by Engineer-in-charge) at the cost of the
contractor.
Permitted Extra Consumption of Line Materials
The quantity of conductor and earthwire to be incorporated in
the line shall be worked out as per the following norms.
Quantity of Conductor=Line Length as per detailed survey X 3 phases X 2
(For double circuit line)

Quantity of Earthwire =Line Length as per detailed survey

The Contractor shall make every effort to minimise


breakage, losses and wastage of the line materials during erection. However,
the Contractor shall be permitted an extra consumption of the line materials
up to the limits as specified below:

materials, number plates, barbed wires etc.

DVC will not accept the empty conductor/ earthwire drums, cut pieces of the
conductor/ earthwire and partly used conductor/ Earthwire consisting drums.
Contractor has to arrange for revert of the items at his means and cost.
7.12 Successful Tenderer shall discharge all obligations under the Indian Workman’s
Compensation Act and Labour Laws for his employees and for those employed
locally.
7.13 Successful Tenderer shall also indemnify the purchaser against direct damage or
injury to property or persons of the purchaser or that of the other contractors to the
extent caused by the negligence of the contractor or his sub-contractor(s) by making
good such damages to property and compensation for personal injury. For the
purpose, third party liability shall be arranged by the contractor.
7.14 As per “ the Building & Other Construction Workers” welfare cess act 1996 and
the “ the Building & Other Construction Workers” welfare cess rules 1998, cess
amounting 1(one)% of the cost of construction has to be levied and collected by DVC
from the bills paid for such works. The same shall have to be transferred by DVC to
the building and other welfare construction board, Govt. of West Bengal / Jharkhand
after deducting 1 % of it as cost of collection within 30 days. The bidders are
requested to include the same in their bid price.
7.15 As per direction of the Governor of West Bengal, in exercise of the Power
conferred by section 212 of the West Bengal Panchayat Act., 1973, the Contractor on
behalf of DVC shall obtain permission from the concerned Gram Panchayat and
deposit fees @ Rs.3/-(Rupees three) only per cubic metre of the volume of tower for
according approval in respect of construction of the said line.
The volume of the Structure is derived by the formula
Volume = 1/3 X area of the base ( i.e. the area of the ground covered) X height
The bidders are requested to include the same in their bid price.
7.16 Imposition of new tax / cess etc. by Govt. Authorities during contractual
completion period shall be in the Purchasr’s account against documentary evidence.
However, this will not be applicable beyond contractual completion period.

8. Price Variation / Adjustment


8.01 CONDITIONS FOR PRICE VARIATION/ADJUSTMENT
The price variation clauses shall be invoked by either party (either
Contractor or Owner) subject to the following conditions:

i) No price adjustment shall be applicable on the portion of the Contract


price payable to the Contractor as advance payment. The Ex-works price
component, less advance, and erection price component less advance
will be subject to price adjustment, only for equipment/materials/items
of work specifically stated hereunder. The base date for different indices
for the purpose of calculating price variation will normally be
considered 30 days prior to the last date of submission of bid, unless
otherwise stated.
ii) For bought-out items, where the actual ex-works price is not available,
the quoted price excluding Freight & Insurance shall be considered as
base price for the purpose of calculation of price variation.
iii) For the price adjustment for Ex-works price component, the date of
shipment for goods shall mean the scheduled date of shipment or actual
date of shipment, whichever is earlier. Scheduled date of shipment will
be ex-works date of dispatch, governed by the approved bar chart.
For the purpose of price adjustment for Erection price component, the
billing period shall mean the billing period as per the contract time
schedule i.e., the agreed Bar Chart or actual period, whichever is earlier.
The billing period for various erection activities will be as per the agreed
erection bar chart indicating monthly schedule of erection activities for
completion of works.
iv) No price increase shall be allowed beyond the original delivery/
erection dates unless specifically stated in the Time Extension Letter, if
any, issued by the Purchaser/Owner. The Purchaser/Owner will,
however, be entitled to any decrease in the Contract Price which may be
caused due to lower price adjustment amount in case of delivery /
erection beyond the original delivery/ erection dates. Therefore in case
of delivery/erection of goods beyond the original delivery/erection dates,
the liability of the Owner shall be limited to price adjustment on the
lower side only which may be worked out either on scheduled date or
actual date of dispatch/ erection of goods.
v) In case of non-publication of applicable indices on a particular date,
which happens to be the applicable date for Price Variation purposes, the
published indices prevailing immediately prior to the particular date
shall be applicable.
vi) In case IEEMA does not publish any of the price indices, as mentioned
above, the Bidder shall indicate any nationally recognized published
index for respective items and the source of the same shall be furnished
in the Bid.

vii) If the Price Adjustment amount works out to be positive, the same is
payable to the Contractor by the Owner and if it works out to be
negative, the same is to be recovered by the Owner from the Contractor.
viii) The Contractor shall promptly submit the price adjustment invoices
for the supplies made/works done, positively within three (3) months
from the date of shipment/works done whether it is positive or negative.
ix) Price adjustment shall be restricted to maximum ceiling limit, wherever
indicated.

8.02 The prices of the following items shall be subject to price adjustment as per
the details given herein under.

(a) Fabricated Tower


The price adjustment on the Ex-works price component, of the fabricated
tower parts (including Bolts & Nuts) shall be worked out as under:

P1 is the price payable as adjusted of fabricated tower parts (including
Bolts & Nuts)
Po = Price quoted of fabricated tower parts(including Bolts& Nuts)
HAo = Price of heavy angles. This price is applicable on the first working day
of the month, one month prior to the date of tendering.
LAo = Price of lighter angles. This price is applicable on the first working day
of the month, one month prior to the date of tendering.
Zno = Price of Electrolytic High Grade Zinc. This price is applicable on the
first working day of the month, one month prior to the date of tendering.
Wo = All India Average Consumer Price Index Number for Industrial
Workers as published by Labour Bureau, Ministry of Labour, Govt. of India
with respect to Base: 2001=100)
This index number is as applicable for the month, four months prior to date of
bid opening.
HA1 = Price of heavy angles. This price is applicable on the first working day
of the month, two months prior to the date of delivery.
LA1 = Price of lighter angles. This price is applicable on the first working day
of the month, two months prior to the date of delivery.
Zn1 = Price of Electrolytic High Grade Zinc. This price is applicable on the
first working day of the month, two months prior to the date of delivery.

W1 = All India Average Consumer Price Index Number for Industrial


Workers as published by Labour Bureau, Ministry of Labour, Govt. of India
with respect to Base: 2001=100). This index no. is as applicable for the
month, five months prior to date of delivery.
The date of delivery shall mean the scheduled date of delivery (as depicted in
the Project Schedule) or the date of issue of Purchaser’s dispatch instruction,
whichever is earlier.
The price adjustment amount calculated by the above formula (including nuts
& bolts) shall not be subject to any ceiling, whatsoever.

(b) Conductors
The ex-works price mentioned at the price schedule is subject to variation
as per the following formula:

P1 = Po + ALF(ALy –ALy0)
Where,
P1 = Ex-works Price payable in Rs. per Km. as adjusted in accordance with
the price variation clause
Po = Quoted (base) Ex-works prices of the conductor in Rs. /Km.
ALF = Variation factor for Aluminium
For AAAC (61/3.31mm, 525 sq. mm.), ALF is 1.44839
ALy0 = Price of Aluminium Alloy rods in Rs. Per MT. The prices for raw
materials are as published by IEEMA for conductors prevailing for the
Caleder month, One month prior to the date of tender opening.
ALy = Price of Aluminium Alloy rods in Rs. Per MT. This price is as
applicable for the month, one month prior to the date of delivery.
The date of delivery shall mean the scheduled date of delivery (as depicted in

In the above price adjustment formulae, subscript ‘0’ refers to indices as


applicable on 30 days prior to date of bid opening (referred to as base date
indices) and subscript ‘1’ will correspond to billing period.

The price adjustment amount calculated by the above formulae in (e) 1,2 &3
shall not be subject to any ceiling, whatsoever.

9 Measurement of Work
Payment for erection items will be made through the Measurement Books (MB) duly
certified by the site Engineer. Payment for the supplied materials will be made on
joint inspection with the site Engineer.
Measurement of weight shall be in metric tonnes corrected to the nearest kilogram.
Linear measurements shall be in meters corrected to the nearest centimeter.
The quantity for payment of fabricated steel structures will be assessed from
approved fabrication drawings and the respective bill of materials prepared by the
Contractor and approved by the Purchaser. The weight of structural steel shall be
calculated on the basis of relevant IS code and handbook. Modes of measurement not
mentioned above, shall be as per relevant IS codes/ price schedules/ specification.

10 Temporary Work
All work of temporary nature such as temporary drains at work site, preparing
approaches in the working area wherever required shall be the responsibility of the
Contractor and all costs towards the same shall be deemed to have been included in
the quoted rates.

11 Preparation
11.1 Contractor’s representative
The Contractor shall engage at least one graduate engineer for supervision of the
execution. The Contractor upon signing the Contract shall nominate a responsible
officer as its representative at site. This person shall be suitably empowered for the
purpose of overall responsibility and co-ordination of the work to be performed at
site. Any written order or instruction of the Owner or his authorised representative, if
communicated to the resident representative of the Contractor, shall be deemed to
have been communicated to the Contractor at its legal address.

11.2 Site office


The Contractor shall also construct office, stores and workshop, at a suitable place at
its own cost. The space for these establishments The security of the establishment
shall rest with the Contractor. The Contractor shall also arrange for suitable
accommodation for its personnel and representative at site at its own cost.

11.3 Electricity, Water


The Contractor shall arrange for electricity and water required for construction work
solely at it cost and means. All temporary wiring must comply with the prevailing
regulations.

11.4 Tools & Plants


The Contractor shall arrange at its cost all tools and plants, tackles, ladders,
scaffolding, implements, safety belts and other equipment requisite for proper
execution of the work whether original, altered or substituted. The Contractor shall
be equipped with latest, calibrated and reliable sets of T&P of proper capacity in
sufficient quantities so as to complete the work entrusted to him within the scheduled

time. The contractor shall not use tools and plants that are not of proper standard,
strength and capacity.

12 Schedule of Work And Progress Report:


Parity shall be maintained for supply items with progress of work. The
successful tenderer shall furnish, within 30 days of issuance of Letter of
Acceptance/Award, the final project schedule with sufficient details depicted in the
form of BAR CHART or PERT NETWORK showing the commencement and
completion of all activities like procurement of raw materials, manufacture, shipment
to site, various phases of civil construction, erection, testing and commissioning and
performance guarantee test of all plant and equipment under the scope of contractor
for DVC’s approval prior to taking up the work.
The Owner shall have the right to change the schedule if found necessary for
co-ordination with other items of work, whether it is in the same area or connected
with the work of the project.
The finally approved Project Schedule shall be binding and form an integral
part of the contract. However, the schedule will be finalised after placement of LOA
which is also be binding for purpose of payment against Price variation.
The bidder shall furnish a preliminary schedule (bar chart or pert network)
with their bid considering date of LOA as zero date.
The supply items may be allowed to be despatched in staggered manner to
match with actual erection program.
The contractor shall submit a monthly progress report of work in approved
proforma to the purchaser indicating the achievements / slippages, if any, with
reasons for such slippages and remedial actions taken thereof.

13 Execution

13.1 Approved Vendors List

Bidders shall propose sub-vendors as per the list of approved make/ suppliers/
sub vendors for different items/ equipment given below. Regarding ‘Make’ and ‘Sub
vendors’ outside DVC’s list, Owner’s decision shall be final and binding. Final list
of Sub vendors and GTP in respect of main equipment and materials are to be
finalized and submitted by the successful Bidder subsequent to acceptance of LOA.
Requests for change of sub-vendors (involving sub-vendors other than the
Bidder himself) within the Owner’s list of approved vendors will be decided in terms
of Clause 31 of the GCC. Proposals for change from the Bidder himself to a sub
vendor or vice versa will normally be discouraged. In case of compelling
circumstances such proposals with proper justification may however be accepted.
Commercial implications arising out of such changes will be dealt with as follows:

1. There shall be no change in price on account of a change in source of


supply from one sub vendor to another.
2. There shall be no change in price/ price structure on account of a change in
source of supply from a sub vendor to Bidder. No additional payment/
reimbursement of taxes and duties shall be made by the Owner.
3. There shall be no change in ex-works price and inland F&I, in case of
change of source of supply from Bidder, as originally indicated in the bid, to a sub
vendor. However the taxes and duties shall be reimbursed at actual restricted to the
amount of taxes and duties as originally payable to the Bidder in terms of the bid.

NOTE :

1. a) In case of proposal of new Sub-Vendors, the bidder shall furnish


details / documents in support of the proposal viz. credential, past
proven performance, financial capabilities etc. as per requirement of
DVC, in respect of the proposed Sub-Vendors for the purpose of

13.2 Labour Regulations


The Contractor shall comply with the provisions of Employees Provident Fund Act
and register themselves with Regional Provident Fund Commissioner (RPFC) before
commencing work. The Contractor shall furnish along with each Running Bill, the

challan/ receipt for payment made to the RPFC for the preceding month.
The Contractor shall discharge all obligations under the Indian Workman’s
Compensation Act and Labour Laws for its employees and for those employed
locally.
The Contractor shall ensure proper safety of all the workmen, materials and
equipment belonging to it at site. In case any accident occurs during erection or other
associated activities undertaken by the Contractor causing minor or major injury to
its employees due to any reason whatsoever, it shall be the responsibility of the
Contractor to promptly inform all the relevant authorities and pay appropriate
compensation.
In every case in which by virtue of the provisions of the above mentioned
regulations, the Corporation is obliged to pay compensation to a workman employed
by the Contractor in execution of the work, the Corporation will recover from the
Contractor the amount of the compensation so paid and without prejudice to the
rights of the Corporation under the said Act, the Corporation shall be at liberty to
recover such amount or any part thereof by deducting it from the Security Deposit or
from any sum due by the Corporation to the Contractor whether under this contract
or otherwise.

13.3 Type Tests


All equipment supplied shall be type tested as per the type test requirements
indicated in the specifications. Certified copies of type tests shall be submitted to the
Purchaser as proof of compliance of the materials with the standards indicated herein
during finalization of vendor/ GTP. Type test reports must be from an accredited
laboratory. Accredition should be from the national accreditation body of the country
in which the laboratory is located. Type test reports submitted shall not be older than
5 years on the date of opening of bid. However 3(three) months relaxation may be
allowed at the discretion of DVC.
In the event of any discrepancy in the type test reports due to any design/
manufacturing changes (including substitution of components) or due to non-
compliance with the requirements given in the specifications, any additional type
tests required to bring the material/ equipment in line with the specification, shall be
carried out by the Contractor at its own cost.
All type tests mentioned in the price schedule may specifically be requested by
the Owner. In such cases the tests shall be witnessed by the Owner’s representative.

13.4 Acceptance Tests


Routine tests reports as per relevant IS/ DVC specification are to be submitted to
the Owner before acceptance tests by DVC.
The Contractor shall co-ordinate with manufacturer and the Owner for arranging
joint inspection of Acceptance tests. The Contractor shall inform the Owner at least
15 days in advance for inspection of any material to be supplied by them. Materials
shall, in no case be despatched prior to the receipt of written despatch clearance from
the Owner.

Materials damaged during Type/ Acceptance tests at laboratory/ works shall be


replaced/ rectified by the manufacturer/ Contractor at it’s own cost for which no
extra payment will be made by the Owner.

13.5 Document Approval Procedure


All drawings that may be required for complete erection & commissioning of
lines are to be designed and prepared by the Contractor in a CAD based software and
in a freely exchangeable format in consultation with the Owner’s Engineers.
Contractor shall prepare all detailed drawings as specified in scope of supply/
erection and submit the same in triplicate for review/ approval by the Owner. The
submission schedule of the drawings shall be in line with the supply and erection
schedule. Approval will generally be intimated within two weeks of date of
submission on time critical issues. Comments for correction shall be complied with
at the earliest to preclude any possible slippage in execution. The Contractor should
also note that no extra payment shall be made for design and preparation of
drawings, check prints and final printouts and for supply of CDROMs.

13.6 Document Requirements


Four sets of all approved drawings will be submitted for execution of work at site
for DVC use. Six sets of ‘AS BUILT’ drawings for supply items and ‘AS
ERECTED’ drawings for erection items and two sets of soft copies of all drawings
on CDROMs must be submitted after completion of all work.
Six sets of approved GTP of all equipment, installed in the line shall be submitted
after completion of all work.
Reports of Type test, routine test, acceptance test and drawings of all equipment
involved in the contract shall be compiled as one complete ring bound volume. Four
such volumes will be submitted after completion of all work.
The Contractor should note that unless all the documents indicated in the Contract
are handed over to the Owner, the balance 10% payment of supply and erection bill
would not be released. The Contractor should also note that no extra payment shall
be made for design and preparation of drawings, check prints and final printouts and
for supply of CDROMs.

13.7 Commissioning
On completion of erection, the Contractor shall request DVC Engineer for in-
spection and testing with minimum 15 days advance notice. The Engg-in-Charge
shall arrange for pre-commissioning tests generally within 7 days of receipt of such
request. During the above tests, the Contractor shall assist the Engg-in-Charge. Any
discrepancy/ modification/ defects/ tests pointed out/ advised this stage should be
complied with by the contractor.

On successful completion of pre-commissioning tests the Engg-in-Charge shall


arrange for commissioning tests. The contractor shall conduct all tests as advised and
rectify defects detected and any modification(s) suggested by
DVC Commissioning group. would finalise the program for such test in
consultation with the Contractor.
Line shall be charged on compliance of above in all respect including clearance
from CEA.

13.8 Taking Over


On successful testing and commissioning, the contractor shall request the En-
gineer in charge in writing for taking over the installation. The Engineer, on receipt
of requests, shall arrange for taking over the installation after final inspection. Till
such taking over, the responsibility of the whole installation against theft or damage
of any kind shall remain with the contractor.

13.9 Return of Materials


All materials shall be reconciled and excess material shall be returned to DVC
specified stores at Maithon/ Dhanbad/ Giridih or any other store as advised by DVC
at the cost of the Contractor.
The Contractor shall prepare a statement covering payments claimed and the
payments received vis-a-vis the work executed for reconciliation of accounts with
the Purchaser. The contractor shall also prepare and submit a detailed account of
materials issued by the Purchaser for use in the contract.

14. Forfeiture Of Security Deposit

If DVC by serving notice in writing does rescind the contract as per the
Cancellation/Short closure clause of the GCC for reasons attributable to the
contractor, the Security Deposit of the contractor will stand forfeited and be
absolutely at the disposal of DVC and the contractor will not be allowed to do any
work of DVC for a period of two years after the date on which the contract was
terminated.

DVC reserves the right, after giving notice to the contractor to measure the work
done till the date of termination, to take such part of the work as left unexecuted
out of his hands and give it to another contractor to complete. In such cases, any
and/or all the expenses and/or loss which may be incurred in excess of the sum
which would have been paid to the original contractor if the whole work had been
executed by him shall be borne and paid by the contractor and shall be deducted
from any money due to him by DVC under the contact or on any other account

whatsoever or from his Security Deposit or the proceeds of sales thereof.

DVC reserves the right, after giving notice to the contractor in writing, to employ
labour and to supply materials to carry out the work or any part of the work
debiting the contractor with the cost of the labour and the price of the materials
and crediting the contractor with the value of the work done in all respects in the
same manner and at the same rates as if it had been carried out by the contactor
under terms of his contract.
