COMPLAINT-AFFIDAVIT

I, HEIDI PERLAS K. FERNANDEZ, Filipino, 12 years of age, single, and a resident

of No. 5, Sto. Rosario, Angeles City, after being sworn to in accordance with law,
depose and state that:
1. The accused, Fernando Y. Fernandez is my biological father. This is evidenced by
my birth certificate attached as Annex “A”;

2. My mother, Almeerah K. Fernandez and the accused got married on November

7, 2003, herein attached as Annex “B”;

3. On the night of January 20, 2020, I was playing catch outside with my sister
when my father, the accused, arrived home and parked his motorcycle near the
door of our house;

4. While playing, my sister threw the ball more forceful than before which caused
me to step further back in order to catch the ball;

5. Unfortunately, I crashed against my father’s motorcycle which caused it to fall to

the ground and breaking its headlights and side mirrors;

6. When the accused heard the loud crash, he immediately ran outside and saw me
slumped over his motorcycle;

7. The accused dragged me inside the house and exclaimed several curses;

8. Once inside, the accused started punching and kicking me in different parts of
my body;

9. Despite my pleas and cries, the accused refused to stop beating me;
 10. My sister heard my cries and immediately called the attention of my mother and
our neighbour, Tita Coney Marcelo;

11. When they were successful in pacifying the accused, I was already slumped to
the ground and was already losing consciousness;

12. I woke up in the emergency room after a few hours with several wounds and
bruises all over my body;

13. As a result of such incident, the doctor assessed that I needed at least 30 days of
medical attention. Copy of such medical assessment is attached as “Annex C”;

14. I am therefore executing this Complaint-Affidavit to attest to the truth of the

foregoing statements and in support of the charges for Violation of Sec. 5(a) of
R.A. No. 9262 or the Anti-Violence against Women and their Children Act of
2004.

IN WITNESS WHEREOF, I have hereunto set my hand this 27 January 2020 at
