Concept of Pay:
 Pay means the amount drawn monthly by a Govt. Servant as
(i) the pay, other than special pay or granted in view of
his personal qualifications ( Generally it is called Basic Pay)
(ii) special pay and personal pay
(iii)any other emoluments which may be specially
classed as pay by Govt.
 Personal Pay means additional pay granted to a Govt. Servant to
save him from a loss of substantive pay
 Special Pay means pay granted for special nature of duties
 Compensatory Allowances means an allowance granted to meet
personal expenditure necessitated by the special circumstances
in which duty is performed. It includes HRA, Local Allowances,
Uniform Allowances, Travelling Allowance etc.

Fixations of Pay (F.R. 19 – 35 )
 Pay: The amount drawn monthly by a Govt. servant.
 Revised Master Scale 2015 of T.S. State Govt. employees :
 The Revised Master Scale shall be Rs.13000-390-14170-

 (ii) The existing 32 Grades shall continue with 80
segments in the Revised Master Scale.
 For every post, one grade scale is assigned.

Circumstances under which pay fixation arises:
1.First appointment to a post
2.Revision of scales of pay
3.Promotion to a post carrying higher
responsibilities
4. Automatic Advancement
5.Appointment by transfer to a post outside the
regular line
6.Repatriation to the parent dept. from outside the
regular line
7.Substantive appointment to a post not carrying higher
responsibilities or to a new post
8. Reversion to a lower post
9.Reemployment after retrenchment
10. Reemployment after retirement
11.Reduction of pay as penalty

1.First Appointment:
 The basic pay is fixed at the min. of the time scale
attached to the post to which an employee is
appointed (FR 22(b)).

For Ex.: If a person is appointed to a post


Deputy Collector, his pay is fixed at the
min. of the time scale attached to that
post.

 The pay of a regular Govt. Servant (not appointed
under emergency provisions) when appointed directly
to another post under the Govt. on selection by the
APPSC shall be fixed in the new post at a stage which
is not lower than the pay drawn by him in the earlier
post (FR 22 a (iv) Pay Protection). Next increment will
be sanctioned after completion of 1 year in the new
post i.e. no protection of increment.
For Ex.: If a Govt. servant drawing a pay of
17050 in time scale 14860-39540 is appointed directly to a
post having scale 16150-42590, his pay in the old post is
protected.

2.Revised Scales of Pay
 The option has to be exercised by the Govt. Servant
whether to continue in old scales or to come into new
scales either w.e.f. 1st July or from the date of increment, as
mentioned PRC G.O.
Pay fixed at the next stage to the amount arrived by
adding DA, Fitment.
Pay in pay scales 2005 : 13750
D.A. as on 01.07.08 (42.39%): 5829
Fitment (39%) : 5363
Total : 24942
Pay fixed at Next Stage : 24950

 Three stagnation increments can be sanctioned beyond the
max. of the scale (G.O.Ms.No.52,Fin(PC.1)
Dept.,Dt.25.02.2010.

 G.O.Ms.No.25,Fin(HRM.IV) Dept.,Dt.18.03.2015.
 Government also hereby order that all the
employees falling under Grade-I to Grade - XXXII
are entitled for five stagnation increments
beyond the time scale in the Revised Pay
Scales, 2015. These stagnation increments shall
be treated as increments for all purposes such as
fixation of pay on promotion / Automatic
Advancement Scheme, Pension etc.

3.Promotion to post carrying higher responsibilities
 The pay is fixed under FR 22 (a)(i) or FR 22B
 FR 22 (a)(i): Initial pay the stage of the time scale
next above his substantive pay in respect of the old
post.
For Ex.: If an employee drawing a pay of 15280 in
11530-33200 and increment in August’13 is promoted to a
post having scale of pay 14860-39540 in March’13,
Pay in the lower post 15280
for Next stage +420=15700
His pay will be fixed at the next stage at 15700
from the date of promotion

FR 31(2): On an enhancement in the substantive pay, as a
result of increment or otherwise, the pay of such Govt.
Servant shall be re-fixed from the date of such
enhancement as if he was appointed to officiate in that
post on that date where such re-fixation is to his
advantage.
Pay in the lower post 15280
Increment +420
Total 15700
for next stage +450=16150
His pay will be re-fixed at 16150 as on date of
increment i.e. August’13

 FR 22B:The individual is allowed option to have benefit of
this fixation either
(a)from the date of promotion or
(b)from the date of next increment in the lower post.
 Option has to be exercised within 1 month from the date of
promotion and can be revised only once within a period of 1
year from the date of promotion
 The pay in the promotion post is fixed at a stage above the
notional pay which is arrived by increasing the pay in the
lower post by an increment.
 The date of fixation is the crucial date for grant of future
increments in the higher post.

 (i) if the individual opts to fix his pay from the date of
promotion:
for Ex: If an employee is drawing a pay of 15280 in
11530- 33200 and increment in August’13 is promoted to
a post having scale of pay 14860-39540, in March’13
Pay in the lower post 15280
Notional increment +420=15700
Pay fixed at a next stage in the
new scale 14860-39540 in March’13 +450=16150
Next date of increment is the date of promotion
i.e.March’14 +450=16600

 (ii) if the individual opts to fix his pay on date of
increment in the lower post,

pay will be fixed initially under FR 22(a)(i) and refixed on date of


accrual of next increment in lower post under FR 22B

for Ex: If an employee is drawing a pay of 15280 in


11530- 33200 and increment on August’13 is
promoted to a post having scale of pay
14860-39540, in March’13

 FR 22B is not applicable to employees who have availed
24 years scale
 The pay fixation of the employees who are promoted to
a higher post after enjoying 3 stagnation increments in
lower should be done according to FR 22 a(i) and not
FR 22B.
 The pay fixation of an employee when promoted from a
post carrying special pay to a post not carrying spl. Pay
should be done by merging the Spl. Pay with basic pay
in the lower post. This rule will not be applicable to
the recruitees who are appointed after 24.08.98.

4.Automatic Advancement
Scheme:
 It has been introduced w.e.f. Dt.1.4.1981 in order to relieve
stagnation in services
 On completion 6 / (12/18) / 24 years of service which counts for
increment an employee shall be eligible for special grade scale
which is usually a scale next above the ordinary pay scale of the
post (G.O.Ms.No.96, Fin Dept,Dt.20.05.2011) w.e.f.01.02.2010.
 G.O.Ms.No.38, Fin (HRM.IV)Dept,Dt.15.04.2015) w.e.f.01.07.2013.
 An addl. Increment is released on assigning the AAS scale.
 There is no separate 18 years scale and only addl. Increment is
released in the 12 years scale.
 For assigning 12 years scale, an employee has to pass the tests
which are required for promotion

5&6.Appointment by transfer to a post outside the regular line and
on repatriation to the parent department:
 (a)If an employee is promoted to a higher post outside the
regular line, the same principles of pay fixation will apply
i.e. FR 22(a)(i) with FR 31(2) or FR 22 B

 (b)If a junior in the regular line is promoted and his pay is


fixed higher than the senior , then the pay of the senior
working outside the regular line will be fixed on par with the
junior( Ruling 8 FR 19 and FR 30(1)).

 (c)On repatriation to the parent dept., the pay accrued will


protect by treating the excess as personal pay to be merged
in future rise in pay on account of grant of increments.

7.Substantive appointment to a post not carrying higher
responsibilities F.R. 22 (a)(ii):
 (i) His pay in the new post will be fixed at the stage of time scale which is equal
to his substantive pay in the old post. The date of increment will be protected.
For Ex.: If an employee is drawing a pay of 11200
in 10900 – 31550 is appointed to a post
having scale 14860 – 39240,
his pay is fixed at 11200.

 (ii) If there is no stage equal to his substantive pay, the initial pay has to be fixed
at a stage next below the substantive pay, the excess will be sanctioned as PP.

 (iii)If the min. of the new time scale is more than substantive pay, the initial pay
shall be fixed at the min.. The date of next increment shall be after one year from
the date of appointment.
For Ex.: If an employee is drawing a pay of 11860 in
10900 – 31550, is appointed to a post having scale
14860-39540,
his pay is fixed at 14860

8.Reversion to a Lower post:
 Reversion may be due to 3 reasons
 1.Administrative grounds
 2.Penalty/Punishment FR 28
Pay not exceeding the max. of the lower post
 3.Own request FR 22 (a) (iii)
The initial pay has to be fixed under FR 22 (a)(ii) but
the max. of time scale of new post is less than the
substantive pay in the old post, he will draw max. of
time scale of new post as initial pay. No PP is admissible.
For Ex.: If an employee is drawing a pay 39540 in
14860-39540 was transferred at his own request
to a post having time scale 10900-31550, his pay will
at max of new scale i.e. at 31550.
 Pay protection is not done in any type of reversion.

9.Fixation of pay of reemployed employees after
retrenchment:

 Pay fixed according to Rule (9) FR 22 and


G.O.Ms.No.1002 G.A.D.Dt.29.11.1967 and G.O.Ms.No.219,
Fin.,Dt.14.04.1972.
 Fixed at the min. of the time scale.
 In addition, grade increments counting the length of
previous service also be sanctioned, provided they have
not received any pension or gratuity or if received have
returned.
 Leave at credit shall not be allowed to carry over.

10.Fixation of pay of Reemployed employees after
retirement:
 Pay fixed according to G.O.Ms.No.145, F&P (FW PSC)
Dept.,Dt.16.10.2000
 If pension is not considered, pay will be fixed at the
min. pay of scale of the post
 If pension is considered,
Pay in the new post = Last pay drawn in old post -
pension
 A.G.I. may be sanctioned
 DA, HRA, CCA etc., may be claimed
 No DR will be allowed on pension.

11.Reduction of pay as penalty:
 The order should mentioned the period for which the
reduction has been ordered.

 The order should clearly specified whether the period


can be counted or postponed for the sanction of
increment

Increments (F.R.24,26 & 31A):
F.R.24: Increment shall ordinarily be drawn as a matter
of course unless it is with held. Presence of
orders is necessary for withholding increment
for misconduct or dissatisfaction of work.

 F.R.26 lays down the conditions  Periods not count for increment

increment. (i) Over stayal of leave
(i) all periods of duty (ii) EOL other than illness
(ii)deputation on MC
(iii) foreign service (iii)Non continuous service
(iv) all leave with allowances (iv) Suspension period

(vii) Joining time
(viii) Training period

 FR 27: Sanction of premature increment
(preponement and step up)
 By the appointing authority only
 Preponement of date of increment of senior with that
of junior may be sanctioned provided (i) the junior
was drawing pay at the higher stage than the senior (ii)
the pay of both is fixed at the same stage in the new
scale and (iii)both have opted for the revised scale

Combination of Appointments
( F.R. – 49 )
 The state govt. may appoint one govt. servant to hold
substantively as a temporary measure or to officiate in
not more than two independent posts at one time.

 Independent means separate or distinct post and the


second post is not being subordinate to the regular one
(G.O.Ms.No.116 Fin Dt.16.04.69).

1. Unless the previous incumbent of addl. Post has given
over charge.
2.(A)in case of FAC: if the period of addl. Charge does not
exceed 14 working days ( excluding holidays, CL)
(B)in case of discharging current duties: 1 month
3. If the addl. Post held is not independent and not
subordinate to regular post.
4.When the extra duties to be performed are only
nominal or comparatively light.
5.during the period of vacation unless the addl. Duty
is actually performed.

 Competent Authority:
 Upto 3 months: HOD
 Beyond 3 months: Govt.
Addl. Pay : ½ of first 3 months
 No addl charge shall be given to Class IV,
Chowkidars,Drivers and Record Assistants.
 Addl. Charge is not permissible from a retrospective
date.

Joining Time (F.R. 105 to 108)
 Joining Time may be granted to a Govt. Servant to enable to
join a new post to which he is appointed.
 It is admissible in the following cases
i) to join a new post while working in an old
post ( on transfer )
ii) to join a new post on return from leave on
average pay of not more than 4 months
duration
(iii) to join a new post on return form any kind
of leave when he has not had sufficient
notice of his appointment.

(iv) to travel form the port of debarkation or
airport when he returns from leave, study l
leave or deputation out of india of more
than 4 months duration.
(v) to proceed from a station to join in a post
in a place in a remote locality.
(vi) to proceed from a station in a place in a
remote locality to another station after
relinquishing charge.
(vii) to the surplus staff transferred from one post
to another post

 Joining time is computed as follows
(i) a) for preparation – 6 days
b) for journeys: by rail – 500 km … 1 day
by motor vehicle -150km..1
Besided the above 1 Sunday is permissible.
For any fraction… extra day is allowed.
Max period is 30 days.
(ii) when there is no change of residence as a
sequel to the transfer only 1 day is allowed.

 Joining time is treated as duty and the employee is
entitled to pay drawn by him in the old post before
handing over charge and DA, HRA, & CCA as
applicable at old station. Conveyance allowance, FTA
are not admissible during joining time(G.O.Ms.No.84,
Fin, Dt.15.04.81.)
 Where transfer of charge consists of inspection of
several stores or scattered works by both the officers,
the relieving officer is allowed additional time as on
duty.
 During joining time after leave with allowances, joining
time pay equal to leave salary.

Foreign Service (F.R.110 - 126)
 Service in which the Govt. Servant receives his pay
from a source other than the consolidate fund of State
(F.R. 9(7)).
 Deputation means service in which a Govt. servant
receives pay form the consolidate fund of the State
from an authority other than the Dept. to which he
belongs.
 No Govt. servant may be transferred to foreign service
against his will (F.R.110(a)).
 A transfer to foreign service outside India may be
sanctioned by the President of India (F.R.110(b)).
 HODs may sanction transfer of Non Gazetted staff to
foreign service.

 Max Peirod: 5 years
 HOD : 3 years
 Govt. : Another 2 years.
 Foreign employer has to pay pension contribution, leave salary
contribution as per the table under FR 115.
 Pension and Leave salary contribution be waived in respect of
employees working in AP SC,ST, BC Corporations, Women
cooperative Finance Societies,ITDA, DRDA etc.,
