AN ORDER CREATING THE BARANGAY ECOLOGICAL SOLID WASTE
MANAGEMENT COMMITTEE (BESWMC)
WHEREAS, the problems of solid waste management confronting local
government units are becoming more complex as population and local economies grow. LGUs need to continually review and map out short-term and long-term solutions to effectively deal with them;
WHEREAS, Republic Act No. 7160, otherwise known as the Local
Government Code of 1991, enjoins LGUs to enforce sanitation laws, prepare a solid waste management program, and other environmental functions, Section 17 mandates barangays and municipalities to provide services for solid waste collection and management;
WHEREAS, Republic Act. No. 9003 otherwise known as the Ecological
Solid Waste Management Act of 2000, emphasize the vital role of the barangay in the successful implementation of the program, particularly segregation, collection of solid waste and recycling of waste at source shall be conducted at the barangay level, specifically for biodegradable and reusable waste. The said law also provides for the establishment of a materials recovery facility (MRF) in every barangay or cluster of barangays. For these reasons, a Barangay Ecological Solid Waste Management Committee is to be created in consonance to Section 10 of RA9003 through the issuance of Memo. Circular 2001-38;
NOW, THEREFORE, I, MAREFE D. PAMIL, Punong Barangay of Bacong,
Salug, Zamboanga del Norte, by virtue of the powers vested in me by law, do hereby order the constitution of the creation of the Barangay Ecological Solid Waste Management Committee (BESWMC), its functions and duties, to wit: SECTION 1. Barangay Ecological Solid Waste Management Committee is hereby amended and reconstituted as follows:

SECTION 2. FUNCTIONS AND DUTIES.
1. Formulate a community solid waste management plan and program consistent with that of the municipality; 2. Be responsible for the segregation and collection of solid waste specifically for biodegradable, compostable and reusable waste; 3. Establish within the barangay or cluster of barangays a Materials Recovery Facility (MRF); 4. Allocate barangay funds for the barangay ecological solid waste management program, approved by the Sangguniang Barangay; 5. Organize a Core of Area/Street Coordinators through the conduct of trainings for barangay residents on segregation, composting, recycling and livelihood opportunities from use of recyclable waste and to monitor their implementation; 6. Integrate the Ecological Solid Waste Management program in the Barangay Development Plan and/or Annual Investment Plan; 7. Find alternative sources of funds other than the regular barangay budgets; 8. Submit a monthly report to the Municipal Ecological Solid Waste Management Council on the progress of the program, copy furnished to the MLGOO.
SECTION 3. REPEALING CLAUSE. All orders, issuances and memoranda issued
inconsistent herewith are deemed superseded, cancelled and/or revoked.
SECTION 4. EFFECTIVITY. This Executive Order shall take effect immediately.
