CREATION AND COMPOSITION OF THE TECHNICAL WORKING GROUP. A Technical Working Group shall be created to monitor and evaluate the Pilot Implementation of Motoreyele Taxis to be composed of the following: PMGEN ANTONIO N GARDIOLA, JR. PILOT IMPLEMENTATION: The pilot implementation will be considered as part of the ‘TWG activities and will be placed under the strict supervision of the DOTr. The Final Report of the TWG and the result of the Public Consultation will be submitted to DOTr for approval before submission to the House of Representatives and Senate which shall serve as valuable inputs for legislative action. SECTION 3. AREAS OF IMPLEMENTATION: The pilot implementation will run within Metro ‘Manila and Metro Cebu. SECTION 4, BASIC GUIDELINES: In order to ensure the efficiency of the pilot implementation, the ‘TWG formulated the basic guidelines to be strictly implemented and followed: ON SAFETY: 1. The Motoreycle Specifications shall be as follows: i. 100-150 cubic centimeter (ce) conventional engine displacement ii, Allowable build types include: underbone, scooter, business motorcycle models only. No aggressive sport, off-road or enduro bikes. Pillion seat and foot pegs must be in good condition, and exhaust pipe shall be insulated. Any modifications made shall adhere to the LTO standard; and : iv. No modifications to engine, air intake, exhaust, of wiring. Direc ne 425-2515, 4252598 Fax No 921-2201 ¥V. Motorcycles without top boxcs shall have a helmet bag secured by a flexible strap. 2. The Biker/Rider must comply with the following safety measures: a, Rider must comply with safety gear laws; 'b, Rider should be equipped with helmet and reflectorized vest with relevant Motorcycle ‘Taxi branding and identification card which includes the rider control number provided by LTFRB, Only helmets with Philippine Standards (PS) or Import Commodity Clearance (ICC) shall be allowed; cc. Rider must wear a belt-based strap with at least 4 handles that can be held by the passenger for stability; 4d. Rider must be in good health condition prior to accreditation by MC providers as certified by public hospitals or DOH accredited clinics. ¢. Rider shall drive no faster than 60kph along any road while on duty, even if the speed limit permits higher speeds £. Rider shall observe speed limit in all roads such as schools, churches, markets, hospitals; 2. Rider shall abide by all available traffic rules and regulations; 1. Rider needs to observe maximum payload of the motorcycle; i, Rider shall ensure that motoreyeles are routinely maintained and all safety gear are in 00d condition; 4, Rider must wear proper uniform c.g, pants and shoes; and . Rider shall only be allowed fo serve ten (10) hours a day, or as prescribed by the LTFRB. 3. The passenger must comply with the following safety measures: a, Passenger should be provided with reflectorized helmet and comply with proper safety ‘gear requirements; ’ Passenger to seat front-facing only; ©. The following passengers shall not be allowed to ride: i, Passenger who is under the influence of alcohol, drugs and other banned substances; 4d, PWD who cannot hold -on safely . Children covered by R.A. 10666 or the Children’s Safety on Motoreyeles Act of 2015 £ Pregnant women ON SECURITY: 1. Participating Ride Hailing Platform Providers shall require the Riders to submit the following: a, Professional Driver's License b, NBI Clearance «. Police or Barangay Clearance 4. Court Clearance/Publie Prosceutor’s Clearance ¢. Pillion-ferrying Skills Assessment £. Traffic Rules and Regulations Written Exam g. Customer Relations Training for Riders h, Official ReceipUCertificate of Registration for the motoreycle under rider's name, otherwise, proof-of-ownership (e.g. deed-of-sale) or authorization letter to use must be provided i. Completed Passenger Courtesy Training to avoid sexual harassment and discrimination, among others SECTION 5. DATA SHARING: To obtain the necessary data, the Participating Ride Hailing Platform Providers and Participating, Bikers/Riders shall comply with the following: a, The TWG or any designated IT expert must be allowed to access to the Participating Ride ling Platform Provider database for validation and verification. b. All Riders must register with the LTFRB to create a database of participating Riders. The data format shall be provided by the TWG: ¢. The Pilot Implementation should run on a Motorcycle Ride ailing app-based platform; . The participating ride-hailing platform for the pilot implementation must submit a List of Bikers/Riders registered in thcir platform Hi Oe US ©. The MC taxi providers must provide free online access to the feed back mechanism from the passenger and riders. f The participating ride-hailing platform for the pilot implementation must, on a monthly basis, submit raw data on the following: i, Road crashes and complaints from passengers; ii, Collation of service feedback from passengers; iii, Any data on trips, kilometers travelled, fares collected, as determined by the DOTr; iv. Metro Cebu pilot implementation will gather data for mountainous and rural areas to ‘determine best course of action for motoreycles-for-hire specific to those locations; and -. Modifications or updates of their mobile application, if any. g. Have access to a feedback mechanism for both rider and passenger to raise complaints or other issues (€.g. accidents, lost items, etc); h. The Data for Road Incident Visualization Evaluation and Reporting System (DRIVERS) and the other road safety databases (MMARAS, PSA, ONEISS-DOH) shall be utilized for this pilot ‘implementation; SECTION 6. MONITORING AND EVALUATION: The TWG Members shall convene on a monthly basis with the following data and report to be submitted one week prior to the mecting, for validation and evaluation: 1. Data provided by the Participating Ride Hailing Platform Provider, 2, Reports from the other government agencies concemed (PNP-HPG, MMDA, LTO & other traffic enforcement agencies) 3. Periodic validation on the mobile apps system operation. 4. TWG must validate the data submitted by MC Taxi provider by accessing their database and platform, 5. TWG must validate the actual report submitted by MC Taxi provider from other government agencies concerned. 6. TWG must validate the feedback report of the rider & passenger from the mobile apps platform and for on-line feed mechanism, 7. TWG must conduct surveys to get feedback from riders and passenger. SECTION 7. FARE MATRIX: The following fare matrix shall be utilized for the purpose of the pilot implementation: ‘a. Metro Manila: Php 50 for 1 st 2km, Phpl0/km up to km and Php 15 for the succeeding km , Metro Cebu: Php20 for 1 st km, Php16/km up to 8km, and Php 20/km above Skm. SECTION 8, PERIOD OF PILOT IMPLEMENTATION: The pilot implementation shall run for three (3) months from 23 December 2019 and shall terminate on 23 March 2020. Said period may be extended for another three (3) months upon favorable recommendation of the TWG. In ease a law is enacted amending RA 4136 and other related laws allowing Motoreycles as Public Utility Vehicle, the TWG becomes functus officio and the pilot implementation shall cease SECTION 9. KEY PERFORMANCE INDICATORS (KPD: The following shall serve as the KPI for the pilot implementation: 1, Accident Threshold (both major and minor incidents) — Five (5) Percent of total rides; any ‘major or fatal incident will call immediately for an emergency TWG mecting, followed by an investigation and decide appropriate next steps which may include possible suspension of the pilot implementation; 2. Traffic Rules Violation reported by the PNP-HIPG, MMDA, LTO and other traftic-enforcement agencies; and 3. Customer Feedback from Frequent Customers. Oe OS SECTION 10. PARTICIPATING RIDERS: A total of 30,000 riders for Metro Manila and 9,000 riders for Metro Cebu shall form part of this pilot implementation. The number of riders shall be divided evenly among qualified Ride Hailing Platform Providers. SECTION 11, OPERATIONAL REQUIREMENTS: Participating ride-hailing platform shall comply with the following operational requirements: 1. All bookings shall only be made within and via the app platform. 2. Accident insurance should be secured and on par with or above Passenger Personal Accident Insurance Program (PPAIP) rates, 3. A comprehensive safety campaign for the public to ensure that all passengers arc knowledgeable in pillion-riding shall be implemented. 4. Existing motoreycle units with or/er as of 1 December 2019 shall be allowed to be included in the pilot implementaton 5. A one motoreycle-one rider must strictly be observed in the implementation. Participating Riders shall be registered to one (1) ride hailing platform only. SECTION 12. BLACKLISTING: Ride-Hailing Platform Providers and Riders registered in their platform found operating without authority shall be blacklisted from applying and operating should a law be enacted amending RA 4136 and other related laws allowing Motoreyeles as Public Utility Vehicle. Al other motorcyle not registered with DOTr/LTFRB but operating as a motoreycle taxi shall be considered as colorum. SECTION 13. TERMINATION. The TWG may recommend for the termination of the pilot implementation upon assessment of the operations. The TWG may likewise pre- terminate the Pilot Implementation in case of violation of ride hailing platform providers and its registered bikers of any provisions of this guidelines SECTION 14. CREATION OF DATABASE. LTERB is tasked to register all riders included in the pilot implementation and to create and build a database. SECTION 18. REGISTRATION FEE. LTFRB is tasked to provide guidelines as regards the collection of registration fees from Participating Ride Hailing Platform Provider and their registered Bikers/Riders. SECTION 16. EFFECTIVITY. The Extended Pilot Implementation for the Motorcycle Taxi shall take effect on 23 December 2019, CON Oy Se PMGEN ANTONIO N.
