JUDICIAL AFFIDAVIT
(By Way of Direct Examination)

Petitioner, JADE FLORES BARTOLOME, of legal age, Filipino, and


with residential address at 142 Juan Luna St., Pasay City, Metro Manila,
having been duly sworn to in accordance with law through the
supervision of ATTY. JOSE LEOZAR L. VELASCO with office address at Rm.
501 VICTORIA TOWER 1, Timog Avenue, Diliman, Quezon City, conducted
at the given address of the counsel of record, hereby answers all the
questions asked of him with full consciousness under the pain of criminal
liability for false testimony or perjury:

The testimony of this witness is being offered to prove the


following matters:

1. The allegations in the ANSWER;

2. The facts that the respondent is not suffering from Histrionic


Personality Disorder which renders her, psychologically
incapacitated to comply/perform essential marital
obligations;

3. The fact that the petitioner and respondent are separated-


in-fact since 2016;

4. The fact that both parties have one common child;

5. That both parties have no community of property;

6. Other matters relevant to this case.

DIRECT EXAMINATION

1. Q: Please state your personal circumstances.

A: I am JADE FLORES BARTOLOME, a Filipino, 30 years


of age, and a resident of 142 Juan Luna St., Pasay City,
Metro Manila.

Atty. Tolentino: Your Honor, may we request the copy of


Barangay Clearance issued by Brgy. 35, Zone 03, Pasay City
be marked as Exhibit “G”.

2. Q: Why are you here, Mrs. BARTOLOME?

A: I am here because my husband filed a Petition for


Declaration of Nullity of Marriage against me,
although I still love him dearly and would want nothing
more than to remain married to him.

Atty. _______________: Your Honor, may we request the


copy of the Petition be marked as Exhibit “A”, as well as the
Verification and Certification of Non-Forum Shopping page
and the signature of the Petitioner as Exhibits “A-1” and “A-
1-a”, respectively.

3. Q: I have a document here which I am showing to you,


purporting to be a Petition for Declaration of Nullity of
Marriage dated June 30, 2016 under Civil Case No.
RTC-PSY-1022-16, is this the same Petition you are
referring to?

A: Yes Sir, that is the Petition that my husband filed.

4. Q: And at the back of this Petition, particularly the


Verification and Certification against Non-Forum
Shopping, it bears the name Jade Flores Bartolome
and a signature affixed above said name, is this yours?

A: Yes Sir, the name is mine and I am the one that
affixed that signature above my name.

Atty. _______________: Your Honor, may we request that


the copy of the Petition dated June 30, 2016 be marked as
Exhibit “A”, as well as the Verification and Certification
against Non-Forum Shopping page as our Exhibit “A-1”,
bracketing the name and affixed signature thereon as our
Exhibit “A-1a”.

5. Q: When and how did you meet the petitioner?

A: I first met the petitioner in 2014, in a car expo held


in Pasay City, Metro Manila. I was a sales agent then,
working for a car company.

6. Q: How did your first meeting go?

A: The petitioner came to our booth to inquire about


the cars we were selling. We talked for about 15
minutes or so. Eventually, he asked for my contact
information, so he can get back to me for a follow up.

7. Q: Did the petitioner contacted you after?

A: Yes, he initially called and texted me strictly on


business matters. As the days went on, his messages became
decreasingly work related and more of something as that
would come of a friend.

8. Q: Did you and the petitioner became friends after


that?

A: Yes, I sensed a sincerity in him which I found lacking


in the people I meet every day. My job takes almost all of my
time and energy which is why I was yearning for some sort
of a companionship. Frankly, I was glad for the friendship he
offered.

9. Q. Was your relationship with petitioner merely just


friends?

A: No, we eventually became more than just friends.
But it did not happen abruptly. During those times, we
went out on dates where we got to know each other
more and built our friendship. After a month, the
petitioner professed his love for me which I
wholeheartedly accepted. We started going steady
after that.

10. Q. As a couple, did you and the petitioner engaged in


sexual relations?

A: Yes, we were very much in love with each other. We


would constantly text each other during the day when
at work and looked forward to when we would meet
again. In the weekends, we would often go out on
short adventures out of town. Sometimes we would
even visit our respective parents in the province
together. He was very sweet back then, he would
often send me flowers at work and take me home at
the end of the day.

11. Q: It seems that you and the petitioner were always


together, was there a time when you were apart?

A: Yes Sir. In December 2014, I was assigned to my


company’s southern headquarters to assist in
establishing and stabilizing our base of operations
there. Aside from providing assistance there, I had also
undergone mentorship under the Company’s CEO.

12. Q: You mentioned the Company’s CEO, was he the


same Ace mentioned by your husband in the petition?

A: Yes sir.

13. Q: Did this Ace, made any romantic advances towards


you?

A: No sir. Although even if he did, I would have paid no


mind to it as I was completely in love with Lino. Truth
be told, I was half-hearted in going to Cebu to undergo

mentorship there as it would mean less time for us to
be together. If Lino had not motivated me, I would
have declined the offer and stayed in Manila.

14. Q: What happened on February 14, 2015?

A: I went to Taiwan with my other officemates along


with their loved ones. The trip was a reward for
performing employees which also included another
ticket to have them bring a loved one along.

15. Q: Why was the respondent absent during the trip?

A: Our original was to go there together but he had to


cancel his trip due to a work emergency. Initially, I also
decided to cancel my trip as it would be pointless
without him, but he convinced to go and pleaded to
bring my female best friend to go in his stead.

16. Q: When did you and the petitioner got married?

A: My Taiwan vacation lasted for 1 week and when I


got back home, I was surprised he was there along
with our family and friends. He said he just wanted to
greet me a happy birthday, but he also went down on
his knees and asked me to marry him. I said yes, and
we made our wedding preparations and got married
on May 30, 2015 in Quiapo Church in City of Manila,
Metro Manila.

17. Q: Where did you and the petitioner lived?

A: We lived in a two storey house in 1212 Venus


Street, Barangay 152, Paco, Manila.

18. Q: How would you describe your marriage?

A: After our marriage, we both decided for me to stop


working and become a full time housewife. During the
weekdays, Lino would manage his auto parts and
repair shop while I tended to the house and prepared

our meals. During the weekends, we would go out,
have dates around town. Every once in a while, we
would travel overseas and spend a few days there. We
were happy during those days and I have felt a great
sense of fulfillment as his wife that I did not feel when
I was working. For his part, I also felt Lino’s happiness
too as he was grateful that I was supporting him in his
business. He also adored the food I prepared for him
each day as he always asked for seconds and gained a
few pounds because of it.

19. Q: Did you ever felt the need to go back to work during
your marriage?

A: Yes Sir. A year after our marriage, our business went


under due to our inability to compete with bigger
establishments who had a bigger customer base due
to their relatively cheaper prices. During that time,
Lino and I decided for me to go back to work.

20. Q: Were you able to find work again?

A: Yes. My previous employer was gracious enough to


let me for them again.

21. Q: Were there any changes to your previous set up as


married couples when you returned to work?

A: Yes. Primarily, our chore assignment was altered as


we would sometimes swap chores according to
availability which I think for the most part was equal.
Often times, I would have to render overtime work to
finish my tasks. Other times, I would take home work
during the weekends just to finish it.

22. Q: Did your work have any effect on your marriage?

A: Unfortunately, yes, it did have an adverse effect. I


felt that Lino was starting to become resentful
towards me because of our situation. I think he felt

bad that I was spending less time with him because of
my work and that his pride as a man was somehow
wounded when I became the breadwinner. It was also
during that time that it became a habit of his to fidget
around my smartphone. Although I did not mind that
habit of his, I always wondered why.

23. Q: Were there any changes to your sex life?

A: Yes, before I went back to work, we would have sex


almost every other day. When I started working again,
it was just two or three times a week.

24. Q: Did you have any sort of romantic or sexual


relationship with Ace Corpuz or anyone other than
your husband?

A: No, I love my husband and I would do nothing to


harm him or cause him pain. Ace Corpuz was the CEO
of the company I currently work for but I do not work
directly under him. As the company’s CEO, he is always
in the southern headquarters as that is where the
company originated from. Frankly, I am perplexed as
to why they allege him and I are lovers as Ace Corpuz
is already in his mid 60s and even if he were in his
prime, he could not have compared to Lino.

25. Q: Do you wish to be reunited to your husband?

A: Yes, definitely sir. It is my ardent wish for us to be


reunited again. I could find no other man whom I can
surrender myself to. I truly believe that we can
overcome this hurdle and be happily married once
more.
