JUDICIAL AFFIDAVIT
(of Prosecution Witness, Miguel Quirino)

PRELIMINARY STATEMENT

I, Miguel Quirino, 33 years of age, born in Makati City, Manila, Single and employed as
Head Waiter at Shaw Burger Joint, after having been duly sworn to in accordance with
law, hereby depose and state that:

1. The person examining me is Atty. Marivic Boni with address at Block 12, Lot 8 Sapphire
St. Quezon City;
2. The examination is being held at the same address; and
3. That the questions are asked in the English Language but are translated in the Tagalog
dialect which I fully understand and
4. That I am answering his questions fully conscious that I do so under oath and may face
criminal liability for false testimony and perjury.

OFFER OF TESTIMONY

The testimony of the witness, Miguel Quirino, is being offered to prove that he is an
eyewitness in the crime of Frustrated Homicide against the person of Juan Vito Cruz. He
will testify what he saw last July 26, 2018 and the events that transpired on the said date.
The witness will identify the accused in open court as the person who committed the crime.

EXAMINATION OF THE WITNESS

1. Q : Mr. Witness, will you please tell the Honorable court your name, age and
personal circumstances?
A : I am Miguel Quirino, 33 years of age, born in Makati City, Manila, Single and
employed as Head Waiter at Shaw Burger Joint.
2. Q: Mr. Witness, where were you on the 26th day of July 2018?
A: I am at the Shaw Burger Joint working from 8:00 in the morning until 5:00 in the
afternoon.
3. Q: Mr. Witness, are you related by any chance to the accused, Mr. Torres?
A: Yes, He is the head chef at the Shaw Burger Joint, the restaurant where I work.
4. Q: Mr. Witness, do you know by any chance, the private offended party, Mr. Vito
Cruz?
A: Yes, He is our Boss and the person responsible in managing the restaurant.
5. Q: So, Mr. Witness, can you tell us based on your personal knowledge of the
events that transpired last 26th of July 2018?
 A: It was already time to close the restaurant until I heard Mr. Vito Cruz screamed
for help. I immediately ran at the kitchen and I saw him lying on the floor in a pool
of blood pointing at Mr. Torres who was holding the Chef knife and immediately
escaped from the back door.

3. I nor any other person then present or assisting her coached the witness regarding her
answers.
