While on patrol, I was called to assist AO2 with a minor traffic accident atthe listed location. arrival, I
teamed from A2 that AP vehicle lad boon weatbound on W. Comncre ad tard noth ome NW 26d 6. AP vehicle
‘struck a pipe used in a construction project about 1/2 block away. AP vehicle was significantly damaged but was driven
back to the the intersection of NW 26¢h and W. Commerce St where it was no longer able to move. The driver of AP
vehicle fled the scene according to AO2, but was contacted a block away and identified by a witness who described what
API was wearing. AO2 told me when he contacted API, he matched the description provided. AO2 told me API was
unsteady on his fect and was slurring his speech. AO2 further stated API had the odor of intoxicants coming from his
breath. API denied operating AP vehicle but AP vehicle keys were found in his right front pants pocket and API's credit
card was found in AP vehicle. AP vehicle was registered to API's uncle. AO2 asked me to assess the sobriety of API.
T contacted AP] who was seated in the back of AO7's vehicle. AO? had initially been detained for fleeing the scene of
the accident and had been handcuffed as he was transported back to the accident scene. API was read his Miranda
‘Warning and asked if he understood his rights. API stated he did. 1 leamed from API that he did not know the road was
closed and that he did not s=c the pipe he struck because it was dark. API told me he was the operator of AP vehicle and
he did not have any passengers. As API spoke with me, I could smell a moderate odor of intoxicants coming from his
breath, he slurred his speoch and his eyes were glassy. API appeared to walk in a slow lethargic manner and was unsteady
on his feet. API told me he was not diabetic, epileptic an does not take medications for anything except allergies.
API was checked for HGN. API exhibites 2} § cles of nystagmus. API did not have vertical nystagmus. API did
have some difficulty following the instructions Tor "GH. API was then offered the OLS. API raised his right foot,
‘swayed while balancing, hopped twice and used his right arm for balance once. API counted by "Mississippi's", which
‘was not as instructed. API was then offered the Walk and Tum test. API was not able to maintain his balance during the
instruction stage. Once the test began, API used his arms for balance, missed heel to toe twice, took I] steps and did not
‘tum as directed (in a spinning motion). API returned a total of 7 steps, missed hee! to toe again and used his arms for
balance. API was asked if he thought he had too much to drink this evening and he stated he did not. Based on all of my
observations, training and experience, | believed API was intoxicated and could not operate a motor vehicle safely. API
was arrested for DWI. API was secured in my vehicle. Approximately 9.1 grams of marijuana were found in API's left
{front pants pocket. It was placed in the SAPD property room. AP vehicle was towed to Growden Pound. API was read
the Statutory Waming and asked for a breath specimen, which he agreed to provide. API kept his keys, money and cell
phone. API was taken to 401 S. Frio.
‘Upon arrival at 401 S. Frio, API was offered the breath specimen. API provided two breath specimens, both of which
‘were above the legal limit. API was booked for DWI w! BAC 0.15 or higher.
