1. SCOPE OF SPECIFICATION

1.1 General

This specification covers the general technical requirements for activities related to the
PROJECT, and shall be considered as an integral part of the WORK(S) to be performed by
the CONTRACTOR to the complete satisfaction of ADWEA/ENGINEER.

All text, dimensions, test data and results, and all other information regarding the WORK shall
be expressed in the English language and shall be in the Metric System.

1.2 Interpretation of Technical Specifications

a) The Technical Specifications and Tender Drawings shall prevail in any case of variance
between the provisions thereof and provisions given in the CONTRACTOR's proposal,
except in so far as has been expressly and specifically stated and proposed by the
CONTRACTOR to ADWEA, approved by ADWEA/ENGINEER and agreed upon
between ADWEA/ENGINEER and the CONTRACTOR in writing.

Where clarification is required or correspondence is necessary in connection with the


interpretation of Technical Specifications and Tender Drawings these shall be dealt with
by ADWEA/ENGINEER. All such correspondence in connection with the same shall be
addressed to:

Copies of correspondence shall be distributed in accordance with Table-1.

b) Any work shown on the Tender Drawings and not particularly given in the Technical
Specifications shall be included by the CONTRACTOR, and the omission of any detail of
work necessary and presumably considered as an obvious requirement for the
completion of WORK(S) and not given in the Technical Specifications and Tender
Drawings shall not relieve the CONTRACTOR from his obligations of providing the same
at no extra cost to ADWEA.

c) Should any error or inconsistency appear in the Technical Specifications and Tender
Drawings, or should the CONTRACTOR be uncertain about the WORK(S), he shall,
before proceeding with the WORK(S), inform ADWEA/ENGINEER about the same, in
writing, and after being directed, in writing by ADWEA/ENGINEER, he shall proceed with
the WORK(S).

d) The Technical Specifications and Tender Drawings are intended to describe and provide
for the required complete WORK(S) of the PROJECT. They are intended to be

presented in complementary sections altogether with documentary enclosures and what
is called for by any section shall be as binding as if called for by all sections.

1.3 Extent of Technical Specifications

a) The Technical Specifications and Tender Drawings cover the design, survey,
measurement, manufacture, supply, testing and inspection at manufacturer's works,
insurance, packing for export shipment, delivery to site, unloading, storing in proper
condition, complete erection, testing, commissioning, setting to work and maintenance of
the WORK(S), providing all labour, erector's materials, CONTRACTOR's equipment,
temporary works, planning, organisation, co-ordinating the progress of the different kinds
of works and workers and carrying out every detail of work of temporary or permanent
nature required in and for such manufacture, testing, transport and delivery to site,
erection, completion, setting to work and maintenance so far as the necessity for
providing the same is specified in or reasonably inferred from the CONTRACT.

b) The WORK(S) that shall be performed and fulfilled, to its final complete form, is
described in the Technical Specifications and Tender Drawings. It shall be clearly
understood that the WORK(S) include every necessary detail to furnish the entire works,
in a proper and effective way, notwithstanding the fact that every detail or item has not
been specifically mentioned or given in the Technical Specifications and Tender
Drawings.

2. DEFINITIONS

The following definitions are applied:

ADWEA means the Abu Dhabi Water & Electricity Authority and its successors-
in-interest and assigns as the OWNER of the WORKS.

CONTRACTOR means the designated organisation performing the construction


WORK(S) and associated procurement, engineering and design for
ADWEA.

ENGINEER means the party appointed by ADWEA to act for and on behalf of
ADWEA as designated by ADWEA.

CONTRACT means the Conditions of CONTRACT, the Specification, the Drawings,


the Schedules of Prices and Rates, the Bill of Quantities, the Tender
with Appendix, the Letter of Acceptance and the Contract Agreement
and such further documents as may be expressly incorporated in the
Letter of Acceptance or Contract Agreement.

CONTRACT PRICE means the total aggregate sum to be paid to the CONTRACTOR by
ADWEA in accordance with the provisions of the CONTRACT.

TECHNICAL means Standard Specifications, Schedules of Technical Data,

SPECIFICATIONS Technical Data Sheets, Typical Drawings, Particular Specifications or
any other technical document that specifies the WORK(S).

WORK(S) means the permanent works to be executed in accordance with the


CONTRACT and the temporary works of every kind required in or
about the execution and completion of the PROJECT and the
remedying of any defects therein.

PROJECT means the Project to which the WORK(S) apply.

SHALL is to be understood as mandatory.

SHOULD is a strong recommendation.

APPROVAL means the approval in writing by ADWEA.

3. CLIMATIC CONDITIONS

The following data is provided for guidance only and the CONTRACTOR shall be solely
responsible for any interpretation that he makes from the data provided and shall carry out at
his own cost any further investigation works he deems necessary to provide further details
and their effect on the WORK(S).

a) The following conditions are believed to prevail in Abu Dhabi City :

b) The climate of Abu Dhabi is relatively mild from November to April and hot from May to
October and with high relative humidity.

Under certain combinations of the above climatic conditions considerable condensation


will take place.

c) Particular attention should be paid to the severe prevailing corrosion conditions.


Considerable amounts of salt are contained in the atmosphere due to the extremely high
ambient humidity.

d) The distribution of rainfall is erratic. Although the annual precipitation is low, the
CONTRACTOR should be prepared for sudden thunderstorms of short duration which
may be accompanied by intense rainfall and high winds. Flooding may occur and persist
in low-lying areas.

e) Protection against dust and sand for outdoor equipment requires special attention.

4. COMPLIANCE WITH SPECIFICATION

Notwithstanding any descriptions, drawings or illustration which may have been submitted by
the CONTRACTOR, all details will be deemed to be in accordance with the Technical
Specifications and Tender Drawings referred to therein.

The CONTRACTOR shall comply fully with the above as a minimum requirement, and shall
observe the best practices for workmanship and quality control used in modern engineering
construction.

In the event of ambiguity between Technical Specifications or Tender Drawings the highest
standard shall prevail.

5. CONTRACTOR'S RESPONSIBILITIES

The CONTRACTOR will provide all items, articles, materials, operations, sundries, labour,
supervision, guarantees, allowances for overhead and profit etc., shown or implied in any of
the CONTRACT documents including equipment, tools, scaffolds, and other incidentals as
may be required.

It is to be emphasized that the Technical Specifications and Tender Drawings represent the
Basic Engineering Design only. The CONTRACTOR shall visit the site(s), check the existing
installations and verify data, arrangements, conditions, limitations, available spaces, etc. all
proposed WORK(S) on adjacent sites and in adjacent areas which might affect the WORK(S)
on this site and any other information required by him to complete the work in accordance
with PROJECT requirements.

It is the CONTRACTOR's responsibility to visit the site and take such measurements which
are necessary to prepare detail engineering for the PROJECT according to his investigations
and findings which can be implemented to form a fully acceptable operating system that
meets the specific guaranteed values as set out in CONTRACT.

The CONTRACTOR shall note that ADWEA/ENGINEER shall not be responsible for any
differences in the final design data used by the CONTRACTOR and the basic data provided
in Technical Specifications and Tender Drawings; nor shall such eventuality be used by the
CONTRACTOR to demand any variations or additional money over and above the contracted
amount.

In complying with the requirements of the Specifications both with respect to arrangement and
detail, all design is to conform to the best current engineering practice. Each of the several
parts of the plant and equipment shall be of the manufacturer's standard design provided that
such design is in general accordance with the Technical Specifications and Tender Drawings.

The essence of design is to maintain simplicity in order to give long continuous service with
high economy and low maintenance cost.

The design, dimensions and materials of all parts shall be such that they will not suffer
damage as a result of stresses under the most severe service conditions.

The material used in the construction of all plant and equipment shall be of the highest quality
and selected particularly to meet the duties required of them.

All similar parts of the plant and equipment shall be interchangeable.

All equipment shall operate without undue vibration and with the least possible amount of
noise and shall not cause nuisance.

All equipment shall be designed to minimise the risk of fire and any damage which may be
caused in the event of fire.

The equipment shall also be designed to prevent the ingress of all vermin, accidental contact
with live parts and to minimise the ingress of dust and dirt. The use of materials which may be
liable to attack by termites or other insects shall be avoided.

The CONTRACTOR is bound to adhere to the design data and design criteria as stated in the
Technical Specifications and Tender Drawings. If, during the execution of the CONTRACT,
the CONTRACTOR intends to deviate from these data and / or criteria, he is obliged to ask
ADWEA/ENGINEER for approval, and to state the reasons for the same.
ADWEA/ENGINEER are free to accept or reject such deviations proposed by the
CONTRACTOR.

All design and drawings prepared by the CONTRACTOR shall be subject to approval by
ADWEA/ENGINEER.

Not withstanding any omissions and in addition to CONTRACTOR's General Obligations, it


shall be expressly understood that the CONTRACTOR shall be responsible for:

• Supplying, installing and commissioning complete systems and related works in


accordance with CONTRACT documents to satisfy the aim of the CONTRACT.

• Carrying out the works in such a manner so as to cause minimum disruptions to existing
works and services.

• Carrying out the works to the full intent of the CONTRACT, and to the full satisfaction of
ADWEA/ENGINEER.

6. QUALIFICATION OF CONTRACTOR/SUB-CONTRACTOR

Each CONTRACTOR/SUB-CONTRACTOR shall have the technical expertise to undertake a


quality work with similar demonstrably completed projects in the United Arab Emirates.
ADWEA/ENGINEER reserve the right to inspect any or all of the CONTRACTOR/SUB-
CONTRACTOR's designated similar projects and to approve, or otherwise, on the basis of the
work so demonstrated. ADWEA/ENGINEER may request certificates of satisfaction from
owners or consultants of other projects done by CONTRACTOR/SUB-CONTRACTOR(S).

Where the CONTRACTOR intends to do all parts of the WORK(S) using his own work force
he shall so indicate at tender stage and give details of the proposed supervisors, who shall
have a recognised qualification and training in such WORK(S). Previous site experience
alone will not be considered adequate.

Unless such indications are given at tender stage, the CONTRACTOR shall subcontract the
WORK(S) to a qualified SUB-CONTRACTOR who must be submitted to ADWEA/ENGINEER
at tender stage.

The CONTRACTOR will state clearly at the time of bid any SUB-CONTRACTOR(S) proposed
and who will not be revocable by the CONTRACTOR. The CONTRACTOR is expected to
have firm bid prices from SUB-CONTRACTOR(S) prior to submitting a bid and it is his
responsibility to contractually bind prospective SUB-CONTRACTOR(S) at that time for both
price and performance.

In the event that any such SUB-CONTRACTOR is not acceptable to ADWEA/ENGINEER or


fails to meet any of the other requirements, ADWEA/ENGINEER may nominate to the

CONTRACTOR any of the other acceptable SUB-CONTRACTOR(S) who have bid the
project to other CONTRACTORS at the prices bid to those other CONTRACTORS.

ADWEA/ENGINEER is not obliged to give reasons for any acceptance or rejection of any
SUB-CONTRACTOR(S), or whether any rejection is due to past performance or to present
staff limitations or otherwise.

In the event that a SUB-CONTRACTOR is proposed by the CONTRACTOR and is not


acceptable for whatever reason but ADWEA/ENGINEER does not nominate a SUB-
CONTRACTOR, then the CONTRACTOR must propose further SUBCONTRACTOR(S) until
satisfying ADWEA/ENGINEER. The CONTRACTOR will be bound to follow this procedure
regardless of any price difference between his original SUB-CONTRACTORS bid and that of
a satisfactory SUB-CONTRACTOR.

7. STANDARDS

a) Whenever Standards are referred to in this Specification, the CONTRACTOR shall


assume such references pertain to the latest edition of the Standard.

b) All materials, equipment and construction under this CONTRACT shall be in accordance
with the latest editions of the related applicable Standards, Codes and Regulation.

c) The applicable Standards, Codes, Rules and Regulations include, but are not limited to
the following :

• Abu Dhabi Water & Electricity Authority (ADWEA) Rules and Regulations

• Abu Dhabi Transmission and Despatch Company, Metering and Data Exchange
Code

• Abu Dhabi Civil Defence Rules and Regulations

• ISO standards

• IEC standards

• BS standards

• DIN standards

• AWWA standards

• ASTM standards

• ANSI standards

• NFPA standards

• British IEE regulations

d) Alternative Standards may be considered subject to approval of ADWEA/ENGINEER.

e) In cases of technical discussions related to specific subjects, the CONTRACTOR shall


provide ADWEA/ENGINEER with two (2) copies of Codes and/or Standards which are
applicable to the PROJECT. These shall be in the English language.

f) For material and equipment manufactured under non-English Standards, the


CONTRACTOR shall provide translated copies of the said Standards if so instructed by
ADWEA/ENGINEER.

8. STANDARDIZATION AND INTERCHANGEABILITY

The CONTRACTOR shall, in his choice of materials, take into account compatibility and
interchangeability with existing installations and materials, such as pipes, fittings, parts and
spares for valves, mechanical and electrical equipments, instruments, etc.

9. GENERAL REQUIREMENTS FOR MATERIAL

The CONTRACTOR shall submit to ADWEA/ENGINEER the names of the respective


manufacturers and suppliers from whom he proposes to obtain the various goods and
materials required for the construction of the WORK(S) and, if instructed by the ENGINEER,
samples of goods and materials shall be submitted for approval at his cost.

All materials to be supplied as specified in the CONTRACT are subject to


ADWEA's/ENGINEER's approval. All the materials, supplied under the CONTRACT, shall be
new and of first class quality, free from scale, laminations, inherent corrosion and any other
defects. Materials shall be designated for the particular project. Materials not so designated
may only be accepted with ADWEA's agreement. All the materials shall be manufactured,
inspected and tested in accordance with the accepted codes and standards and shall be
capable of withstanding all stated pressures and temperatures.

Materials for inclusion in the WORK(S) are to be proposed by the CONTRACTOR and shall
be fully described on the appropriate Material Data Sheets. The CONTRACTOR shall provide
any supporting information requested. Material Data Sheets shall be submitted to the
ENGINEER and once he is satisfied then the Materials Inspection Committee appointed by
ADWEA shall consider and rule on the submissions. Once their approval has been received
the CONTRACTOR may place the appropriate orders. No material may be ordered until the
CONTRACTOR is in receipt of an approved Material Data Sheet.

Other materials, required for the WORK(S) shall be supplied as specified or their approved
equivalent subject to ADWEA's/ENGINEER's approval.

All materials shall be supplied from reputable manufacturers having ISO 9001, 9002, 9003,
BS 5750 or other approved equivalent Quality Control Certificate.

All imported materials shall be inspected at source by independent authority (to be appointed
by ADWEA) and be supplied with an appropriate inspection report. All costs for the
independent inspection authority shall be borne by ADWEA.

All inspections shall be carried out in full coordination with the requirements of Technical
Specifications and Tender Drawings and the relevant standard acceptance tests.

Test certificates shall be submitted with the shipping documents.

All materials shall be stored so that :

• No deleterious effect from the prevailing weather is observed.

• No material is in contact with natural ground.

• No moisture, either from the air or the ground, shall affect sensitive items.

• No possibility of loss occurs.

When the materials arrive at site, the ENGINEER shall make arrangements to conduct an
initial inspection of the material and prepare a preliminary report, a copy of which shall be
given to the Material Inspection Committee (M.I.C) appointed by ADWEA.

The ENGINEER shall thereafter invite the Material Inspection Committee (M.I.C) to participate
in the final inspection of the material.

In the event of differences, the findings of the Material Inspection Committee (M.I.C) shall
rule.

Locally supplied materials shall be inspected at site. The CONTRACTOR is to provide proof
of source (invoice, etc.)

Whenever it is requested by ADWEA/ENGINEER, the CONTRACTOR shall provide at his


own expense any instrument/equipment required for checking materials compliance with
specifications (for example paint thickness measuring device, etc.). All such
instrument/equipment provided by CONTRACTOR shall be to the approval of
ADWEA/ENGINEER.

Goods and materials rejected by ADWEA/ENGINEER shall be removed from the site at
CONTRACTOR's expenses.

Certificates presented for approval shall be valid at the time of submission.

All components of paint, coating or lining system applied on material for storage and
conveyance which come in contact with potable water shall be subject to the conditions and
requirements as directed by ADWEA in Administrative Circular No. 5 of 2000.

The CONTRACTOR shall make the appropriate arrangements so that the necessary
materials are supplied quickly so that the WORK(S) may be carried out expeditiously and
satisfactorily. He shall receive approvals as described above before placing orders and shall
conform with the requirements of ADWEA/ENGINEER. He shall carry out such repairs as
required by the M.I.C. before installation.

In some circumstances when the CONTRACTOR may be permitted to borrow materials from
ADWEA Stores he shall take the appropriate steps to ensure that any material borrowed shall
be made equivalent to new material before it is placed in the WORK(S). If any material is
borrowed it shall be replaced, in first class condition, at the earliest opportunity.

If the CONTRACTOR wishes to transfer material from one project to another he shall obtain
the approval of ADWEA for carrying out such transfer.

If the CONTRACTOR desires to propose a method or to use material or equipment other than
specifically described in the Technical Specifications and Tender Drawings he shall in all
cases submit the same for consideration to ADWEA/ENGINEER and he shall not make the
substitution unless approved by ADWEA/ENGINEER in writing. If requested by
ADWEA/ENGINEER, the CONTRACTOR shall give details of the relevant costs for the
substitute items. If the substitute offered is not approved by ADWEA/ENGINEER, the
CONTRACTOR is bound to furnish the component under consideration in keeping with the
Technical Specifications and Tender Drawings.

10. PROCUREMENT AND EXPEDITING

The CONTRACTOR shall prepare the requisitions for the various equipments and materials
based on his approved detail designs.

The requisitions shall be subject to the approval of ADWEA/ENGINEER.

Before placing any order the CONTRACTOR shall submit his intended purchase order(s) for
ADWEA/ENGINEER approval. Such purchase orders shall be based on the approved
requisitions only.

The CONTRACTOR shall carry out his expediting for the procurement of equipments and
materials and shall submit weekly expediting progress reports.

11. MANUFACTURING PROGRESS INFORMATION

a) The CONTRACTOR shall supply within one (1) month after the CONTRACT start date, a
detailed progress schedule covering - as far as applicable at this time - all pertinent data
and key dates for all materials and fabricated parts and components pertaining to the
WORK(S). Such data shall include:

• Description of material.

• Date of order and copy of order.

• Suppliers or Manufacturers name and address.

• Schedule of design and submission of drawings for approval, where applicable.

• Schedule of manufacture and fabrication.

• Schedule of inspections by ADWEA/ENGINEER and/or TPI.

• Schedule dates of ex-works delivery, shipping and arrival.

• Final date delivery ex-works.

• Port of embarkation, estimated time of departure. mode of transport, name of the


vessel, estimated time of arrival.

The schedule shall be brought up to date every month and shall form the basis for the
follow-up and inspections to be performed by ADWEA/ENGINEER.

b) The inspections carried out by ADWEA/ENGINEER shall not release the CONTRACTOR
from any of his obligations under this CONTRACT.

c) Local travelling expenses incurred by ADWEA and/or the ENGINEER in connection with
co-ordination meetings, checking of progress of work, expediting of work, necessary
routine visits etc. to the CONTRACTOR's/ Sub-CONTRACTOR's Offices and/or
premises shall be borne by the CONTRACTOR and shall be included in the CONTRACT
PRICE.

12. PACKING AND SHIPPING

12.1 General

All materials shall be packed to ensure that damage does not occur during shipping and
transportation to site.

All packing materials shall therefore be of first class quality and no second-hand materials
shall be used.

Care shall be taken that sensitive items are properly protected from the effects of handling,
humidity, ultra violet radiation and salt concentrations.

Materials shall be so packed that each package can be handled easily.

12.2 Packing Guidelines

Pipes may be bundled so that bundles do not exceed 3 tonnes in weight. Care shall be taken
during handling to avoid damage.

Gate valves or butterfly valves greater than 500 mm diameter shall be individually packed.
Two valves may have the packing joined, provided the combined weight does not exceed 3
tonnes.

Gate valves (up to 300 mm diameter) may be placed together provided that the packages do
not exceed 4 tonnes in weight and individual valves are prevented from moving within the
package.

Air valves and hydrants may be packaged in a similar manner to gate valves.

Flanged pipes are to have their open ends protected by adhesive tape or jointing and are then
to be covered with a wooden blank flange secured by service bolts.

The sleeves and flanges of flexible couplings shall be bundled by wire ties. Cases containing
rubber rings, bolts and other small items shall not normally weigh more than 500 Kg gross.

Lids and internal cross battens of all packing cases are to be fixed by screws and not nails.

Hoop metal bindings of cases are to be sealed where ends meet and if not of rustproof
material are to be painted.

Contents of cases are to be bolted securely or fastened in position with struts or cross battens
and not with wood chocks, unless they are fastened firmly in place. All struts or cross battens
are preferably to be supported by cleats fixed to the case above and below to form ledges on
which the batten may rest. Cases are to be up-ended after packing to prove that there is no
movement of contents.

Where parts are required to be bolted to the sides of the case, larger washers are to be used
to distribute the pressure and the timber is to be strengthened by means of a pad.

All stencil marks on the outside of the casings are to be either of a waterproof material or
protected by Shellac or varnish to prevent obliteration in transit.

Woodwool is to be avoided as far as possible.

Waterproof paper and felt linings are to overlap at seams at least 12 mm and the seams
secured together in an approved manner, but the enclosure is to be provided with screened
openings to obtain ventilation.

Each crate or package is to contain a packing list in a waterproof envelope and copies in
duplicate are to be forwarded to the Engineer on Site, prior to despatch. All items of material
are to be clearly marked for ready identification against the packing list.

All cases, packages, etc. are to be clearly marked on the outside with lettering not less than
20 cm high to indicate the total weight, to show where the weight is bearing and to indicate
the correct positions for slings, and are to bear an indelible identification mark relating them to
the appropriate shipping documents.

All boxes, bundles or other packaging shall be clearly marked with the following information :

12.3 Transport and Shipping

i) Shipping Documents

a) The CONTRACTOR shall submit complete shipping documents as soon as possible


after shipping, in order to reach ADWEA and ENGINEER before the arrival of the
ship. Responsibility for delays, loss or damages of shipping documents shall rest
with the CONTRACTOR.

ADWEA/ TPIA

One set of complete shipping documents including, the second original BILL OF LADING
shall be airmailed directly to ADWEA within seven days of the departure of the ship.

ii) Transport to Port of Embarkation, Loading and Unloading

The CONTRACTOR shall arrange and provide for the transport of material, equipment
and plant components from the manufacturer's works to the port of embarkation. The
CONTRACTOR shall assign special personnel to supervise the transport, loading and
unloading of material, equipment and plant components. They shall take all skill and care
in the performance of transport, loading and unloading.

Overseas Transport

a) When carrying out overseas transport either by sea or by air the special provisions
of the Boycott of Israel laws and regulations shall be taken into consideration and
adhered to scrupulously.

b) The CONTRACTOR shall be responsible for the selection of the overseas transport
as well as for the whole transport period. The transport shall be carried out at his
own risk. Where possible when transporting goods by sea, preference shall be
given to using ships of the United Arab Shipping Company provided their rates are
comparable with those of other shipping companies, and subject to available cargo
capacity meeting CONTRACT requirements.

c) Should a work, or any part thereof, the manufacture and/or supply of any material,
equipment or plant component, as well as any equipment or tool required for the

WORK(S) be delayed with respect to the relevant time schedules, the
CONTRACTOR shall transport the part or component delayed by air at no extra
cost to ADWEA.

d) All freight consignments shall be delivered to the sea port - MINA ZAYED, Abu
Dhabi.

Local Transport

a) The CONTRACTOR shall arrange and carry out under his own responsibility and
supervision the local transport from the port of Abu Dhabi to ADWEA stores and/or
different storage sites as directed by the ENGINEER.

b) The CONTRACTOR shall, at his own convenience, gather all necessary information
and arrange for all necessary provisions in order to obtain accurate information
about unloading at Abu Dhabi port and inland transport facilities as well as all
prevailing conditions, particularly the safe load bearing capacity of highways and
bridges. The CONTRACTOR shall bear every and all expenses related herewith.

c) The CONTRACTOR shall use every reasonable means and care to prevent any of
the highways or bridges on the route to Site from being damaged or injured by any
traffic of the CONTRACTOR or any of his SUB-CONTRACTOR(S) and in particular
select, choose and use vehicles and restrict and distribute loads so that any such
extraordinary traffic that will inevitably arise from moving of CONTRACTOR's
equipment and material from and to the Site shall be limited as far as reasonably
possible so that no damage or injury may be occasioned to such highways and
bridges.

If during the carrying out of the work or at any time thereafter the CONTRACTOR
receives any claim arising out of the execution of the WORK(S) in respect of
damage or injury to the highways or bridges, he shall immediately report the same
to ADWEA/ENGINEER and thereafter he shall make the settlement of any payment
of all sums due in respect of such claim and in respect of all claims, demands,
proceedings, damages, costs, charges and expenses in relation thereto without any
obligation to ADWEA/ENGINEER.

d) If the CONTRACTOR carries out any transport from the island of Abu Dhabi to the
mainland or vice versa, he shall take into consideration the load capacity and
clearance of the bridges that link the island with the mainland.

e) The CONTRACTOR shall use every reasonable means and care to prevent any of
the shores, jetties and sea structures from being damaged or injured by vessels
loading and unloading equipment of the CONTRACTOR or any of his SUB-
CONTRACTOR(S).

If during the carrying out of the work or at any time thereafter, the CONTRACTOR
receives any claim arising out of the execution of WORK(S) in respect of damage or
injury to shores, jetties or sea structures, he shall immediately notify
ADWEA/ENGINEER and thereafter he shall, settle payment of all sums due in

respect of such claim, and in respect of all claims, demands, proceedings,
damages, costs, charges and expenses in relation thereto without any obligation to
ADWEA/ENGINEER.

f) The unloading and storage at Site shall be carried out by the CONTRACTOR, who
for these purposes shall make all necessary provisions and arrange for all
necessary equipment.

12.4 Receiving-Cum-Damage Reports

a) The CONTRACTOR shall submit Receiving-cum-Damage Reports to


ADWEA/ENIGNEER to cover each individual shipment received and checked at the job
site.

After unloading the CONTRACTOR will check the consignment and submit Receiving-
cum-Damage Report (RCDR) to ADWEA/ENGINEER in accordance with Table-1 of
General Technical Requirements. On receipt of RCDR from the CONTRACTOR, the
ENGINEER will carry a joint inspection of the consignment along with the
CONTRACTOR and submit the RCDR along with his comments to ADWEA for their
review/approval. Finally the CONTRACTOR/ENGINEER/ADWEA/ will carry out a joint
inspection of the consignment and the action will be taken by CONTRACTOR to rectify
any damages or replace any part of equipment, as per observation of
ADWEA/ENGINEER.

If any damage occurred in transit the CONTRCTOR shall immediately submit a damage
report, countersigned by ADWEA, to the Insurance Company with copies to ADWEA.
Where damage has occurred in Marine Transportation, a copy of the damage report
shall be also sent to the registered / appointed surveyor.

b) In all cases of irrepairable damages, the CONTRACTOR shall immediately notify the
relevant manufacturer(s). He shall also immediately notify ADWEA of the actions he will
be initiating and undertaking in order to repair or replace the damaged part(s) and of the
consequences this damage will have on the completion date of the Works.

c) ADWEA shall reject material and equipment for which no Acceptance Certificate can be
provided and is not in compliance with the Specifications. The signature of ADWEA does
not release the CONTRACTOR from his responsibilities of the CONTRACT.

12.5 Materials Reconciliation

During the course of the CONTRACT, the CONTRACTOR shall maintain detailed records of
all materials that are received (from whatever source), installed, exhumed, refurbished,
disposed and issued to other parties (as instructed) such that, at the completion of the
WORK(S), an accurate assessment of the materials remaining as surplus-to-requirements
may be presented in the form of a Materials Reconciliation Statement. This statement shall
be submitted to the ENGINEER for approval and shall form the basis of the ADWEA
acceptance of any surplus materials into their Stores. Acceptance of any surplus materials
into store shall be at the ADWEA's discretion.

12.6 Title to the Plant

Title to the Plant shall pass to ADWEA upon delivery ex-factory, but the CONTRACTOR shall
maintain total and exclusive care, custody, and control including all risk of loss until
Provisional Acceptance by ADWEA.

13. CONSTRUCTION CONDITIONS

The CONTRACTOR is strongly recommended to visit and thoroughly acquaint himself with
the nature of the site location, pipeline routes, etc. and to take the site and ground conditions,
type of soil, etc. into full account in preparing his offer.

The site locations, pipeline routes, etc. may occupy or cross areas which are low lying
Sabkha areas with high water table and prone to flooding and ponding or undulating sandy
areas and rock areas with a well weathered surface and relatively low water table. They may
also encounter existing services, such as electric or telephone cables, gas, water, sewer
pipes, etc. The CONTRACTOR shall arrange to expose, support and protect the cables or
services that he encountered or overcome the obstacles encountered by deeper excavation,
any temporary supporting necessary, complete relocation or any other means which he may
deem fit and which are approved by ADWEA/ENGINEER.

CONTRACTOR'S rates shall include all costs involved due to any type of site conditions
mentioned above.

The phasing of the WORK(S) may require interference with operating plant and services. This
shall be co-ordinated with ADWEA and the ENGINEER and various government departments
well in advance so that arrangements can be made for progressing the WORK(S)
accordingly.

Every effort will be made by ADWEA to assist the CONTRACTOR in progressing with
WORK(S).

A site investigation for the site pipeline route, etc. may be instructed by the ENGINEER and
provisional items may be included in the Bill of Quantities for such works.

14. SURVEY POINTS

A network of coordinated permanent ground markers PGM's exist throughout the Emirate and
in the vicinity of the project works. The coordinates of the survey points are UTM based on
Clark 1880 (Mod) Spheroid Zone 40 and levels are based on the New Abu Dhabi Datum
(NADD).

Survey points designated as "Existing PGM's" are those establish by Government Authorities.
Survey points designated as "New PGM's" have been established by the ENGINEER.

ADWEA/ENGINEER shall not be liable for the effects of errors in the coordinates or levels
attributable to any individual, or the physical status of survey points at the time of
construction.

15. INSTALLATION AND CONSTRUCTION

All construction activities shall be carried out in accordance with the specified procedures
ensuring that the completed systems shall be capable of withstanding satisfactorily all
resultant forces such as these exerted by normal pressures, hydrostatic test pressures and
any surge pressures which may arise from sudden reversal of flow during starting up or
shutting down of any portion of the system or the pumping station.

All pipelines shall be installed and erected along the routing shown on the pipeline alignment
drawings except where unforeseen obstacles along this routing are encountered and
alternative route as approved by the ENGINEER shall be followed.

The CONTRACTOR shall observe that the installation of pipeworks shall be completed prior
to commencing construction of any base courses, pavement, curbs or related works. Further,
the installation of the pipework shall be in such a sequence as not to interfere with or interrupt
other activities under this or other contracts awarded by ADWEA

The CONTRACTOR shall ensure that the installation of all materials and equipment are
carried out according to the recommendations of the manufacturers and in compliance with
the CONTRACT.

The CONTRACTOR shall carry out the installation and construction work by workmen skilled
in the type of work being accomplished. All installation and construction personnel shall be
subject to the approval of ADWEA/ENGINEER.

Before any installation or construction activity, the CONTRACTOR shall submit procedures or
method statements for carrying out the work. These procedures and method statements shall
be subject to the approval of ADWEA/ENGINEER.

Co-ordination procedures for activities to minimize the shutdown of existing systems shall be
prepared by the CONTRACTOR and submitted to ADWEA/ENGINEER for approval.

The CONTRACTOR shall give notice to ADWEA/ENGINEER for inspection of the constructed
work and shall notify ADWEA/ENGINEER of work progress on daily basis.

Where the work is to be erected and commissioned in stages, the CONTRACTOR shall
include for the supply and erection of blank flanges and all extra work involved with this
required sequence of installation.

All items of work specified in Technical Specifications and Tender Drawings shall be carried
out by the CONTRACTOR and shall be taken as part of the Scope of Work. Where the cost
of any work item is not specifically mentioned in the Bills of Quantities it shall be taken as to
be covered by the unit rates or prices of other items.

16. SEQUENCE OF WORK AND SHUT DOWNS

Having fully understood the prevailing conditions and the shutdowns that may be required, the
CONTRACTOR, before commencement of any work, shall submit to ADWEA/ ENGINEER for

approval a fully comprehensive procedure detailing the sequence of work which he intends to
follow.

The CONTRACTOR shall prepare his planning of work well in advance and in coordination
with ADWEA/ENGINEER and in such a manner so as to minimise disruption and shutdown
time.

17. PLANNING AND COMPLETION OF THE WORK(S)

17.1 Planning Schedule

The CONTRACTOR shall prepare his planning schedules in accordance with the
specifications.

17.2 Commencement of the Work(s)

a) Before the CONTRACTOR starts any activity related to construction he shall inform all
parties concerned of his intentions.

b) Notwithstanding the CONTRACTOR's obligations to submit Notices of Intent, the


CONTRACTOR shall, before starting any work (material handling, surveying, temporary
or permanent works etc.) inform the ENGINEER at least one week in advance through a
site memorandum giving the following information:

• Area of the work.

• Short description of the work.

• Drawing numbers comprising the intended works mentioning the latest revision and
approval status.

• Starting date.

• Site Engineer, Foreman supervising the work.

• Estimated number of machines and labour involved.

c) The CONTRACTOR shall only execute permanent works based on drawings stamped
"APPROVED" or "APPROVED EXCEPT AS NOTED".

d) It shall be the CONTRACTOR's sole responsibility to ensure that all the necessary
information is duly recorded and certified by the ENGINEER, prior to the commencement
of any work which, for the purpose of any payment, may require compliance with the
above mentioned procedure.

17.3 Survey of the Work(s)

a) The CONTRACTOR shall carry out all survey work required for the project and shall
provide efficient staff and all necessary tools, instruments and appliances for an accurate
survey of the WORK(S). The result of the survey work carried out shall be included in

the CONTRACTOR's construction drawings, showing, as applicable, existing and future
ground levels, levels of nearby roads, embankments over the pipe, fill under the pipe,
valves, fittings and special pipeline appurtenances, existing services which are close to
or crossing the project site and pipeline route, obstructions and any other relevant
information.

Cross-sections shall be taken over the PROJECT site or areas of the site if instructed by
the ENGINEER, also, where indicated by the ENGINEER the CONTRACTOR shall
provide cross sections along the pipeline route.

The CONTRACTOR shall submit all completed survey drawings to the ENGINEER for
approval.

The CONTRACTOR shall also provide and fix and be responsible for the maintenance of
existing survey marks, boundary marks, distance marks and centre line marks and take
all necessary precautions to prevent them from being removed or disturbed and shall be
responsible for the consequences arising from such removal or disturbance which may
take place in which case the CONTRACTOR shall be responsible, for their
reinstatement.

The survey of the work shall be carried out prior to finalizing the quantities of materials to
be ordered and to commencement of any field works.

b) The CONTRACTOR shall provide for the duration of the CONTRACT a complete range
of pipeline route and area survey equipment including but not limited to theodolites,
levelling instruments, measuring staffs, tripods, binoculars etc. all in accordance with the
specifications.

These equipments shall be made available on request for usage by ADWEA and
ENGINEER.

c) All costs and expenses in connection with the site investigation and surveying of the
works for both record, location, routing and measurement purposes and for the provi-
sion of equipment, support and transport for ADWEA and the ENGINEER, all as
specified in these documents, shall be borne by the CONTRACTOR and included in the
CONTRACT PRICE as part of the local expenses.

17.4 Movement of Machinery and Manpower

In addition to the approved programme of work when a section of work is completed the
CONTRACTOR shall obtain approval from ADWEA/ENGINEER to move his manpower,
machinery and materials from the PROJECT sites.

17.5 Preliminary and Functional Tests at Site

a) Upon completion of the construction and installation of all PROJECT's components etc.,
the CONTRACTOR shall perform preliminary and functional tests as deemed necessary,
in order to check whether the installations are ready for commercial operation.

b) Test Procedure(s) shall be submitted by the CONTRACTOR to ADWEA/ENGINEER for
approval before preliminary and functional test is undertaken at site.

17.6 Trial Operation

a) After having finished all preliminary and functional tests at SITE, and as early as possible
before commissioning of the completed works successfully, the CONTRACTOR shall
notify ADWEA/ENGINEER in writing two weeks in advance that all construction work is
complete, and the system is ready for Trial Operation.

b) Method Statement shall be submitted by the CONTRATOR to ADWEA/ENGINEER for


approval before proceeding with Trial Operation.

c) The start of Trial Operation shall mutually be agreed upon between the CONTRACTOR
and ADWEA/ENGINEER. The period of trial operation shall be seven (7) days or more
as advised by ADWEA/ENGINEER. During the Trial Operation period the
CONTRACTOR shall operate the complete system under all possible operating
conditions with all procedures for start up and shutdown performed, specified flow and
pressure conditions achieved, protection and interlocks demonstrated all according to
the approved procedures.

d) The CONTRACTOR shall prepare a report to record all pertinent information and results
on the Trial Operation.

17.7 Initial Operation

a) Directly upon successful completion of Trial Operation, the CONTRACTOR shall start
the Initial Operation of the complete system for a period of fourteen (14) days. During
this period the system shall be set to operate in continuous (uninterrupted) normal mode
of operation for the fourteen (14) days. If the operation has to be interrupted due to
reasons for which the CONTRACTOR is responsible (unauthorized interruptions), then
the fourteen (14) days initial operation shall be restarted from the very beginning, after
the cause of the interrup-tion has been removed by the CONTRACTOR.

If this interruption is due to reason outside the CONTRACTOR's responsibility


(authorised interruptions) then the count will carry on from the number of days already
completed.

b) The CONTRACTOR shall prepare a report to record all pertinent information and
operation log sheets for the Initial Operation.

17.8 Provisional Acceptance and Taking-Over (Commissioning)

On satisfactory completion of the Initial Operation and thus the system being ready for
Commercial Operation, the CONTRACTOR will request ADWEA/ENGINEER to issue the
Provisional Acceptance Certificate to the CONTRACTOR. ADWEA/ENGINEER shall proceed
for inspection of WORK(S). On the successful completion of inspections to the satisfaction of
ADWEA/ENGINEER, Provisional Acceptance Certificate will be issued. At the same date, all
the installation shall be handed over to ADWEA.

17.9 Final Taking-Over

On satisfactory completion of the Guarantee Period, inspection for the Final Acceptance will
be carried out by ADWEA/ENGINEER. ADWEA will issue Final Acceptance Certificate in
case they are satisfied with results of this inspection.

17.10 Instruments, Measuring Equipments, etc.

The CONTRACTOR shall provide calibrated instruments, measuring equipment and devices
required and shall arrange for all measures related to the performance of all the tests.

All tests shall be conducted in accordance with the standards and regulations stipulated in the
CONTRACT or mutually agreed upon.

17.11 Guarantee

The CONTRACTOR shall guarantee that all equipment and materials furnished will be free
from any inherent defects in design, workmanship and material and that they will function in a
proper and continuous manner under the operating and design conditions specified, for a
period of 12 calendar months, continuous day and night service, reckoned from the day on
which the WORK(S) or section of WORK(S) were commissioned and provisionally accepted.

Costs of all repair or replacement including freight charges to any of the erected and
commissioned installations, prior to the date of handing over to ADWEA for commercial
operation, shall be to the account of the CONTRACTOR. After handing over, in the event of
failure covered by the CONTRACTOR's guarantee, ADWEA shall notify the CONTRACTOR
thereof and without delay the CONTRACTOR will have the choice of :

a) having the material returned to his equipment manufacture or material source for repair,
or

b) effecting the repair at the place where the material is then located.

In the event of choice (a), then freight cost from site to the CONTRACTOR's works,
including repair costs, will be borne by the CONTRACTOR who shall supply or replace
the material.

Repairs may be effected by ADWEA without prior consent by the CONTRACTOR in cases
where it would be unreasonable to demand that prior consent be obtained. All costs related
to such repairs shall be to the CONTRACTOR's account.

18. APPROVAL PROCEDURE

18.1 General

All specifications, requisitions for equipment/material, drawings, reports, calculations, data


sheets, procedures etc. are subject to ADWEA/ENGINEER approval. Comments or approval
shall be normally given by ADWEA/ENGINEER within twenty one (21) days of receipt of such
documents. Any procurement, manufacturing or construction carried out prior to such

approval will be at the CONTRACTOR's own risk and expense. If ADWEA/ENGINEER fails to
approve or comment on the calculations, requisitions, drawings or documents submitted by
the CONTRACTOR within a reasonable period, the CONTRACTOR may after advising
ADWEA/ENGINEER in writing proceed with the procurement, manufacturing or construction
of the WORK(S).

The CONTRACTOR shall be responsible for any discrepancies, errors or omissions in the
documents supplied by him, whether such documents have been approved or not.

The CONTRACTOR shall be deemed to have examined all Technical Specifications and
Tender Drawings forming part of the CONTRACT and shall advise ADWEA/ENGINEER of
any discrepancies thereon which may affect him in properly performing the works which he is
responsible to under the CONTRACT. Any failure of the CONTRACTOR to do so shall be
deemed to be a waiver of any right to claim additional cost resulting from such discrepancies
on the documents forming part of the CONTRACT.

Each document for which no approval is required shall be clearly marked "For Information
Only" in a visible place.

Modified drawings shall bear a revision letter and the nature of the modifications shall be
clearly stated.

The CONTRACTOR shall propose a document numbering system and a drawing schedule
which will be subject to approval by ADWEA/ENGINEER.

At monthly intervals, the CONTRACTOR shall submit copies of the drawing schedule showing
the actual status i.e. preliminary, completed, modified and approved.

18.2 Dispatch of Documents (Table 1)

Documents shall be distributed to ADWEA and ENGINEER in accordance with TABLE-1 of


this specification.

When submitting documents for approval, or for information only, the CONTRACTOR is
obliged to indicate plainly and unmistakably any deviation from the contract documents, to
explain the reason for such deviation and to ask ADWEA and the ENGINEER explicitly for
approval.

Failure to do so does not release the CONTRACTOR from his obligation in accordance with
the contract documents even if the documents submitted by the CONTRACTOR were
approved by ADWEA/ENGINEER.

18.3 Approval of Documents

Within the period mentioned in this document the ENGINEER will inform the CONTRACTOR
by returning one copy marked with one of the following categories :

1) "APPROVED"

2) "APPROVED EXCEPT AS NOTED"

3) "NOT APPROVED".

The notation "APPROVED" authorizes the CONTRACTOR to proceed with the fabrication or
construction.

The notation "APPROVED EXCEPT AS NOTED" authorizes the CONTRACTOR to proceed
with the fabrication or construction subject to the corrections noted on the document. After
correction, the document must be resubmitted for approval.

The notation "NOT APPROVED" indicates that the document must be revised and
resubmitted for approval before proceeding with the manufacture or construction.

18.4 Dispatch of Approved Documents

When the CONTRACTOR receives the advice that a document is approved by


ADWEA/ENGINEER, he shall immediately enter the mark "APPROVED" in the original,
together with revision index and date when the document was approved by
ADWEA/ENGINEER and distribute copies to ADWEA and the ENGINEER in accordance with
TABLE-1 of this Specification.

19. TEMPORARY WORKS

19.1 Dewatering of the Works

The CONTRACTOR shall at all times during construction maintain the whole of the WORK(S)
in a dry condition free from water. The CONTRACT PRICE is deemed to include the cost for
all pumping, dewatering and necessary disposal of waste water, and also for the restoration
of the area after completion.

ADWEA/ENGINEER may direct that a particular method for dewatering be used, and the
CONTRACTOR shall carry out this work as directed with no additional cost to ADWEA. This
has special significance during concrete placing and curing.

19.2 Discharge of Waste Water

The CONTRACTOR shall provide all facilities for, and include in his rates, the removal and
drainage of water associated with WORK(S) to the satisfaction of ADWEA/ENGINEER.

Drained water shall be discharged to the location and in the manner as directed by ADWEA/
ENGINEER.

Discharge of water into the sewer system or in open areas is strictly forbidden unless
specifically authorized.

The CONTRACTOR shall hold ADWEA indemnified against any claims that may arise
through the discharge of any water. Prior to the commencement of any testing, flushing or
disinfection of the pipeline, the CONTRACTOR shall submit to the ENGINEER, for approval,
his proposed method for discharging the water used for testing, flushing and disinfection.

20. EXISTING SERVICES AND NOTICES OF INTENT

The CONTRACTOR shall be responsible for contacting the various Government Authorities
or other related parties by the recognized Notice of Intent procedure or otherwise as

necessary to ascertain the positions of any services likely to be encountered, such as electric
cables, telephone cables, water pipes, gas or oil mains, sewer pipes and septic tanks.

No claim for additional costs or extension of time will be allowed due to delays in obtaining
"No Objection" or permission to work from the various authorities.

The attention of the CONTRACTOR is drawn to the Laws of Abu Dhabi and to Penalty Laws
No. 10 of 1976, No. 12 of 1978 and No. 4 of 1980 in particular concerning damaging or
disruption of services, and any charges and penalties which may be imposed upon the
CONTRACTOR for each occurrence.

The CONTRACTOR must arrange to expose, support and protect the services met with and
he shall take all necessary measures, as approved by the ENGINEER, or relevant authorities,
to overcome any obstacles in the direct route of the proposed pipeline installation.

The CONTRACTOR's attention is drawn to the special safety/security precautions to be


observed when crossing oil or gas pipelines. Applications to the relevant Authority shall be
accompanied by a full method statement and normally no machine excavation is permitted
within 10 metres of the pipeline to be crossed. Clearance from the Oilfield Security Police is
also required and a work permit required when working within 50 metres of the oil/gas
pipelines. Safety officers from these authorities may be present during the crossing
operations to ensure the works are performed to the standard required.

When work is scheduled to cross known locations of high voltage cables, indicated from As-
Built drawings and/or replies to Notices of Intent, no actual excavations shall be started
without the presence of a representative electrical engineer from Abu Dhabi Transmission &
Despatch Co. or Abu Dhabi Distribution Co. who shall give relevant directions with respect to
electrical cables and who shall give written permission to proceed. The CONTRACTOR shall
make all arrangements for the above mentioned requirements in due time to avoid
unnecessary delays.

The same procedure shall apply to any other major services crossed in the course of the
WORK(S) such that the Authorities concerned have the opportunity to advise on the safest
method of crossing their service lines without damage.

Except as detailed below the CONTRACTOR shall be responsible for maintaining all
watercourses, sewers, drains, gas mains, oil pipelines, water mains, electricity and
telecommunication cables and all other services, structures, trees and plants encountered
during the construction of the WORK(S) and for any remedial measures necessary to make
good any damage caused thereto during the construction of the WORK(S) all at his own
expense. Such operations shall be executed either by the CONTRACTOR or by the workmen
of the Authority concerned as may be directed by that Authority and all such operations shall
be performed to the satisfaction of the ENGINEER and the appropriate Authority. The
CONTRACTOR shall to the satisfaction of the ENGINEER and the appropriate Authority
temporarily support or divert and subsequently reinstate all such services and structures as
herein specified or such operations shall be carried out by the Authority at the
CONTRACTOR's expense if the Authority should so elect. Where services have to be
temporarily supported or diverted and subsequently reinstated and the appropriate Authority

decides to execute such works by the agency or its own employees reasonable charges
incurred in performing such work shall be borne by the CONTRATOR. In all cases where the
WORK(S) cross under or over existing services the CONTRACTOR shall include for all
necessary costs of such crossings in his rates included in the CONTRACT.

Safety shall always be maintained in all work in the vicinity of existing services and all costs
involved including particular requirements of the Authority concerned or the ENGINEER shall
be included by the CONTRACTOR in his CONTRACT PRICE.

Where existing services require permanent support as the unavoidable results of the
construction of the WORK(S) in accordance with the CONTRACT the cost of providing such
permanent support as the ENGINEER may direct shall be deemed to be included in his rates
included in the CONTRACT.

Where existing services have to be permanently diverted as the unavoidable results of the
construction of the WORK(S) in accordance with the CONTRACT, such diversions shall be
carried out either by the CONTRACTOR or the workmen of the appropriate Authority as the
ENGINEER shall direct.

The CONTRACTOR shall carry out such trial excavation by hand as may be regarded by the
ENGINEER as necessary before any bulk excavation or trench excavation is commenced in
order to determine the precise locations of any existing services which may impede the
WORK(S). Any such trial excavation shall be deemed to be included in the rate included in
the CONTRACT.

Where overhead electricity or telecommunication pylons, posts or cables lie directly over or
immediately adjacent to the line of any WORK(S) and where in the opinion of the ENGINEER
such pylons, posts or cables have to be temporarily or permanently supported or diverted in
order to execute the WORK(S) in accordance with the CONTRACT, the provision of
execution of such support, diversion or reinstatement will be deemed to be included in the
rates included in the CONTRACT.

21. INTERFERENCE WITH OTHER UTILITIES

The CONTRACTOR may be required to work in the vicinity of high voltage and
telecommunications cables sewer and water lines in certain locations. These locations are to
be ascertained and confirmed on site with the appropriate Authorities. Work in these areas
will not be permitted with mechanical excavation plant.

22. APPROVALS FROM OTHER DEPARTMENTS AND AUTHORITIES

Before issuing of the Provisional Acceptance Certificate (PAC) the CONTRACTOR shall
obtain approvals of the installations from each of the concerned Departments (e.g. telephone,
sewerage, civil defence, drainage, etc.).

23. OTHER DEPARTMENTS AND UTILITY COMPANIES SPECIFICATIONS

Notwithstanding the requirements of Technical Specifications and Tender Drawings the


CONTRACTOR shall comply with all the additional requirements which are included in the

Specifications of all the concerned Departments and Utilities Companies (e.g. Drainage,
Sewerage, Telephone, etc.) in use at the time of construction. The CONTRACTOR shall
include in his rates all the extra costs, if any, to comply with the above requirements and shall
have no right to any claim related to the above.

24. OTHER CONTRACTORS

CONTRACTORS constructing other utilities will be working in the vicinity of the WORK(S)
during the course of this CONTRACT and the CONTRACTOR must allow for this including all
required rescheduling of works, special construction methods, special measures, etc. and for
co-ordinating work as necessary to cause minimum disruption.

25. OBSTRUCTION TO WORK(S)

The CONTRACTOR shall have visited the site at tender stage and shall have been therefore
aware of any obstruction which will affect its works while preparing the offer. The
CONTRACTOR shall be responsible for obtaining all the required approvals from the
concerned Departments for the removal/replacement of the obstructions. In consideration of
the above the CONTRACTOR shall reschedule his programme of works and
equipment/labour deployment in order to cope with the obstruction he may encounter and
shall not be entitled for any claim for idle equipment and labours due to the lack of front of
work caused by obstructions or works by other CONTRACTORS, which affect the available
work front.

26. REMOVAL OF TREES

Agriculture Section of Abu Dhabi Municipality and Agriculture or Forestry Section of Al Ain
Municipality and Private Department of H.H. The President are the only Authorities which
shall provide authorisation to remove existing Trees and Plantation. If any tree or plantation
is obstructing the works, the CONTRACTOR shall contact the competent Authority and do all
the required co-ordination activities for their necessary decision and action.

Notwithstanding the above, it shall be noted that the above authorities normally provide only a
verbal authorisation to remove the trees, therefore if a written authorisation can not be
obtained within a reasonable time the CONTRACTOR shall proceed on the basis of the
verbal authorisation. The CONTRACTOR shall not be entitled to any extension of time or
claim for idle equipment due to its inability to do the necessary co-ordination works to obtain
the approval to remove the trees.

Removal and disposing off or replanting of trees, bushes and similar which have a main trunk
with a diameter of less than 100 mm shall not be measured and paid but shall be deemed to
be included in the excavation and backfill rates. Payment will be done only for the removal
and disposing off or removal and replanting of trees within a main trunk diameter equal to or
greater than 100 mm.

27. SUPERINTENDENCE

The CONTRACTOR shall provide all necessary superintendence as necessary for the proper
fulfilling of CONTRACTOR's obligations under the CONTRACT.

28. SCAFFOLDING

If scaffolding shall be required for safe performance of the work, the CONTRACTOR shall
erect the same using his own standard steel scaffolding materials. The use of wooden
scaffolding shall not be permitted. The CONTRACTOR shall ensure that scaffolding shall be
erected in such a manner so as not to interfere with other activities in the area.

29. SITES FOR CONTRACTOR'S OFFICES, AND STOREYARDS

It is the CONTRACTOR's responsibility to secure the site required for his construction offices
and storeyards. As soon as possible after award of the CONTRACT, the CONTRACTOR
shall investigate the availability of suitable sites for his offices, and storeyards. He shall then
submit his request to the relevant Authorities enclosing sketches indicating the locations and
dimensions of the several alternative sites he requires.

The concerned authorities will determine which site or sites will be allocated for the purpose
and the CONTRACTOR will be informed accordingly. No site can be allocated on a perma-
nent basis, or guaranteed for the duration of the CONTRACT.

30. CLEANING OF WORK SITE

The CONTRACTOR shall maintain the work site in a clean and orderly manner and shall
comply with all requirement of ADWEA regarding area of use, storage of equipment and
materials and disposal of waste or other debris. Upon completion or earlier termination of the
WORK(S), the CONTRACTOR shall promptly remove all his equipment, surplus materials
and debris from the work site and shall clean and restore the condition of the work site to the
satisfaction of ADWEA.

31. COORDINATION MEETING

All coordination meetings and procedures shall be conducted in accordance with the
CONTRACT.

32. DOCUMENT DISTRIBUTION

All documents, correspondence etc. shall be distributed in accordance with TABLE-1, of this
Specification.

33. PROTECTION OF THE ENVIRONMENT

The CONTRACTOR shall be responsible for protecting the environment from the
accumulation of waste and other materials that cause pollution or contamination. It is the
responsibility of the CONTRACTOR to dispose of, at his own cost and to ADWEA's
satisfaction, all substances, materials, equipment and debris resulting from his work. Failure
to do so may result in withholding payments by ADWEA which are due to the
CONTRACTOR.

34. TAG NUMBERING

The tag numbering shall be carried out in accordance with the KKS system, the AKS system
and/or as per ADWEA's requirements/procedures.

All items shall be tag numbered according to the approved drawings.

35. NAME PLATES

All items of equipment for the WORK(S) shall be provided with a nameplate. Nameplates
shall be standardised for each group of similar equipment and shall be made of stainless
steel. Each nameplate shall be securely fixed to the equipment concerned and such fixing
shall not involve drilling into the walls of parts under pressure.

Name plates shall contain the order number, equipment items number, manufacturer's name
and serial number, date of fabrication, type, size, weight and design conditions in addition to
all other data pertinent and specific to the equipment concerned such as tag number, speeds,
capacities, horse power, differential pressures, etc. Data shall be legibly stamped or
preferably engraved on the name plates.

The CONTRACTOR shall also take into consideration ADWEA's requirements in this respect.

36. HEALTH, SAFETY AND ENVIRONMENT (HSE) PLAN

a) Two months after the start of CONTRACT, the CONTRACTOR shall produce a HSE
Plan and submit it for the approval by ADWEA/ENGINEER. The HSE Plan is described
in the following sections. The primary objective of the HSE Plan is to demonstrate the
capability to carry out the contract work in a cost effective manner, giving due
consideration to the Health, Safety and Environmental management of his own
employees, those of ADWEA and anyone who may be affected by its activities.

b) In addition to the general hazards and their controls, the following hazards have been
identified as specific to the WORK(S) specified in Technical Specifications and Tender
Drawings and therefore the CONTRACTOR should demonstrate that he is capable of
providing the necessary controls for the work :

• Working within a 'Permit to Work' system

• Working adjacent to live high voltage equipment

• Working adjacent to, and in the vicinity of, live high voltage overhead lines

• Working at elevation

• Lifting operations

• Use of heavy machinery including cranage, pile rigs and concrete mixers

• Excavation works

• Work in confined spaces

The CONTRACTOR shall demonstrate his understanding of these hazards by either


proposing specific controls for each of them or by giving supporting documentation which
demonstrates that such controls already exist.

The CONTRACTOR shall ensure strict adherence to the “Ministerial Decision No. (32)
for the year 1982 regarding determination of the ways and means to protect employees
against occupational hazards”.

c) The HSE Plan shall identify the Standards, Procedures and Guidelines that will be
applicable to the PROJECT. These will be subject to the approval of
ADWEA/ENGINEER.

d) The CONTRACTOR will provide supervisors with a minimum of five years experience of
this type of work such that they are able to supervise the quality and standards of the
work without intervention by ADWEA/ENGINEER. The role of ADWEA/ENGINEER will
be to monitor and audit the quality of the work to ensure that it is of adequate standard
and that it is being safely and successfully managed.

37. ACCEPTANCE INSPECTION

37.1 Provisional Acceptance (Commissioning)

Upon successful completion of the WORK(S), satisfactory completion of Testing, successful


Trial and Initial Operations of the complete WORK(S), and thus the WORK(S) being ready for
Commercial Operation, the CONTRACTOR shall submit a request for Provisional Acceptance
to the ENGINEER.

Subject to the agreement of the ENGINEER, the ENGINEER shall inform ADWEA and a date
for inspection of the installation for Provisional Acceptance and commissioning shall be
arranged. The actual inspection is to be carried out by a special committee to be appointed by
ADWEA, and the facility's commissioning shall be carried out jointly by ADWEA/ENGINEER
and the CONTRACTOR.

The CONTRACTOR shall provide provisional As-Built Drawings and other documentations,
and he shall also provide all assistance, including demonstrations if requested during
inspection and commissioning.

According to the findings of the inspection committee and of the commissioning the
Provisional Acceptance Certificate may be issued, or if deemed necessary the
CONTRACTOR will be instructed to rectify any deficiencies found.

37.2 Final Acceptance

Prior to expiry of the guarantee period the CONTRACTOR shall inform ADWEA/ENGINEER
in writing when he considers that the whole of the WORK(S) have been completed and
properly maintained that inspection may be made for Final Acceptance. ADWEA/ENGINEER
shall carry out the inspection. The CONTRACTOR shall perform at his own expenses all
necessary repairs as may be required which are apparent at such inspection. On completion
of such repairs if ADWEA/ENGINER are satisfied that the WORK(S) have been completed
and properly maintained and the CONTRACTOR has fulfilled all his obligations under the
CONTRACT then the Final Acceptance Certificate may be issued with triplicate copies being
signed by ADWEA/ENGINEER and the CONTRACTOR.

After issue of the Final Acceptance Certificate, settlement of the final account will be made.

38. COMMISSIONING ENGINEER

Where items of specialist equipment have been supplied, for example pumps, generators,
instrumentation and switchgear, the CONTRACTOR shall include for qualified commissioning
engineers of the specialist suppliers to be at site during commissioning and to assist in the
demonstration and explanation of the plant and equipment.

39. GUARANTEE ENGINEER

The CONTRACTOR shall keep available a guarantee engineer well experienced, in operation
and maintenance of the plant and equipment supplied and installed to attend the site as and
when required at short notice by ADWEA/ENGINEER during the guarantee period of the
installations.

The guarantee engineer shall assist ADWEA in the operation and maintenance of the
installations in order to achieve undisturbed and optimal utilization. He shall also assist
ADWEA in the training of personnel if specified and, after the withdrawal of the
CONTRACTOR's agent, he shall act as the authorized CONTRACTOR's representative to
handle all cases which may arise during the Guarantee Period.

The name, qualification and experience of the guarantee engineer shall be transmitted to the
ADWEA/ENGINEER for approval not later than three (3) months before his delegation to site.
All costs and expenses in connection with the delegation of the guarantee engineer shall be
borne by the CONTRACTOR and be included in the CONTRACT PRICE.

40. NOISE LEVEL

All plant offered shall be quiet in operation. The Vendor/Supplier shall incorporate the best
practical means for noise control. Full information on the sound pressure levels likely to be
produced shall be provided.

Noise control procedures applied to equipment shall not interfere with the running and
maintenance thereof. Acoustic enclosures shall be constructed such that the site dismantling
and reassembly is possible without affecting the acoustic properties.

The noise level in any plant or machinery room shall not exceed 95 dB(A) at 1 metre from any
plant unit when all plant is running.

The CONTRACTOR shall guarantee that when all equipment is running the noise level in the
control rooms and offices will not exceed 50 dB(A).

41. EFFICIENCY GUARANTEE PENALTY

Any shortfall in the guaranteed efficiencies of various equipments between the one's given at
the time of TENDER and the efficiencies established at the efficiency tests, will be penalised
in accordance with the CONTRACT.

Any shortfall in the guaranteed pump and motor set efficiencies between the one's given at
the time of tender and the efficiencies established at the efficiency tests, will be penalised at
the rate of :

Penalty = 0.5 x Q x H UAE Dirhams

where 'Q' is in litres per second}

'H' is in metres total head } at the pump duty point

for each percent point difference in the efficiencies of each pump unit in which a shortfall
occurs from the guaranteed tender efficiencies up to a maximum of 25% of the pump unit
price in the summary price breakdown.

A pump unit is defined as the pump, coupling and its electric drive motor.

42. REJECTION OF EQUIPMENT

ADWEA reserves the right to reject:

a) Parts of equipment if the workshop tests prove that the equipment is not in accordance
with the requirements of the CONTRACT.

b) The equipment or parts thereof if the sum of penalties due to deficiencies in guaranteed
values exceeds 25% (twenty five percent) of the cost of the equipment.

c) The equipment or parts thereof, if the efficiency established during the factory testing is
less than the guaranteed value.

43. MONTHLY PROGRESS REPORTS

The CONTRACTOR shall submit 5 sets of a detailed Monthly Report, including progress
photographs, not later than the first week of the following month.
