Bioprospecting
Sec. 5 (a). “Bioprospecting” refers to research,
collection, and utilization of biological and
genetic resources for purposes of applying the
knowledge derived there from SOLELY FOR
COMMERCIAL PURPOSES.

A. For foreign entity/institution/individual or a Filipino citizen affiliated
with foreign institutions

Requirements (Section 4 of DAO 55)


1. Execution of a MOA with the PAWB

b) Institution’s profile, if applicable
c) Endorsement form the head of the
Institution; or in the case of an individual
researcher, from a recognized expert or
a research institution or a conservation
organization

captive-bred/propagated individuals

C. For thesis of students affiliated with local academic institutions and other government
initiated or implemented research or scientific projects

1) Issuance of Gratuitous Permit (GP) by the RED concerned shall be sufficient

d) Payment an amount of P100.00 for application and processing fees (Section 9 of DAO 55)

❑ Authorizes the deputation of Wildlife
Enforcement Officers
Who:❖ DENR officials and field personnel assigned
in the forestry and protected area and wildlife
sectors. Their function in wildlife law
enforcement is limited to terrestrial plant and
animal species, all turtles and tortoises and
wetland species, including but not limited to
crocodiles, waterbirds and all amphibians
and dugong
DA officials and field personnel in the law enforcement units of the said agency. Their wildlife law enforcement function covers all
declared aquatic critical habitats, all aquatic resources, including but not limited to all fishes, aquatic plants, invertebrates and all
marine mammals, except dugong.
PCSD officials and field personnel. Their wildlife law enforcement is limited to wildlife species found in Palawan. Jurisdiction over
existing DENR wildlife conservation projects of national concern/significance located in Palawan, such as but not limited to the
Palawan Wildlife Rescue and Conservation Center (PWRCC) and Philippine Cockatoo Conservation Program (PCCP) remains with
DENR.
Deputized wildlife enforcement officers from non-government organizations, citizens groups, community organization and other
volunteers who have undergone the necessary training for this purpose;

Designated wildlife enforcement officers from the Phil. National Police, Armed Forces of the Phil., National Bureau of Investigation
and other law enforcement agencies
Qualifications:
Must be a resident of, or assigned to, the area specified in the deputation/designation order;
Must be able to read and write;
Must be at least 18 years old and not more than 60 years old;
Must be physically fit and mentally sound;
Of good moral character; and
Willing to perform and undertake the functions and duties of a wildlife enforcement officers

Functions
❑ Seize illegally traded wildlife and arrest violators of RA 9147
subject to existing laws, rules and regulations on arrest and
detention;
❑ Seize illegally collected, possessed and/or traded wildlife or
parts, by-product and/or derivatives thereof
❑ Arrest even without warrant any person who has committed,
is committing, or is about to commit in his presence any of
the offenses provided under the Act and other relevant laws,
rules and regulations
❑ Assist in the conduct of surveillance and monitoring of
wildlife-related activities
❑ Authorizes the deputation of Wildlife
Enforcement Officers

Functions
❑ Deliver the arrested offender within reasonable time to the
nearest police station and assist in filing the proper
complaint with the appropriate official designated by law
to conduct preliminary investigation
❑ Deliver within reasonable time to the nearest CENRO,
PENRO or DENR RO of BFAR Regional/Provincial
Offices or PCSDS District Management Office for custody
of all confiscated wildlife, their parts, by-products and/or
derivatives, as well as tools, equipment and conveyances
used in the commission of the crime, including
corresponding reports
❑ Act as witness in the court for the speedy
prosecution of criminal complaints against
wildlife violators
❑ Prosecute cases before Municipal Trial
Courts in areas where there are no
prosecutors
❑ Coordinate with other law enforcement
agencies for security, if necessary
❑ Prescribes the establishment of critical
habitats outside protected areas where
threatened species are found
▪ areas outside PAs where threatened species are found
▪ based on best scientific data available (species endemicity
richness, presence of man-made pressures/threats)
▪ to be protected in coordination with LGUs and concerned
groups
