“WILDLIFE RESOURCES
CONSERVATION AND
PROTECTION ACT”

Bioprospecting
Sec. 5 (a). “Bioprospecting” refers to research,
collection, and utilization of biological and
genetic resources for purposes of applying the
knowledge derived there from SOLELY FOR
COMMERCIAL PURPOSES.
Bioprospecting
Requirements
❖ permit from the DENR or DA or PCSD
❖ execution of an undertaking with DENR or DA or PCSD
- letter of intent, research proposal, accomplished
forms,
letter of acceptance from Filipino research
counterpart,
institution/organization profile, etc
❖ prior informed consent of concerned sectors
❖ in case of foreign applicants, active involvement of a
local institution in the research

❖ issuance of a Gratuitous Permit
❖ prior clearance from concerned sectors

Scientific Researches on Wildlife
A. For foreign entity/institution/individual or a Filipino citizen affiliated
with foreign institutions
Requirements
a) Research/project Proposal
b) Endorsement letter from the concerned Dean (for students applicants only) or in case of an individual researcher,
from a recognized expert or a research institutions or conservation organization
c) Prior clearance from the affected neighborhood communities, i.e., concerned LGUs, recognized head of the
indigenous people in accordance with RA 8371, or Protected Area Management Board
d) Payment an amount of P100.00 for application and processing fees (Section 9 of DAO 55)
❑ Kinds of wildlife permits issued by DENR
Designated wildlife enforcement officers from the Phil. National Police, Armed Forces of the Phil., National Bureau of Investigation
and other law enforcement agencies
Qualifications:
Must be a resident of, or assigned to, the area specified in the deputation/designation order;
Must be able to read and write;
Must be at least 18 years old and not more than 60 years old;
Must be physically fit and mentally sound;
Of good moral character; and
Willing to perform and undertake the functions and duties of a wildlife enforcement officers

Functions
❑ Seize illegally traded wildlife and arrest violators of RA 9147
subject to existing laws, rules and regulations on arrest and
detention;
❑ Seize illegally collected, possessed and/or traded wildlife or
parts, by-product and/or derivatives thereof
❑ Arrest even without warrant any person who has committed,
is committing, or is about to commit in his presence any of
the offenses provided under the Act and other relevant laws,
rules and regulations
❑ Assist in the conduct of surveillance and monitoring of
wildlife-related activities
❑ Authorizes the deputation of Wildlife
Enforcement Officers
Functions
❑ Deliver the arrested offender within reasonable time to the
nearest police station and assist in filing the proper
complaint with the appropriate official designated by law
to conduct preliminary investigation
❑ Deliver within reasonable time to the nearest CENRO,
PENRO or DENR RO of BFAR Regional/Provincial
Offices or PCSDS District Management Office for custody
of all confiscated wildlife, their parts, by-products and/or
derivatives, as well as tools, equipment and conveyances
used in the commission of the crime, including
corresponding reports
❑ Act as witness in the court for the speedy
prosecution of criminal complaints against
wildlife violators
❑ Prosecute cases before Municipal Trial
Courts in areas where there are no
prosecutors
❑ Coordinate with other law enforcement
agencies for security, if necessary
❑ Prescribes the establishment of critical
habitats outside protected areas where
threatened species are found
