EXTRA-JUDICIAL SETTLEMENT OF ESTATE

KNOW ALL MEN BY THESE PRESENTS:

We, GERVACIO O. CALABIA JR., The Heirs of Lilia Calabia represented ROMEO C.
REDOÑA JR., , The Heirs of Jose Calabia namely JOEMAR M. CALABIA, JO-ANN C. BOMBASE
and JOEBERT M. CALABIA, and FE O. CALABIA, all married except Fe Calabia and Joemar
Calabia who are single, all of legal ages, all Filipinos and all residents of Sta. Cruz, Jaro, Leyte,
except Romeo Redoña, who is a resident of Licod, Tanauan, Leyte do hereby declare as
follows:

1. That we, the above-named parties are the legitimate children and the surviving
compulsory heirs of the deceased GERVACIO G. CALABIA SR., who died on May 10,
1995 at Sta. Cruz, Jaro, Leyte;

2. That the decedent died intestate, without leaving any Last Will or Testament and
without leaving any debts or accounts whatsoever;

3. That the decedent left the following parcel of land;

“ A parcel of land (Lot No. 4066 of the Cadastral Survey of Jaro), with the
improvements thereon, situated in the Barrio of Sta. Cruz, Municipality of Jaro.
Bounded on the NE. by Lots Nos. 3993, 3992, 3990 and 3989; on the SE. by Lots Nos.
4067, 4065, 4064 and 4072; on the W. by Lots Nos. 4061, 4062 and 4063; and on the
NW. by Lot No. 3994. Beginning at a point marked “1” on plan, being N.29 18’ E.
649.27 m. from B.B.M. No. 23; thence N.53 dog. 15’ E. 46.11 m. to point 2; thence N.
30 deg. 46’ W. 138.20 m. to point 3; thence N. 52 deg. 49’ E. 221.99m. to point 4; thence
S. 47 deg. 34’E. 107.51 m. to point 5; thence S. 48 deg. 18’ . 79.60 m. to point 6; thence;
thence S. 52 deg. 12’ E. 110.62 m. to point 7; thence S. 60 deg. 20’ E . 77.58 m. to point
8; thence S . 33 deg. 07’ W. 22.36 m. to point5; thence S. 81 deg. 28’ W. 101.14 m. to
point 10; thence N. 42 deg. 54’ W. 109.57 m. to point 11; thence S. 70 deg. 57’ W. 56.24

containing an area of EIGHTY-EIGHT THOUSAND NINE HUNDRED AND TWENTY-
FOUR SQUARE METERS MORE OR LESS(88,924 SQ.M.).

4. That pursuant to Section 1, Rule 74 of the Revised Rules of Court of the Philippines,
and we, the parties herein being all of age and full civil capacity, have agreed to divide
as we do hereby divide equally and adjudicate, the real property above-described;

5. That we hereby affirm that we have executed this instrument out of our own free will
without force, intimidation or violence upon our person, and that we have hereby
received our just and proper share and have no more claim or demand against each
other in connection with the adjudication of the above-described parcel of land;
