RE: Information for Non-observance of Section 24 of RA 9006 in Barangay Inayawan

Dear Hon. Soon:

I am Kim D. Ecarma, a 2nd year law student of the University of San Carlos, and I am writing to you as a student of
the Natural Resources and Environmental Law course handled by Atty. Nelia Prieto. In said course, we discussed
about RA 9003 or the Ecological Solid Waste Management Act, but I have personally observed that Section 24
thereof is not being implemented in our barangay. Hence, my humble request that you take notice of the discrepancy
between said law and the actual practice of garbage collection being observed in our barangay, so that action may be
taken upon to implement Section 24.

Section 24 of RA 9003 or the Ecological Solid Waste Management Act specifically states:

Section 24. Requirements for the Transport of Solid Waste - The use of separate collection
schedules and/or separate trucks or haulers shall be required for specific types of wastes.
Otherwise, vehicles used for the collection and transport of solid wastes shall have the appropriate
compartments to facilitate efficient storing of sorted wastes while in transit.

Vehicles shall be designed to consider road size, condition and capacity to ensure the sage and
efficient collection and transport of solid wastes

The waste compartment shall have a cover to ensure the containment of solid wastes while in
transit.

For the purpose of identification, vehicles shall bear the body number, the name, and the telephone
number of the contractor/agency collecting solid waste.

I have personally observed that while the above provision directs that garbage should be segregated properly, and
that biodegradable waste should be transported on a separate truck from the non-biodegradable waste, garbage in our
barangay are only transported by a single truck; the same goes for the adjacent barangays as far as I can also observe
while I drive through our streets. Furthermore, while the above provision also directs that collection schedules
should also be separate for biodegradable waste and non-biodegradable waste, garbage in our barangay are only
being collected at once every Tuesday, or sometimes on Wednesdays.
