IMPLEMENTING RULES AND REGULATIONS OF ORDINANCE NO. 90,


SERIES OF 2018, OTHERWISE KNOWN AS AN ORDINANCE REQUIRING
MCH ASSOCIATION MEMBERSHIP PRIOR TO THE GRANT OF A MAYOR’S
PERMIT TO DRIVE

Pursuant to Ordinance No. 90, series of 2018, otherwise known as an


Ordinance Requiring MCH Association Membership Prior To The Grant Of A
Mayor’s Permit To Drive, the following Rules and Regulations are hereby
promulgated by the Sangguniang Panlungsod.

RULE 1

PRELIMINARY PROVISIONS

Section 1. Title. - This Rules shall be known as the Implementing Rules and
Regulations of Ordinance No. 90, Series of 2018.

Section 2. Declaration of Policy. - Mindful of the policy of the LGU to


regulate the MCH industry in order to better serve public interest.

Section 3. Definition of terms. - As used in these Implementing Rules and


Regulations, the following terms shall mean:

a. Committee on Accreditation
b. Mayor’s Permit to Drive
c. MCH Association Membership
d. MCH Driver Association
e. MCH Driver Association of Dumaguete City
f. Motorcab-For-Hire (MCH) refers to a motorized tricycle (4-stroke
combus
g. tion engine with engine displacement of at least 125cc with clutch
manual transmission, or its equivalent if battery-powered) with an attached
s ide-car designed primarily for the safe carriage of passengers and goods;
h. Regular Drivers
i. Sectoral Desk Office (SDO)
j. Temporary Drivers (Extrador)
k. Valid MCH Driver Association of Dumaguete City

Section 4. Mandatory Requirement of MCH Association Membership. - No


MCH driver (whether regular or extrador) shall be granted a Mayor’s Permit
to Drive unless he is a member of a valid MCH Driver Association of
Dumaguete City.

In relation to the succeeding section, all unaffiliated drivers may join


existing duly accredited associations or create their own.

Section 5. Compliance. - The Traffic Management Office (TMO) and the


Sectoral Desk Office (SDO), in coordination with the Committee on
Accreditation of the City Council, are hereby given six (6) months from the time
of the approval of this ordinance to monitor and facilitate the required MCH
associated membership of all drivers.

Upon certification by TMO that all MCH franchises have representative


membership in any duly accredited MCH association of the City, the
requirement that all drivers who are not an MCH association member cannot be
issued a Mayor’s Permit to Drive, shall then take effect.
