ESTABLISHMENT OF CHHATTISGARH HIGH COURT

The Chhattisgarh High Court is one of the new High Court in India. It was established on 1st of
November 2000 as a separate High Court for newly created State of Chhattisgarh under the
Madhya Pradesh Reorganization Act, 2000 having its jurisdiction over the territories of the state
of Chhattisgarh. The High Court of Bilaspur is the 19th High Court of India. The High Court was
inaugurated by Hon’ble Mr. Justice B.N. Kirpal, Judge Supreme Court of India on 1st of
November 2000 in the Presence of Mr. Arun Jaitley, Union Minister of State for Law and Justice
and Company Affairs Hon’ble Mr. Justice Bhawani Singh Chief Justice of High Court of M.P.
and Hon’ble Mr. Justice R.S. Garg, first Acting Chief Justice of the High Court of Chhattisgarh
at Bilaspur. It's new building is situated in Bilaspur at Bodri. The court has sanctioned strength
of twenty two judges.

FIRST APPEAL UNDER SECTION 19(1) OF FAMILY COURT ACT 1984

Being aggrieved by the impugned judgment dated 16.02.2018 (Annexure A/1), in Civil
Suit No. 166/2015, passed by the Learned Principal Judge Family Court Durg, Distt. Durg C.G.
in case of Smt. Asha Vs. Ashok Tiwari, the above named appellant/ applicant respectfully
prefers this appeal on the following facts and grounds :-

FACTS OF THE CASE

1. That, the appellant/applicant filed a Civil Suit before the Learned Family Court for
dissolution of the marriage under section 13 (1-A) (1-B) of Hindu Marriage Act, 1955.

2. That, the admitted facts is that appellant/applicant is legal wed wife of the respondent/non
applicant.
3. That, the brief facts of the case as per the appellant/applicant is that on dated 27.04.2002
after the marriage of the appellant she living with her husband in Aditya Nagar Durg and
before her marriage she was doing a government job.

4. That, after the marriage they are living happening few days and after marriage the
respondent/non applicant abusing the appellant/applicant and torturing the
appellant/applicant and stated the relative of the appellant that there is love affair with
other person with appellant/applicant. Therefore the appellant/applicant filed divorce
petitioner under section 13 (1-A) (1-B) of Hindu Marriage Act, 1955.

5. That, the respondent/non applicant file a reply and deny all the allegation.

6. That, the learned family court has found that the appellant/applicant has not a prove its
case, therefore the decree of the dissolution of the marriage was dismissed. Hence this
appeal on the following grounds :-

GROUNDS :-

1. Because, the impugned judgment dated 16.02.2018 is bad illegal, perverse, arbitrary, therefore,
liable to be set-aside.

2. Because, the learned Family Court without seen the fact therefore dismissed the divorce petition
of the appellant/applicant.

3. Because, after the marriage they are living happening few days and after marriage the
respondent/non applicant abusing the appellant/applicant and torturing the
appellant/applicant and stated the relative of the appellant that there is love affair with
other person with appellant/applicant. Therefore the appellant/applicant filed divorce
petitioner under section 13 (1-A) (1-B) of Hindu Marriage Act, 1955.

4. Because, the learned family court has found that the appellant/applicant has not a prove its case,
therefore the decree of the dissolution of the marriage was dismissed

PRAYER
It is therefore prayed that this Hon’ble Court may kindly be allow this appeal and set
aside /quashed the judgment dated 16.02.2018 in the interest of justice.

PERSONAL OBSERVATION

During this period of my internship I came to observe many a things. What I observed is that the
hierarchy was very systematically followed with no delay in time. I got the opportunity to learn
many things from assistants and learned the practical aspect of the law and to see the proceedings
and the drafting. I observed the level of security in the court, every person enters in the court
with the rules and regulations and how one maintains their relation with their senior or their
junior. Their were different chambers of various prosecutors there are different court for different
types of cases which are working systematically and even the technology is used well, research
and records are done electronically. The atmosphere inside the court was quiet and calm. Some
points is to be noted seriously like strikes of prosecution should be avoided, the police must do
their work seriously and the decorum should also be maintained even outside the court rooms.
Judiciary is doing its best in establishing a true democracy however this point will decrease the
workload of a judiciary and can provide justice as soon as possible.

WORKING EXPERIENCE

There was a very healthy environment, everybody in the court were very helpful with not only
internship but also regarding CV making tips and other important aspects involved within a law
college. Even the other advocate converse with us so nicely that it got easier for us to know
about the fact in much wider aspect. I used to ask many problem hundred times and everyone
replied so patiently which taught me how calmly react to the questions asked. There was a
formal relation with my senior which helped me making myself comfortable with work.

Their were many more junior advocate under our senior, they also taught us very well in various
aspects, it was sometimes great with them when the such situation arises were we cannot ask the
question directly to our senior then they helped us to come out of those. The people and their
helping nature was the best thing and their work experience guided me with different hurdles
which an intern faces. It was a great experience working with him and was great learning too.
Enquiring about the cases and their facts some a times made us more serious to hear the matter.
It was a great learning which increased my interest in the profession.
