COMPLAINT-AFFIDAVIT

I, NILO P. QUIAPOS, of legal age, married, Filipino and a resident of

San Isidro, Sagñay, Camarines Sur, state that:

1. I am the owner of a Blue Mitsukoshi Bonus 110 Motorcycle with C.R.

No. 35241884-6; I bought the same on installment basis; copy of the
receipt is attached as Annex “A”

2. On May 24, 2019, it was borrowed by one Pedro S. Bantal of Kilomaon,

Sagñay, Camarines Sur;

3. On July 29, 2019, the said vehicle was returned to me with the
following original parts thereof already missing and were replaced with
substandard items:

4. I reported this matter to the police authorities and caused its entry in
the police blotter;

5. Mr. Pedro Bantal brought the vehicle to the shop of Dennis Purisima
and Stephen Perez. The following parts were then sold by Mr. Pedro
S. Bantal to the following persons:

6. DENNIS PURISIMA AND STEPHEN PEREZ stated that the

motorcycle was brought to their shop. Pedro Bantal along with Grace
Baldosa told them that he was the owner thereof and told them to
remove and replace the aforementioned motorcycle parts;

The joint affidavit of Dennis Purisima and Stephen Perez is attached as

Annex “D”

7. Upon learning the identities of the ones who were in possession of the
stolen items, I took it upon myself to recover the same. I went to
Barangay Turague and had a session with WILSON BRIONES; the
latter refused to return the stolen items from me;

Copy of the session is attached as Annex “E”

8. RAMON ALIS JR of Minadongol, Sagnay Camarines Sur during the

barangay session admitted to having bought the telescopic from Pedro
Bantal in the amount of Php 500.00

9. WILSON BRIONES admitted that he bought the Head Light or Light

Assy, mud guard, the engine and paid the mechanic Php 1,000.00; He
refused to return the said items except if he gets reimbursed;

 10. The abovenamed persons when they were offered genuine
motor parts in the lowest of prices should have put them into inquiry
as to the source thereof but instead they took it as an opportunity at
the cost of the lawful owner;

11. The abovenamed persons after having known that the said items
in their possession, came from the proceeds of theft, still refuse to
return them to undersigned;

12. That the facts as narrated sufficiently shows that a crime or

crimes have been committed and that respondents are probably guilty
thereof;

13. I am executing this affidavit in order to attest to the foregoing,

to charge PEDRO BANTAL for THEFT or carnapping and RAMON
ALIS, Wilson Briones, Danilo Bebat, Jansen Peña for Violation of
the Anti-Fencing Law; Having then known that the motorcycle parts
they bought came from the crime of theft, still they refused to return
them;

married, Filipinos and a residents of Tigaon, Camarines Sur, state that:

1. On May 24, 2019 one Pedro S. Bantal of Kilomaon, Sagñay, Camarines

Sur, with one Grace Baldosa as his backride came to our shop at
Tigaon, Camarines Sur on board a Blue Mitsukoshi Bonus 110
Motorcycle with C.R. No. 35241884-6;

2. Mr. Pedro Bantal informed us that he is the owner of the said vehicle
and that he will surrender the same to SYM motorcycle;

3. He then told us to remove the new genuine motorcycle parts and the
replace them with old dilapidated ones;

4. We are executing this affidavit in order to attest to the foregoing, to

charge PEDRO BANTAL for theft and RAMON ALIS, WILSON
BRIONES, DANIG BENAT, WILSON LANUZO for Violation of the
Anti-Fencing Law; Having then known that the motorcycle parts they
bought came from the crime of theft, still they refused to return them;

Kilomaon, Sagñay, Camarines Sur, state that:

1. On May 24, 2019 I borrowed the Blue Mitsukoshi Bonus 110 Motorcycle
with C.R. No. 35241884-6 of Mr. Nilo P. Quiapos;

2. I, along with Grace Baldosa as my back ride brought the same to the
motorcycle shop of DENNIS PURISIMA AND STEPHEN PEREZ;

3. I then then told Dennis Purissima to remove the new genuine

motorcycle parts and the replace them with old dilapidated ones;

4. After having in my possession the following genuine motorcycle parts

5. I the returned the motorcycle to Mr. Nilo P. Quiapos already with the
genuine parts replaced;
 6. I am executing this Affidavit with my full will and consent. I was not
coerced into executing this but only because I am willing to pay for my
crimes and ask forgiveness from Mr. Nilo P. Quiapos;

7. I am executing this affidavit in order to attest to the foregoing, and for

all legal intents and purposes;
