The copyright and other intellectual property rights in an HumanAlloy.com 3D model file
("the 3D model File") are owned by HumanAlloy.com/Bethe Graphics whose registered
office is at Sauerlandstraat 9 1827HC Alkmaar The Netherlands ("the Owner"). Please
read through the following license conditions and the Terms and Conditions of Business
which appear on the www.HumanAlloy.com website. If you agree to be legally bound by
them please confirm this when prompted. If you do not agree to comply with these
terms you will not receive the 3D file you have selected.

1. license

Upon payment in full of the license fee you are permitted to:

1.1

load the 3D model File onto your or your company's computer or a computer network
which is entirely under your or your company's control and use it and permit other
persons within your company to use it for the production of computer graphics subject
always to the number of copies permitted by your license as set out in clause 1.6;

1.2

exploit in all media without limit of time or place and without payment to the Owner of
any royalties or fees all graphics files created by you that you have adapted by the use
of any part of the 3D model File provided that this license shall not extend to any
program, application, routine, system or applet incorporating any part of the 3D model
File;

1.3

transfer the 3D model File to another computer or computer network under your
company's control.

1.4
make up to 3 copies of the 3D Model File for backup purposes only provided that such
copies reproduce the Owner's notice of ownership and this license;

1.5

transfer the 3D Model File and the benefit of this license to another person provided that
the recipient has agreed to accept the terms of this license and at the same time as
transferring the 3D Model File you transfer all your copies of the 3D model File or
destroy all copies not transferred. If any transferee does not accept such terms then
this license shall automatically terminate immediately. The transferor shall not retain
any rights under this license in respect of the transferred 3D Model File if the license
terminates in this way;

1.6

only you or directors or employees of your company may use the 3D Model File.

2. INFRINGING ACTS

Users of the 3D Model File are not permitted:

2.1

to do any act that would permit the 3D Model File to be used or copied by any person
for whose usage a license fee has not been paid to the Owner;

2.2

except as expressly permitted by this license and save to the extent and in the
circumstances expressly permitted by law, to rent, lease, sublicense, loan, copy, merge,
translate, reverse engineer, decompile, disassemble or create derivative works based
on the whole or any part of the 3D model File or use, reproduce or deal in the 3D model
File or any part thereof in any way;

2.3
to publish, market, distribute, transfer, sell or sublicense the 3D model File as "clip art"
or the like, including but not limited to animations or still images that are sublicensed or
otherwise distributed by a stock photography or stock animation agency.

3. THIRD PARTY RIGHTS

The parties confirm their intent not to confer any rights on any third parties by virtue of
this license.

4. TERM

This license is effective until you terminate it by destroying the 3D Model File together
with all copies. It will also terminate if you fail to abide by its terms. Upon termination
you shall destroy all copies of the 3D model File including any 3D model File stored on
the hard disk of any computer under your or your company's control.

5. LAW

This license, which constitutes the entire agreement between you and the Owner
relating to the 3D model File, shall be subject to and construed in accordance with the
law of The Netherlands and any dispute arising shall be submitted to the exclusive
jurisdiction of the Dutch courts.

Terms of Business

Definitions

"Product" means an HumanAlloy.com 3D model file available to purchase through the

Site by a Purchaser or any other item that may be available for purchase through the
Site; "the Site" means the website located at URL www.HumanAlloy.com; "Purchaser"
means any individual who purchases the Product from the Site; "you" or "your" means
any Purchaser.

Introduction

These Terms and Conditions apply to all Purchasers. When purchasing a Product from
the Site you are required to agree to the terms set out below. If you do not agree to these
Terms and Conditions you may not proceed with purchasing a Product.

1. The Site is operated by Bethe Graphics. We are a company registered in The

Netherlands under Chambers of Commerce number 37081683. HumanAlloy.com
reserves the right to change these Terms and Conditions at any time without notice and
it is in your interest to check regularly whether there have been any changes of which
you should be aware, since your last purchase.

2. These Terms and Conditions are to be read in conjunction with the Privacy

3. For the avoidance of doubt, these terms and Conditions do not apply to any
transactions entered into between a Purchaser and Paypal or any other thirdparty

Reserved Rights

1. Unless otherwise indicated, HumanAlloy.com owns all copyright in the material on

the Site. The Site contains various parties' trade marks, which may be registered or
otherwise protected by law. These include the HumanAlloy.com name and logo and the
logos of various HumanAlloy.com products. You are not permitted to use these trade
marks.

Purchasing Through This Site

1. Information regarding Products on the Site is provided as an indication

only. The statement in the Licence Agreement describing the properties and
capabilities of the Product (at clause 5.2) is the only representation upon which
you should rely when deciding whether to purchase. It is for you to assess
whether the Product will be suitable for your purposes: the Site does not purport
to provide you with any advice.

Exclusions

1. Apart from liability for causing death or personal injury or arising from fraud (which
cannot by law be excluded) HumanAlloy.com excludes all liability for lost profits and all
damages for consequential, special or indirect losses incurred by you as a result of your
use of any of the Products. In any event of any claim the liability of HumanAlloy.com
shall be limited to a refund of the fee paid for the Product.

responsible for the accuracy, legality, and decency of material or copyright compliance

content or operation of such websites or any of the goods and services that they

2. You are permitted to link to or frame the Site without HumanAlloy.com express
written permission.
3. Any arrangements made between you and any thirdparty named on this Site

Jurisdiction

1. If any provision of these Terms and Conditions is found to be invalid by the court, the
invalidity of that provision will not affect the validity of the remaining provisions of
