PROCEDURE FOR APPROVAL OF HOUSING SCHEMES UNDER KP

(SITE DEVELOPMENT SCHEME) RULES -2005

No Objection Certificates (NOC) in respect of the Housing Schemes are issued


to the concerned departments for installation / provision of utilities / basic amenities such
as Gas / electricity / telephone connections subject to approval of the housing schemes.
The said NOCs are issued by Peshawar Development Authority.

The following procedure is adopted for approval of site development schemes /


private housing schemes:

Application is written by the potential developer to the Scrutiny Committee for


grant of sanction in respect of the Housing Scheme along with the following documents:

a. Ownership / Title Document along with Aks – e – Shajarrah


b. Non – encumbrance certificate
c. Lay out plan including showing roads, streets, drains, green belts, etc.
d. Topographic Survey
e. Details of Land to be acquired (if any)
f. Statement of works with time period for development
g. Others
2. The application is analyzed by the Scrutiny Committee on the following grounds
a. Minimum scheme area should not be less than 160 kanal
b. Area is not notified for any government use
c. Land is free from legal and other encumbrances
d. Access roads not less than 30 feet
e. Danger of flood
f. Planning standards are observed, etc
3. If the application is found fulfilling the major criteria then, objections are invited from
general public through notice in two leading dailies

4. If any objections are received, the same are conveyed to the developer and reply is
sorted.
5. The reply so furnished by the developer is further analyzed and if found satisfactory then,
sanction is issued subject to:

a. Land under roads, open space, parks, graveyard and 1 % for public buildings
is transferred in the name of regulatory authority
b. Guarantee in respect of the developmental work is provided either in the form
of mortgage of 20% saleable land or Bank Guarantee of National Bank of
Pakistan / BOK

6. If all the requirements are completed then the approval is formally issued and published in
two leading dailies for information of all

7. The area so mortgaged as a guarantee of the developmental works is released as per


following:
a. 30 % area released on completion of water supply, sewerage and drainage
system.
b. 30% area released on completion of roads
c. 30 % area released on completion of electrification
d. 30 % area released on completion of street lights/ horticulture work
8. In case of any dispute, the applicant has the right of appeal to Secretary LGE&RDD

SCRUTINY COMMITTEE

A “Scrutiny Committee” comprising of 8 members is duly notified by the Provincial


Government is order to analyze and scrutinize the applications received from potential
developers. Following is the membership of the committee:

3. XEN CNW
4. TMO
5. TOP (TMA)
6. Representative of EPA
7. AO Local Government
8. District Officer (Revenue)
