In the midst of a long economic, professional and

institutional crisis, a Law of Schools & Professional
Services has been announced that brings about
some serious confusion between construction and
architecture, with relation to the architects’ at-
tributes, from a false discourse of competition and

contrarily, it would generate a total deregulation

En medio de una larga crisis económica, profesio-
nal e institucional, se anuncia una Ley de Colegios y
Servicios Profesionales que plantea una grave con-
fusión entre construcción y arquitectura, en rela-
ción con las atribuciones de los arquitectos, desde
un falso discurso de competitividad y liberalización,
que en ningún caso exige Europa y no viene de-
mandada por ninguna necesidad, sino que, al con-
trario, generaría una total desregulación y multitud
de nuevos conflictos.
La Directiva Europea 2005/36/CE de cualificaciones
profesionales define el interés público de la arqui-
tectura y el equilibrio entre los aspectos teóricos
y prácticos, aptitudes y conocimientos específicos
técnicos y humanísticos que debe mantener su en-
señanza.
En España, la formación del arquitecto es especí-
fica y diferenciada de otras profesiones técnicas,
como las ingenierías. Asimismo, la garantía y el
interés público son controlados por la sociedad,
que otorga atribuciones profesionales exclusivas a
quienes tienen la competencia, es decir, los cono-
cimientos para ejercer la arquitectura, que no son
otros que los arquitectos.
Los arquitectos nos ocupamos de la arquitectura,
de la coordinación e integración completa del pro-
ceso de proyecto y obra en los espacios en que
predomina el uso de las personas, pero interve-
nimos también en aquellas edificaciones de infra-
estructuras de transporte o industriales en las que
también existen esos espacios. Esas edificaciones
en la ciudad o el territorio pasan a formar parte del
patrimonio colectivo y del paisaje, y no concebi-
mos para nuestras ciudades un panorama tan de-
solador como el de los polígonos industriales.
Confundir construcción con arquitectura es, sin
más, una muestra de incultura. Quien promueve o
construye un edificio no es siempre quien lo uti-
lizará después, y ese edificio pasa a ser parte de
la ciudad, en la que seguirá presente más allá de
quienes intervinieron en su construcción, contribu-
yendo a que la ciudad sea algo mejor, o algo peor
según el caso.
Sin embargo, no se trata solo de motivaciones so-
cioculturales; la propuesta generaría una quiebra
en el sistema de garantías que la Ley de Orde-
nación de la Edificación (LOE) ha consolidado en
cuanto a calidad, seguridad y responsabilidad en
la edificación, y tampoco tendría repercusión eco-
nómica de costes, sino de reducción de la compe-
titividad en un mercado ya saturado, en el que se
produciría una disminución de la calidad.
Se trata, pues, de una propuesta inviable legalmen-
te, manifiestamente inoportuna y gravemente per-
judicial para la arquitectura española, que cuenta
con un reconocimiento internacional como mode-
lo de excelencia competitiva y que contribuye en
gran medida al prestigio de la Marca España.

We architects occupy ourselves with architecture,
with the coordination and complete integration of
project and/or work process in spaces which are
predominantly for the use of people, but we also
intervene in the construction of transport or in-
dustrial infrastructures, within which also exist said
spaces for people. These constructions in the city or
on other terrain become part of the collective herit-
age and landscape, and we by no means conceive
for our cities a panorama as desolate as that of an
industrial estate.
Confusing construction with architecture is, basi-
cally, demonstrating ignorance. Whoever promotes
or constructs a building is not always the person who
will use it afterwards, and that building becomes
part of the city, as such it stays present beyond those
who constructed it, contributing to the city to make
it something better, or worse in some cases.
However, this is not just about sociocultural motiva-
tions; the proposal would generate a crack in the
guarantee system that the Ley de Ordenación de la
Edificación (LOE – i.e. Building Standards Law) has
consolidated with regards to quality, security and re-
sponsibility in construction. Neither would it have
any effect on the economy of costs, it would only
cause a decrease in competition in a currently satu-
rated market, through which a reduction in quality
would come about.
This is about, then, a legally non-viable proposal,
greatly inappropriate and severely damaging for
Spanish architecture, which currently has interna-
tional recognition as a model of competitive excel-
lence and contributes a great deal to the prestige of
Spain as a brand.

En un solar situado tras la pantalla del hotel Don Pepe
y sin vistas al mar, se proyectó este conjunto con una
ordenanza que permitía torres de diez plantas sobre
rasante y un total de 10 000 m2 de construcción.
Este proyecto disminuyó el coste de la repercusión del
solar tres veces al construirse, excavando un valle ar-
tificial en el terreno al que dan algunos apartamentos,
22 000 m2 más bajo rasante.
Desafortunadamente, la construcción no se realizó con
arreglo al proyecto, pues se acabó en enfoscado a
la tirolesa, lo que le da un aspecto de merengue mi-
goso y blando pero agresivo, y se gastó inútilmente
un dinero en una también desafortunada decoración
yuxtapuesta.

In a plot situated behind Hotel Don Pepe’s screen and
without views of the sea, this team planned a project,
under an ordinance that permitted towers of 10 floors
above ground level and with a total of 10000 m2 of
construction.
However, this project reduced the value of the plot three-
fold when completed, excavating an artificial valley in
the terrain that is looked upon by various apartments
that are 22,000 m2 including below ground level.
Unfortunately, the construction didn’t follow the plans
established by the architect, as it ended up being done
using the tirolese mortar filling style which gives the
whole thing a soft crumb-covered meringue effect, yet still
manages to be aggressive. Also money was spent uselessly
on the rather unfortunate juxtaposed decoration.
