Art. 233
The person exercising substitute parental authority
shall have the same authority over the person of the
child as the parents.
In no case shall the school administrator, teacher or
individual engaged in child care exercising special
parental authority inflict corporal punishment upon
the child. (n)
Code of Ethics for Professional Teachers
Art. VIII
Sec. 2 A teacher shall recognize that the interest and
welfare of learners are of first and foremost concern,
and shall deal justifiably and impartially with each of
them.
Sec. 8 A teacher shall not inflict corporal punishment
on offending learners nor make deductions from their
scholastic ratings as a punishment for acts which are
clearly not manifestation of poor scholarship
WHY ARE THERE VARIOUS LAWS
TO PROTECT SCHOOL CHILDREN?

• VULNERABILITY OF CHILDREN:
– Children are incapable of fully protecting
themselves.

• ADDRESS A WRONG PRACTICE:


– Most children grow up doing the same thing their
parent were doing.
– Most teachers teach the way their teachers taught
and treated them.

–“Cycle of Abuse”
• FOR THE STATE TO KEEP UP WITH ITS
MANDATE
-It is the obligation of the State to protect its
children.
-Law provides penalties for perpetrators.

• Crafted as a pro-active response of DepEd to
Reports of Bullying and Child Abuse.
• Creation of a forum to address child abuse and
Bullying in schools.
• Protect PUBLIC & PRIVATE SCHOOL STUDENT
• Protect TEACHERS from Being the Subject of
Complaints
SALIENT FEATURES OF THE DEPED
CHILD PROTECTION POLICY
FORMS OF CHILD ABUSE:
1. PHYSICAL ABUSE: Any act that inflict bodily
or Physical Harm.
- Most common form of Child Abuse
-Often viewed as child discipline in schools
-Boxing, Kicking, Slapping, Spanking etc…
2. SEXUAL ABUSE
• Includes:
a. Rape, Sexual Harassment, Acts of
Lasciviousness, Making demeaning and sexually
suggestive remarks, Physically attacking sexual
parts

b. Forcing a child to watch obscene publication


and shows
Sexual Harassment (CSC)
• Is an act, or a series of act, involving any

Unwelcome sexual advance;

Request or demand for a sexual favor;

Other verbal or physical behavior of a sexual


nature.
WHERE COMMITTED:
• Workplace or Office or the school or training
institution;

• Any place where the parties were found as a


result of work or education or training
responsibilities or relations;

• Work or education or training-related social


functions;
• Official business outside the office or school or
training institution or during travel;

• Official conference, for a, symposia or training


sessions; or

• Telephone, cellular phone, fax machine or


electronic mail.
HOW COMMITTED:

1. Unwanted touching of private parts of


the body

2. Sexual assault;

3. Malicious touching;

4. Requesting sexual favor in exchange


of…….;
5. Unwanted touching or brushing against a
victim’s body;
6. Pinching not falling under grave offenses;

7. Derogatory or degrading remarks ;


8. Verbal abuse with sexual overtones;
9. Surreptitiously looking or staring a look of a person’s
private part or worn undergarments;
10. Telling sexist/smutty jokes or sending these though
text, electronic mail or other similar means;

11. Malicious leering or ogling;


12. The display of sexually offensive pictures, materials;

13. Unwelcome inquires or comments about a person’s sex


life;

14. Unwelcome sexual flirtation, advances, propositions;

15. Making offensive hand or body gestures;

16. Persistent unwanted attention with sexual overtones;

17. Unwelcome phone calls with sexual overtones


casing discomfort, embarrassment, offense or insult to
the receiver;
3. PSYCHOLOGICAL ABUSE:
-Causing mental and emotional suffering.
Includes:
-Intimidation, Harassment, Stalking, Damage to
property, Public Ridicule, Threat of Deduction of grade
as a form of punishment and Repeated verbal abuse.
-Any kind of punishment or penalty
-carried out or inflicted
-for the purpose of discipline, training or control
-by a teacher, school administrator, an adult, or
any other child who has been given or has assumed
authority or responsibility for punishment or
discipline.
CORPORAL PUNISHMENT
Punishment or Penalty Includes
Any of the Following:
1. Infliction of Bodily Harm
eg: beating, slapping, kicking, whipping
2. Forcing a child to perform painful or damaging
acts
eg: Holding weights, kneeling on stones
3. Deprivation of a child’s physical need/s
4. Tying up a child
5. Deliberate exposure of a child to fire, ice,
water, smoke, pepper, rain, sunlight.
6. Forcing a child to swallow any substance that
causes discomfort or poses danger to a child’s
health
7. Confinement of a child/ Deprivation of liberty
8. Verbal abuse and assaults
9. Forcing a child to wear a sign, undress of to
put a child in a in situations that make them
feel foolish or embarrassed in front of others
10. Permanent confiscation of a child’s personal
property, EXCEPT if such property poses
danger to the child or to others.

11. Other analogous cases.

1. File complaint with School Head/D.O./R.O.

2. School Head shall immediately Report the same to


the Division Office.

Development Office (LSWDO) or Children and
Women’s Desk

DEPED ANTI-BULLYING
POLICY
BULLYING ACT:
Elements: if one is not present, there is no
bullying
1. Act is -severe or repeated
-written, verbal, physical or electronic

2. Act is done by a student vs. student


3. Act causes either of the following:

–Causes reasonable fear of physical,


emotional or damage to property;
–Creates a hostile environment;
WHERE PROHIBITTED:

1. School Grounds
2. Places adjacent to the School;
3. Places where school activities are held;
4. School Bus Stops;
5. School Bus or Vehicles;
6. Web/ Internet
CHARACTERISTICS
• Committed by a student/s
against a co-student/s;
• Willful and Aggressive
Behavior
• Victim is out-numbered,
younger, weak, disabled,
less confident or
vulnerable.
Bullying Act Includes:
• Threats to inflict a wrong;

PROCEDURES IN HANDLING BULLYING CASES:
A. BULLYING:
1. Report to School Head;

-Anonymous complaints should


be entertained.
-Public schools are not allowed to
refer the issue to the Barangay Officials
for settlement.

2. Any school personnel should:


Stop the Bullying Immediately.
-Separate/Remove the victim/bully in the site
-Attend to the medical needs
-Bring Bully to Guidance Office or point
person
3. School Head INFORMS THE PARENTS OF THE
INCIDENT and the steps to be done in the
investigation and actions to avoid further
bullying

4. SET MEETING WITH PARENTS


FOR THE INVESTIGATION;

5. REFERRAL OF VICTIM OR OFFENDER TO CPC-ABC


for intervention
-Determine interventions to be done.
6. FACT FINDING AND DOCUMENTATION
-Separate interview with parties;
-should be with the Parents
-Students/Parents should be given
opportunity to give written comments
7. IMPOSE APPLICABLE PENALTY ON THE BULLY:
-Depends on the gravity of the act.
-Written Reprimand, Community Service, Suspension,
Exclusion or Expulsion
-Decision Should be in Writing
(Note: All must be in writing for records purposes.)
B. In Case of Serious Physical Injuries or Death

- Same Step as in Bullying

-You MAY report to the Local Social Welfare


and Development Office (LSWDO) or Children
and Women’s Desk

-Make an Immediate Incident Report to the


concerned Division Office

with the Division Office after its investigation;
5. IMPOSE THE APPROPRIATE SANCTION against the
erring STUDENT, as the case maybe.

4. Parent Representative
5. Student Representative (Senior)
6. Representative from the Community (place of billeting)
as designated by the Punong Barangay, preferably from
the BCPC.
FUNCTIONS OF CPC or ABC:
1. Draft Palaro Child Protection Policy and Anti-Bullying
Policy with Code of Conduct.

2. Identify, Refer and Report to Appropriate Offices cases


involving child abuse and Bullying.

3. Giving Assistance to Parents/Guardians in case of


abuse or bullying.

4. Initiate information dissemination programs for the


protection of children during palaro;
5. Ensure that the children’s right to be heard
are respected and upheld in all matters and
procedures affecting their welfare.

6. Provide Counseling and Intervention


Program to Victims or Offenders in Bullying
and Peer abuse cases

7. May Refer the Abuser/Victim/Bully to the


WOMEN AND CHILD PROTECTION UNIT
