Vale Moçambique: Curral para 100 bois e 600 mil meticais para cada criador?

Há um estado emocional muito forte nos criadores de gado bovino
do perímetro da concessão mineira em Catete, no distrito de Moati-
ze. É que desde a primeira metade de Setembro último, está a circu-
lar uma informação segundo a qual a empresa de mineração Vale
Moçambique vai construir numa zona de escolha de cada criador,
um curral com capacidade para 100 cabeças de gado bovino, ou
seja, um curral para 100 bois e oferecer para cada criador. E como se
isto não bastasse, a Vale Moçambique é citada como tendo prometi-
do a cada criador de Catete, um valor de 600 mil meticais como
compensação por este acto. É um acto de compensação por perda
de suas terras de pasto e que visa reparar outros danos tidos por
passíveis de compensação.
Ora, se verdade ou não, o certo é que essa informação está a provo-
car alvoroço e ansiedade nos criadores de Catete, Bagamoio entre
outros bairros inseridos na concessão mineira da Vale, no distrito
de Moatize que acreditam que tem direito a um curral gratuito para
100 bois e 600 mil meticais de compensação. Em jeito de auxílio, a
Associação de Apoio e Assistência Jurídica as Comunidades que
está enredada com esta informação, entende que ainda que certa,
não deveria ter sido partilhada com os possíveis beneficiários, antes
da finalização da elaboração dos termos de referência e até contra-
tual sobre a matéria. Porque é sensível prometer soluções e benes-
ses a quem anda já há muito tempo disso a procura, a Vale se é que
disse isso, deveria ter sido mais cautelosa no tempo do anúncio. Em
outras palavras, foi muito cedo ter dado a conhecer uma provável
oferta de um curral para 100 bois e 600 mil meticais, porque a ansie-
dade de um povo é muito forte quando há promessas de dinheiro.
Pelo sim ou pelo não, estão a morrer bois em Moatize por limitação
de pasto. E os criadores já apontam a Vale como principal responsá-
vel desta situação, porque vedou as áreas de pasto com promessas
até aqui não cumpridas. E como não deve constituir dúvida para
ninguém que no interior da concessão mineira não há lugar pastar
gado, ainda que haja muito pasto e até com qualidade e nutrientes
necessários para o gado. Também não se deve pastar gado no inte-
rior da concessão mineira. E conscientes deste quadro, está a consul-
ta e o consentimento livre, prévio e informado, contemplados na
Convenção no 169 da OIT e na Declaração das Nações Unidas sobre
os Direitos dos Povos locais.
São direitos de participação, de consulta e de consentimento livre,
prévio e informado, também considerados verdadeiros princípios
fundamentais da Convenção n. 169 da OIT. Neles se encontra o cer-
ne, a nosso ver, do diálogo intercultural proposto por este documen-
to internacional para a protecção dos direitos dos povos locais, sendo
que já tivemos a oportunidade de analisar, tanto no plano teórico
quanto no plano prático, seus méritos e limitações, sobretudo no
tocante à aplicação de tais princípios em Tete. Porém, compartilha-
mos aqui o entendimento segundo o qual a “consulta” e o
“Consentimento Livre, Prévio e Informado podem ser considerados
espécies do “processo participativo” mas não se confundem com a
mera participação e que, no âmbito da Convenção n. 169 da OIT, são
utilizados indistintamente ou mesmo como designações de fases de
um mesmo, cujo momento culminante é a obtenção do consentimen-
to propriamente dito, de forma livre, prévia e informada.

Quem deve consultar?

Vale Moçambique: Corral for 100 oxen and 600 thousand meticals for each breeder?

There is a very strong emotional state in the cattle ranchers on the
perimeter of the mining concession in Catete, Moatize District. Since
the first half of last September, information is circulating that the
mining company Vale Moçambique will build in a zone of choice for
each farmer, a corral with capacity for 100 head of cattle, that is, a
corral for 100 oxen and offer to each breeder. And as if that were not
enough, Vale Moçambique is quoted as having promised to each
Catete breeder a value of 600,000 meticais as compensation for this
act. It is an act of compensation for the loss of your pasture land and
is intended to repair other compensable damages.
For yes or no, oxen are dying in Moatize for pasture limitation. And
the breeders already point to Vale as the main responsible for this
situation, because it has closed the pasture areas with promises not
fulfilled so far. And as it should be no doubt to anyone that within
the mining concession there is no place to graze cattle, even though
there is much pasture and even with quality and nutrients needed
for cattle. Nor should cattle be grazed within the mining concession.
Conscious of this framework is the free, prior and informed consul-
tation and consent provided for OIT Convention n. 169 and the
United Nations Declaration on the Rights of Local Peoples.

Whether or not it is true, this information is causing excitement and
anxiety among the breeders of Catete, Bagamoio and other neighbor-
hoods in Vale's mining concession in the Moatize district who be-
lieve they are entitled to a free corral for 100 oxen and 600,000 meti-
cals of compensation. By way of assistance, the Association for Sup-
port and Legal Assistance Community, which is entangled with this
information, believes that, although certain, it should not have been
shared with potential beneficiaries before the finalization of the
terms of reference and even contractual school subjects. Because it is
sensible to promise solutions and benefits to those who have been
looking for it for a long time, Vale, if so, should have been more
cautious at the time of the announcement. In other words, it was
very early to have made known a likely offer of a corral for 100 oxen
and 600,000 meticais, because the anxiety of a people is very strong
when there are promises of money.
These are rights of participation, consultation and free, prior and
informed consent, also considered as true fundamental principles of
Convention no. 169 of the OIT. In them lies the heartwood, in our
view, the intercultural dialogue proposed by this international docu-
ment for the protection of the rights of local peoples, and we have
already had the opportunity to analyze both its theoretical and prac-
tical merits and limitations, particularly as regards the application of
such principles in Tete.
However, we share here the understanding that “consultation” and
“Free, Prior and Informed Consent” can be considered as species of
the “participatory process” but are not confused with mere partici-
pation and that, under Convention no. 169 of the ILO, are used in-
terchangeably or even as phase designations, the culmination of
which is the obtaining of consent itself, in a free, prior and informed
manner.

Who should consult?

tions to be held on the basis of Convention no. 169 shall be
carried out in “good faith and in a manner appropriate to the
