MOTION TO DISMISS

COMES NOW, undersigned counsel, and unto this

Honorable Court, most respectfully states:

That the above-named accused was charged for the crime of

Slight Physical Injuries, as captioned above;

That undersigned would like to inform the Honorable Court

that accused, JUAN AGUSTO DOE, already passed away last
AUGUST 10, 2018, at KALABASA, AURORA, ISABELA, such
information was confirmed and verified by the undersigned,
as evidenced by his duly Authenticated Certificate of Death
hereto attached for reference;

That in view of the foregoing, undersigned respectfully prays

that the case of Slight Physical Injuries filed against accused,
JUAN AGUSTO DOE, be DISMISSED;

WHEREFORE, it is respectfully prayed to the Honorable

Court that the case filed against the late JUAN AGUSTO DOE, be
dismissed.

Other relief just and equitable under the premises is also

prayed for.
