    0133 Nicholas Neil JUKES STATES | am the General Manager, Operations, of Thiess Contractor Ply Ltd, and am currenty based in Brisbane Queensland. ‘As General Manager, | have access to all of the records ofthis company. Between 1985 and the end of December 1991 I was employed as State Manager, Thiess Contractors Ply Ltd, Wester Australia Thiess Contractors Ply Lid (Thies) is an Australia wide Engineering and Construction ‘company. During 1991 as Stale Managor of Thiess, | was directly involved in negotiations with both the West Australian Government and the Department of Marine and Harbours regarding the Dawesville Channel Project. This project was for tho building of the Dawosville Channel and the Bridge crossing that channel at Dawesville, located South of ‘Mandurah in Western Australia, ‘AS a result of these negotiations, contracts to carry out the engineering and construction ‘work at that location were signed at the end of Op purreusoce ‘Statement of Nicholas Noll JUKES ‘continued Tries directly employed workers as plant ‘operators, the majority of whom are members ofthe Australian Workers Union (AWU). In late 1991 as Stale Manager, | had discussions with Bruce WILSON who was at the time, Branch Secretary of the Australian Workers Union (Western Australian Branch) (the AWU) in ‘elation to seeking the assistance of the AWU to adopt a workplace roform model at Dawesville, ‘The workplace reform model evolved from the Gilles Royal Commission In Sydney NSW In felation to the Building Industry, where Thies had set up workplace reform sites with the Construction, Forestry, Mining and Energy Workers Union (CFMEU), ‘As State Manager of Thiess, | had a number of dealings with Bruce WILSON in regards to other construction matters here in Western Australia. Thies sought the assistance of the AWU in implementing a workplace reform agreement at Dawesvill, in conjunction with the Building fand Construction Industry Training Council (ecrTe) : J) pr ‘Statement of Nicholas Nell JUKES. ‘continued, 1 recall reaching an agreement with Bruce WILSON In regards to the provision of a workplace reform agreement at Dawesvile Prior to my transferring from Perth to Brisbane intate 1991. ‘As a result of those discussions, Thies agreed to fund the cost of an AWU Tepresentative to assist the company Implement the workplace reform agreement at Dawesvile, It was agroed that Thiess would pay for an AWU representative to be available for a ‘maximum of 54 hours per week at a cost of {$36.00 por hour. twas also agreed between myself, on behalf fof Thiess, and WILSON that the accounts relating to the payment of that money would be submitted on a monthly basis for payment. ‘This agreement was formalised in a letter that | drafted in Queensland that was faxed to our Perth Office and signed off by Mr Joe TRIO the thon Western Australian State Manager. : iy ® ‘Statement of Nicholas Nell JUKES continued ‘The letter dated the 16 March 1982 is actully addressed to the Secretary, Austratan Workers Union Workplace Reform Association, PO BOX 255 Northbrigge Wester Australia, Attention R. BLEWITT. BLEWITT was at the time the AWU Branch Assistant Secretary and was Involved in the discussion of the implementation of the Dawesville workplace reform agreement with Me TRIO. ‘Atthough it was referred to in that letter that we would be pleased to second on a full tine basis a representative of his Association to co- ordinate and liaise with our Senior Management and Site Management at It was understood that the representative would be required both on site ‘and here in Perth to laise withthe BCITF. In order that the implementation of the workplace reform agreement go ahead at Dawesville, | recall speaking with Joe TRIO early in 1992 and him advising me that the AWU were forming the AWU Workplace Reform Association (the AWU-WPRA) to handle the reform agreement. . i. ‘Statement of Nicholas Nell JUKES. ‘continued How the AWU structured their organisation to implement the agreement from their Perspective meant nothing to us at Thiess, we ‘were more interested in seeing that AWU ‘support was provided to the project. ‘Work commenced at the Dawesvill site early 1992, Brian PULHAM was the Project Manager at Dawesville. ‘The Project Manager is responsible for the overall day to day operations on site, Records show that on the 9th April 1982, Mr PULHAM completed a Thiess Purchase Order number 410373 The Job Number on the Purchase Order was recorded as 1081, Job ‘Acct 0900 for the provision of services in Matters relating to workplace reiorm, site ‘safoty and oporator training as proviously foutined in my letter dated the 16th March 1992. The letter was formalising the verbal agreement | made on behalf of Thiess, however the Purchase Order is necessary for the formalising of any further payments on ehait of the Company to the Australian - Oh N Statoment of Nicholes Nell JUKES continued Workers Union Workplace Reform Association Inc, Post Office Box 259, Northbridge WA 666. Records show that the Purchase Order has been raised as a result of Mr PULHAM receiving an invoice, number 0001 and due on the 30th Apit 1992. The invoice is styled the Australian Workers Union, Workplace Reform Association Inc and Is for the total amount of $24,272.00. ‘This represents payment of the provision of the AW (the AWU-WPRA) representative at Dawesvile for the months of January, February and March of 1982. The breakdown of the Invoice shows. that ‘January was for the amount of 248.4 hours, February was for the amount of 216.0 hours ‘and March was for the amount 237.6 hours, representing tho amount of $25,272.00 at ‘$36.00 per hour. The invoice Is signed by Ralph BLEWITT, Secretary ‘As a result of that invoice being received by Thiess, an account payable voucher was raised on the 30th April 1892 for he amount of .
