WITH ALL DUE RESPECT TO THE HONORABLE COURT.

Accused has until 20 October 2019 to file its comments/opposition to the

Prosecution’s Formal Offer of Evidence but said day is a Sunday, hence, the filing is the
next working day which is 21 October 2019. The filing of the comment/objection is
timely.

ACCUSED by the undersigned counsel and unto this Honorable Court, most
respectfully comments and/or objects to the admission of the Prosecution’s Formal Offer
of Evidence as follows:

The ACCUSED further objects to the purpose of the offer as follows:

“A” Affidavit of Ms. Lim dated 04 The Accused objects to the purposes of the
May 2017 offer said statements or allegations are self-
serving, mere conclusion of law and the same
are not supported by records.

“A-1” Signature of Ms. Doreen T. De The accused admits the existence of the
Leon Sinumpaang Salaysay and the signature
thereto.

“B” to “B-6 Attachment to the Sinumpaang
Salaysay of Ms.Lim
The accused objects to the purpose, Tan did
not testify before the Honorable Court to affirm
the conversation between her and Ms. Lim,
thus considered as hearsay, she was not
subjected to cross examination by the defense
counsel thus violates the constitutional right of
the accused of confrontation/cross
examination.

These attachment is likewise inadmissible

as evidence due to the reason that it was
never identified by Ms. Tan

RELIEF

WHEREFORE, Accused most respectfully prays to this Honorable Court that the
foregoing object and documentary exhibits mentioned above be denied admission for
the reasons above stated. The Accused further prays for such other relief as may be
just and equitable under the premises.
