 RESUMEN

La investigación tuvo como problema: ¿Cuál es la Calidad de Sentencia en Primera y Segunda

Instancia de Procesos Concluidos en los Distritos Judiciales del Perú, sobre el Delito de Hurto

Agravado en el Expediente N° 00297-2016-0-0207-JR-PE-01; Juzgado Penal Unipersonal

Transitorio-Huaylas, Perú 2019?, el objetivo fue determinar la calidad de las sentencias en estudio.

Es de tipo, cuantitativo cualitativo, nivel exploratorio descriptivo, y diseño no experimental,

retrospectivo y transversal. La unidad de análisis fue un expediente judicial, seleccionado mediante

muestreo por conveniencia; para recolectar los datos se utilizaron las técnicas de la observación y

el análisis de contenido; y como instrumento una lista de cotejo, validado mediante juicio de

expertos. Los resultados revelaron que la calidad de la parte expositiva, considerativa y resolutiva,

pertenecientes a: la sentencia de primera instancia fue de rango: muy alta, muy alta y muy alta;

mientras que, de la sentencia de segunda instancia fue de rango: mediana, muy alta y muy alta. Se

concluyó, que la calidad de ambas sentencias, fueron de rango muy alta calidad, respectivamente.

 ABSTRAC

The investigation had as problem: What is the Quality of Judgment in the First and Second Instance

of Processes Concluded in the Judicial Districts of Peru, on the Crime of Aggravated Theft in File

No. 00297-2016-0-0207-JR-PE -01; Transitional Single-Criminal Court-Huaylas, Peru 2019 ?, the

objective was to determine the quality of the sentences under study. It is of type, qualitative

quantitative, descriptive exploratory level, and non-experimental, retrospective and transversal

design. The unit of analysis was a judicial file, selected by convenience sampling; the techniques

of observation and content analysis were used to collect the data; and as an instrument a checklist,

validated by expert judgment. The results revealed that the quality of the exhibition part, considered

and decisive, pertaining to: the judgment of first instance was of rank: very high, very high and

very high; while, of the second instance sentence was of rank: medium, very high and very high.

It was concluded that the quality of both sentences were of a very high quality, respectively.
