RELIGIOUS LAWS AND RELIGIOUS CRIMES

CHAPTER-1
Introduction
What is religious laws- religious law refer to ethical and
moral codes taught by religious tradition. Examples-
include canon law which is Christian church law,
customary HALAKHA “the” Swedish law, Hindu law and
the above mentioned Sharia or Islamic law.
What do you mean by religious offence/crime?
Means any action which offends religious sensibility and
arouses serious negative emotion in people with strong
belief and which is usually associated with an orthodox
response to, or correction of sin.
Secularism is an integral part of India freedom of all
religion is a fundamental right provided to all the citizen of
India. Religion is the most important aspect of all most
every Indian, not only but most of the world’s population
consider as there important aspect. The Indian constitution
and the many other laws states about the protection of
religious belief but it filled to provide the punishment for
people who misuse those laws religion is sensitive ectopic it
not only involves moral of a person but also the emotion
and upbringing of an individual.
Any betterment comes when the flaws are accepted and
rectified. In case of religion any flaws is suggested it is
viewed in negative aspect all around the world believe India
is divine Place , so does the Indians but there are many
Flaws that happening around us, we fail to notice or
neglect those flaws for mistakes.
The truth to be told in India there are certain religious
crimes are taken easily and accepting those crimes are
taken easily and accepting those crimes is very casual
nowadays. Violence in the name of religion is becoming
part of daily activity suppressing the minorities and hate
crimes in India is also increase. In the 21st Century
technology development amusing us still now are doing
hate cyber crimes in social media is based on girls, politics
and religion. The today’s youth has concentrate on the
religion law and crimes to accept the flaws and get better
bring unity among the people.
CONSTITUTION OF INDIA
India is a developing country and secular state.

 In context of secularism, India follows the positive


content of secularism. The Indian constitution
embodies the positive concept of secularism and has
not accepted the American doctrine of secularism ie
the concept of erecting a wall of separation between
religion and state; the the concepts of positive
secularism separates spire thallium with individual
faith. The state is neither anti-religion. In the matter of
religion equally.
There , art 250 under the constitution of India
guarantees to every person the freedom of conscience
and right is subject t public order , morality and
health and to the other provisions of part III of the
constitution

Definition and meaning of religion
TYPES OF RELIGION
Religion is very diverse categorizing religion is very difficult,
and the results are always inadequate, because we are
combining the problems of comparing cultural
understanding, differing word uses, and differing historical
appreciations of key terms, the very concept of religion has
proven difficult to define.
LIST OF SOME MAIN AND IMPORTANT RELIGION-
1 Agnosticism god- atheist/ monotheist
2 Amish peaceful Christian /monotheist
3 Ancestor worship
4 Atheism- a form of belief, rather than a specific system./

5 Brahma kumara- this group is preparing to rule the
world after a coming apocalypse and embrace many
practices which are now called new stage
6 Buddhism – A world religion. The belief that meditation
and good living can break the cycle of rain carnation and
result in enlightenment.
7 Christianity = Monotheist A – world religion belief that a
single creator god had a son a son, Jesus Christ, born to a
human mother, and that Jesus crucifixion by the Romans
bring salvation
8 Concerned Christians – fundamentalist Christians active
in USA Israel and Greece who expected the end of the world
in year 2000, starting with a nuclear attack on USA, which
they appeared to be trying to instigate themselves theist
9 Hinduism- Polytheist- A world religion cultural religion of
India which was historically decentralized and disparate
and not a single belief system western influence made in
into a single religion, an identity which now accept
10 ISLAM- A world religion strict monotheism taught by
Muhammad, the world second largest religion. – belive in
Quran and Hadiths
11 JAINISM- A world religion beliefs include non- violence
and equality of all living things. Atheist
12 HUMANISM –An organized from of atheism where
normal and ethical goodness is emphasized atheist
And many more religions are recognized in various parts of
the world which are not countable

MOB LYNCHING
Meaning – lynching is a premeditated extrajudicial killing
by group. It is most often used to characterize informal
public execution by a mob in order to publish an alleged
transgressor, convicted transgressor or to intimidate a
group
Or
A lynch mob is an angry crowd of people who want to kill
someone without a trial, because they believe that person
has committed a crime.

SCENARIO IN INDIA

Current scenario-16 cases of lynching have been reported


in two months.
22 people have been killed in incidence of lynching.
Police blame rumors mongering on social media for
lynching.
July 1st Maharashtra-5 people killed by villagers in
Maharashtra’s Dhule district were suspected to be part of
a gang of child lifters.
June 28th -29th- Tripura-3 separate lynching case were
reported.
June 26th- Gujrat-A 40 year old women was beaten to
death by a mob suspicions of being child lifter.
June 19th- Uttar Pradesh- A man was lynched in HAPUR
district of UTTAR PRADESH following rumors of cow
slaughter.

PAST SCENARIO- 2015 Dadri Mob Lynching (Mobbed


Muslim Man for cow slaughter on the basis of rumors).

 India struggles with religious lynchings.

CHAPTER -5
Suggestion
1. The S.C. Issues notices to the center, NATIONAL
HUMAN RIGHTS COMMISSIONS AND STATE
GOVERNMENTS on a plea seeking implementation of
the apex courts 2018 guidelines to prevent incidents of
mob lynching.
2. “Jai Shree Ram” was being reduced to a “Provocative
war cry” that’s leads to law and order problems, and
lynching’s take place in its name.
