DEED OF SALE / TRANSFER OF POSSESSION WITH WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Sale / Transfer of Possession with Waiver of Rights


(“Agreement”) is made and entered into by and between:

EMILY N. LIBO-ON, of legal age, Filipino, widowed, and a


resident of Brgy. Kirayan Tacas, Miagao, Iloilo, hereinafter
referred to as the “FIRST PARTY”

-and-

CECELIA N. NUÑEZA, of legal age, Filipino, married to


Romeo Nuñeza, and a resident of San Jose, Antique,
hereinafter referred to as “SECOND PARTY.”

WITNESSETH: That:

WHEREAS, the FIRST PARTY is the registered and lawful owner and
possessor of Unit 17, BLISS Project, located at Brgy. Kirayan Tacas, Miagao,
Iloilo. Said property consists of Three Hundred Fifty (350) square meters
(“subject property”).

WHEREAS, the SECOND PARTY offered to purchase the subject


property from the FIRST PARTY, and the FIRST PARTY agreed to sell the same
under certain terms and conditions stipulated hereunder;

NOW THEREFORE, for and in consideration of the foregoing premises


and the consideration in the total amount of ONE HUNDRED EIGHTY
THOUSAND PESOS (P180,000.00), Philippine Currency, receipt of which the
FIRST PARTY acknowledges to its full satisfaction, the FIRST PARTY, hereby
transfers, assigns, conveys and waives, as she hereby transfers, assigns, conveys
and waives, the subject property to the SECOND PARTY, her heirs, successors,
and assigns, free and clear of any and all liens and encumbrances whatsoever;

The FIRST PARTY hereby warrants title, ownership, and possession over
the aforesaid subject property, with right to dispose of the same, free from all
liens; and

The FIRST PARTY further represents and warrants that (i) she has full
power, legal capacity and authority to transfer, assign, transfer and waive the
subject property, (ii) the subject property is free from all liens and encumbrances
of any nature whatsoever, registered or unregistered, and is not occupied by
other persons or parties, whether authorized or unauthorized, and (iii) the
SECOND PARTY shall acquire safe and valid title to the subject property.

Possession to the subject property shall be delivered by the FIRST PARTY


to the SECOND PARTY after three months from full payment of the total
consideration.

This Agreement may be signed in two or more counterparts, each of


which, when executed and together, constitute one and the same agreement.
IN WITNESS WHEREOF, the parties herein have affixed their signatures
on the date and at the place indicated below.

they acknowledged to me that the same is their own free and voluntary act and
deed.

This contract, which relates to a sale or transfer of possession with waiver


of rights of a house and lot located in a BLISS project, consists of two (2) pages,
including this page where the acknowledgement was written, was signed by the
parties and their witnesses on each and every page thereof.
