Midterm Examinations
October 9, 2019

I. General Instructions

Please read and follow all instructions carefully. Legal researchers must always read
closely. Every word is important.

Do not write your name or student number on the examination booklet. It should be
numbered and coded in coordination with the Business Office. Your answers should be
from printed legal research materials only. Any answers from the Internet or other
electronic source will cause the student to get an automatic grade of 5.0 in the
midterms. Sharing of answers, cheating, copying, or plagiarizing in any form will not be
tolerated. Cite your sources well so that I will know that you did your own research and
not relied on other people’s work.

I have extended the deadline to give you more time to do the legwork for this exam.
Submission of exam booklets to me will be during class on October 23, Wednesday, at
6 pm.

II. You must choose between these two topics before answering this exam:

A. Preservation of Historical or Cultural Heritage OR


B. Coordination between the Five Pillars of Justice (Justice Sector Coordination)

You have been hired by a government agency for your legal research skills as a
consultant to help them draft a bill regarding your chosen topic. You must provide
them the following materials:

1. Ordinance or Resolution

Go to your local sanggunian. It could be your barangay, lalawigan


(province), or lungsod (city). Find an ordinance or resolution pertaining to
your CHOSEN TOPIC (A or B) and provide a summary here of its:

a) Full title, (1 pt.)


b) Date, (1 pt.)
c) Contents, (6 pts.)
d) Publication (1 pt.), and
e) Effectivity (1 pt.).
f) How was historical or cultural heritage protected by the ordinance? OR
How was coordination between and among the five pillars of justice
achieved? (5 pts.)
g) How can this ordinance or resolution contribute to the proposed bill you
are drafting? (10 pts.)

IMPORTANT: this has to be an actual ordinance or resolution so I suggest you do this first. Attach
a photocopy of the actual ordinance or resolution to your booklet.

2. Statutes

Go to the LPU Law library or any public law library, or any private law library you
have access to. It could be a government office, another university, or a national
or local library. Look for all the LAWS passed by Congress regarding your chosen
topic (A or B). Write the following (1 point each except F and G):
a) Session Law Number
b) Full Title
c) Date of Effectivity
d) Date of Publication
e) Summary of contents (10 pts.)
f) What contribution can each law article provide to the proposed bill? (10
pts.)

3. 1987 Constitution

Look for a printed copy of the 1987 Constitution. It may be a codal or a


commentary containing the full text of the Constitution. Provide the following
information:

a) Author and/or publisher (2 pts.)


b) Year of publication (1 pt.)
c) Look for all the provisions pertaining to A) historical or cultural preservation
or B) justice sector and write them down. You should include: (i) article
number, (ii) section number, and contents of the provision. (5 pts.)
d) What contribution can these constitutional provisions provide to the bill you
are drafting? (5 pts.)

4. Administrative Issuance

a) Name ALL the government departments, agencies, and offices involved with
your chosen topic. (5 pts.)
b) Look for ONE ISSUANCE from a relevant government department, agency, or
office pertaining to your topic. You may do this research in any library or in
the government office.
c) Provide the following: (i) Title, (ii) Year of issuance, (iii) Issuing office, (iv)
Summary of contents. (10 pts.)
d) How can this administrative issuance help the proposed bill? (5 pts.)

5. Supreme Court Decision

Look for a Supreme Court decision from 2010-2019 pertaining to your chosen
topic. Submit the following information:

a) SCRA QUICK INDEX used – indicate month and/or year (2 pts.)


b) Search Words or key words used in the index (5 pts.)
c) Title of case, G.R. Number, Date, Division of the SC, Ponente (5 pts.)
d) Case Brief (10 pts.)

 Procedural History
 Statement of Facts
 Issue
 Answer
 Reasoning or Ratio Decidendi
 Holding

e) How will this case contribute to the draft bill? (5 pts.)

I expect to receive different types of ordinances, laws, and SC decisions. This is


an individual exam and not a group exam. If you have any questions, shoot me an
