Sub: Procedure/ guidelines for import of various items under Tariff Rate
Quota (TRQ).

The Directorate General of Foreign Trade, New Delhi vide its Public
Notice No.47(RE-2010)/2009-2014 dated 18.05.2011 has issued amendments
in the procedure for import of Maize(Corn) under Tariff Rate Quota
scheme. Reference is also invited to the last Public Notice no.49/2009-2014
dated 18.03.2010, where under the National Agricultural Cooperative
Marketing Federation of India Ltd., amongst others PSU's had also been
made as an eligible entity to apply for the quota of various items on behalf of
Applicants/Actual Users.

In accordance with the above cited Public Notice No.47 dated


18.05.2011, Nafed invites applications for import of Maize (Corn) under TRQ.
The application along with necessary documents may be forwarded to our
branches of the applicant’s state for further processing and submission to
the office of the Joint DGFT/DGFT.

The Applicants desirous of applying for the quota for import of Maize
(Corn) under TRQ are required to submit the following documents for
applying to Joint DGFT/DGFT for allocation of quota :-

1. Consent letter of the applicant authorizing Nafed to apply on their


behalf indicating the specific quantity for allocation of the quota
for import of Maize (Corn).

2. Non-refundable application fee in the mode of DD in favour of the


Zonal “Joint DGFT (CLA)” , payable at their local addresses @ Rs.2
per thousand of CIF value or fraction thereof with maximum
amount of Rs.1.50 Lakhs.

3. A copy of Proforma Invoice from the supplier quoting the current


international price on CIF basis on the date of making application.

4. Applicant to submit Ayaat Niryat Form No.1 & Ayaat Niryat Form
No.2B of Handbook of Procedures duly filled-in and signed as per
the latest amendments mentioned in the Public No.47 dated
18.05.2011.

5. A copy of registration certificate being the


Firm/Organisation/Company registered with the Registrar of
Companies or the concerned authorities duly attested by the
authorized signatories / partner / proprietor of the Firm /
Organization / Company as the case may be with its seal affixed.

6. A copy of registration certificate being registered with the sales


tax/VAT authorities duly attested by the authorized signatories /
partner / proprietor of the Firm / Organization / Company as the
case may be with its seal affixed thereon.

7. A copy of the PAN/TAN No. duly attested by the authorized


signatories / partner / proprietor of the Firm / Organization /
Company as the case may be with its seal affixed thereon.

8. A copy of registration certificate from the State Govt. as actual


user, if applicable, duly attested by the authorized signatories /
partner / proprietor of the Firm / Organization / Company as the
case may be with its seal affixed thereon.

9. A copy of licence of the Manufacturing unit if the imported corn is


to be processed for corn based products under Actual User
condition, duly attested by the authorized signatories / partner /
proprietor of the Firm / Organization / Company as the case may
be with its seal affixed thereon.

10. A copy of valid certificate of importer-exporter code.

11. A copy of Statement indicating the quantity imported, processed,


marketed by the actual user in the last financial year 2010-11.

12. Copies of audited balance sheet / profit & loss account together
with auditor’s report for the last 3 years. In case the applicant is
newly formed entity, their banker’s credit worthiness certificate
is to be submitted along with copy of incorporation certification
issued by concerned authority.

13. A self declaration on non-judicial stamp paper of Rs. 100/- that


the applicant who had been allocated the quota for import of
Maize (Corn) during the preceding years have not defaulted in the
matter of compliance of Actual user condition or they are not
under scrutiny by various statutory authorities including
DRI/Customs/Income-Tax etc . If yes, the details of such
violations be provided on a separate annexure alongwith the
application.

14. A separate consent letter confirming to agree to pay


Administrative Change to Nafed @ 3% of CIF value. Applicant is
also required to submit a DD towards 1% of CIF value as token of
advance Administrative Change, with the application. This advance
will be adjusted proportionately for the imported consignments
and balance 1% will not be refunded for non-performance of the
quota. Balance 2% Administrative Change of CIF value will be
payable to Nafed at the time of contracting for import by the
party.

15. Applicant to execute an unconditional and unequivocal undertaking


that they will not resort to any under invoicing/over invoicing.

The applicant would also be required to abide by the terms and


conditions of the procedures of import of Maize (corn) under TRQ laid
down by DGFT, Govt. of India from time to time.

Nafed reserves the exclusive right to accept or reject either


partially or wholly the application filed by the applicant without assigning
any reason whatsoever.

Members of the Business Committee may kindly peruse the above


and approve the guidelines / procedure for import of various items under
Tariff Rate Quota ( TRQ).
