INTRODUCTION

I Did my internship under the guidance of ASHA KHARE MAM she was an experienced person ,it boost
up my knowledge in practical work ,I had to reached at 10 am at her office,

I had provided with a task to read file and listen to grieves and disputes of people who approached to Mrs
Asha mam to fight their case, I get opportunity to help mam in searching the section realated to cases, this
practical work helps me to understand many terminologies.

Specially the land cases and criminal cases really attracts me a lot. These cases needs a real intelligence the
section applied by lawyer and the way to save their client from the trouble shows the quality of a good
lawyer.

On the very first day of my internship, I have provided with civil files including the case Aslam khan and
Afsar khan’s case after reading it first time I’m not getting the facts of the cases but later on by reading the
case twice I’m familiars what actually the case is all about, This case deals with land issues between the
parties.

After that mam give me the task to read different files such as criminal, civil, Consumar forum cases, this
task makes me more clear towards my practical knowledge and helped me to understand the law more
clearly,

Great experience, hearing out the people cases and seeking out a solution to their problem is the best task I
enjoyed.

BACKGROUND

Mr. ASHA KHARE started her practice since 1972,he started as assistant lawyer from mr.GN Saxena’s
office later on on 15 december 1975 he wen back to his native place panna

After that she has been working in PANNA DISTRICT COURT having the tag of most reputative and
experienced lawyer with taking all the cases of criminal, civil, service matter and revenue too.

Case 1

Aslam
khan v
afsarkhan

Aslam khan is from gunor district panna and afsar khan is his father he is the farmer ,after the death of her
wife afsar khan ,decided to get married to jyda begam ,aslam has no problem of remmariage of his father
,aslam khan decided to get share from the property so that no disputes may arise between the farther and son
in future,

Afsar is the land owner of 2738 hectre of land ,which he decided to share equally among the son and
himself,aslam so 1.369 hectre of land is divided between both. decided to build a kutch house and started
living with his wife, due to dispute between his step mom and aslam, his father told to build a house on his
shared land.

After some time due to construction of 4 line A.b road some part has been removed from both land, and
government has provided 9,46,000 money to afsar khan as the owner of the property,

Due to cleverness he didn’t registered aslam khans name during rewriting of contract.

Later on aslam told afsar to return him half of the money but aslam didn’t reply to it,and after that afsar told
him that he will hire bullies and hand over to himself.

After that aslam decided to invite all his close relative and have a discussion over the family matter, as the
result afsar decided to give 1 lakh from the compensation of 9,46,000.

Afsar khan told to give 36,400 and half of the share will be given by afsar khan so that total amount of
72800 must be sumitted in bank as the kisan credit card, afsar told from 1 lakh he has to pay Rs 36,400 ,
Aslam khan paid the full money and later on, afsar gave him the copy of the receipt.

Aslam khan want legal share in the property and he want equal share in the compensation given by the
government .

Prem singh son of kalluram arihar ,got engaged with the daughter of kallu arihar in panna,during
engagement ceremony kallu give 1 gold ornament of chain and 1 ring some fruits and sweets worth Rs 1500,
cash .

After that dispute has arisen from the side of kallu singh ,he is not happy with the engagement ,and told to
all his relatives the prem singh has mental disorder, and faces problem of mirgi he told that had polio on his
right leg.

Prem singh brought new bike from guna after his marriage on his farther’s name of 63.000 , during the
agreement of bike, prem singh father signature and name is wriiten but kallu said that is had given money
for the bike but it is not so,kallu showed his fradulant clever mind to get more money.

Kullu is asking to return 90,000 of cash from prem singh for the jewelllery that kallu has gifted during
engagement.

Such rumours is faced by the prem singh and his family member, as the result prem singh family is getting
humiliating infront of the society due to false rumours spred by kallu.

As a result kallu must be punished by the law under the section500, 406 vdp

Lalita bai married to banbari lal according to hindu marriage act ,

After the long time in marriage dispute has arisen between the couples, banbarilal is alcohol addictive and
used to beat lalitabai in addictive stage, he is the land owner of 20-25 hectres of land.

On 24.07.09 lalitabai decided to go to his maternal parents house due to dispute has gone so long and after
that lalita bai don’t want to live with banwarilal. And she want complete separation without any
compensation.

Both were agreed to divorce each other.

During his marriage time lalitabai was very badly beaten up banbarilal without any reason, lalitabai parents
were poor they can’t afford the lawyer fees and transportation fees to come court

And lalita bai remains house wife for several years so she don’t have any savings and job to afford such
heavy fees.

Banbarilal had 20-25 hectre of land and earns more than 1 lakh during harvesting season. Banbarilal must be
liable to compensate with monthly Rs of 6,000 till their divorce to lalitabai.

CASE:-

Sumer singh , rajkumar, devendra,vishvaranjeet share the piece of village before 1 years disputes have been
so long between sumer singh and rajkumar’s mother . reason of dispute is that rajkumar’s mother did wire
fencing on her land and taken some part of sumer singh also, sumer singh is unhappy to see small area of his
land. As a result dispute took place between rajkumar mother and sumer singh. Sumer singh wrote complain
against the rajkumar family but police do not react to it as a result sumer singh is helpless.

Sumer singh told vishvaveer to throw out his piller and fencing from his land ,vishveer told to put his mouth
shut otherwise he will hire all his property and throw him out from the village.

Around 10 at night sumer singh is working in the field ,then devendra ,vishvaranjeet and rajkumar come to
beat sumer singh.sumer singh is badly beaten up having injuries all over his body. After beating him badly
they left him lying on the field.

Then one of the witness shyam informed sumer brother about the incident , sumer singh brother nand gopal
come on time then filed a FIRST INFORMATION REPORT on time under section 154 CRPC.

On 6 december 2011 sumer singh is admitted in the district hospital panna to medical officer incharge
radiologic he had been referred to bupendra dhakad and examination report shows that he has severe head
teeth and leg injuries.

Rajlumar family member must be punished for the offence ,as case is more to attempt to murder.

rekha pal and maalan pal got marriage according to hindu marriage act, during 10 years of their marriage the
live happily rekha and maalan have 1 boy child and 1 girl child .maalan has a business of jewellary shop in
ajaygarh ,district panna later on he started doing seasonal farming as a side business.

He meet with a woman rachabai. Maalan had a affair with rachna bai.he started beaten up her wife , don’t
provide montly salary to rekha she is unable to bear the school fees for 2 months.

Rekha pal is unable to bear anger and extra marital affair of her husband so she want separation from her
husband.

Rekha want 6000 cash every month as the only compensation from maalan.

CASE:-

Raj kumar raghuwanshi started a hotel name raj vilas in panna. Hotel started in 14 december 2015Hotel is
mainly for marriage function .hotel is provided with specious 15 room with attached bathroom all is
provided with a heating water connection.

Rajkumar bought solar heater to boil water from ashadeep akshay shop. rajkumar bought 6 water heater all
are attached with the pipes.

During the connection within 8 days solar heater pipes got break and heating system collapse. Then a
technician was send by ashadeep akshaydeep shop owner ,solar heater gets repaired again.

Same has been repeated after 10 days, then rajkumar invited technician from other shop. He explained the
all 6 solar heater are defective, and so there is no need to repair it again and again.

Rajkumar spend 9,38,000 cash to buy solar system and spend 5000 for repairing,rajkumar want
compensation for damages and time wastage in installation of solar heater.

Or he want all new 6 pieces of solar heater for his hotel raj villas.

KAMAL JAIN

SACHIN JAIN

RIGHT NEGOTIABLE INSTRUMENT ACT SECTION 138

Kalam jain is the wholesaler and sale small quality of namkeen product to sachin jain. Sachin jain is from
panna is buys the product in bulk quantity for his shop to sell the product.

Kamal jain generally give the product to his regular customer kamal with discount as well as late payement
is allowed to sachin.

On 24 december 2014 kamal jain sold the goods on credit to sachin jain, sachin promised to return back the
money within 1 month,

On January 28 kamal asked for the amount, sachin sent a cheque of full amount payment of 34600 , on the
same day kamal went to SBI to encashed to cheque but the cheque is dishonoured and returned to kamal.

Kamal sent back the cheque and asked a new cheque from sachin, after that kamal wait for 15 days but
sachin do not reply to it and not even sent the money on either of the forms.

Kamal faces a loss of cash 34,600 and now kamal is expecting the compensation of loss of cash from,
sachin. Appropriated punishment is provided to sachin for fradulant and dishonor of cheque.

RADHESHYAM

STATE BANK OF INDIA

SECTION12 COSUMER PROTECTION ACT 1986

State bank of India from radhogarh initiated a scheme of FD. Radheshyam a consumer of the FD borrows
the FD of 1,50,000 cash an amount of 193000 must be given to radheshyam but only a amount of 1,50,000
is returned back after maturity of FD.

State bank is charging tax of 10000 which is given by the radheshyam but it is noted that state bank itself do
not pay any of the taxes then how he will charge tax.

State bank do not give any of the printed slip from the bank, they give a blank slip with no title but amount
written in it with tax.

Radheshyam filled all receipt,but during last 2 installment bank manager do not collect the TDS of any of
the installment.this shows that by fradulant manner bank manager is collecting extra TDS.

Radheshyam want his full amount of 1,93,000 cash in written from bank and extra 10000

amount of charging illegal tax.

Conclusion

I am very obliged to receive such a great task of enriching me with practical knowledge and pleasure of
making a keen interest in cases related to law, specially cases related with civil and criminal, these cases
enriched the me with curiosity to know about section, and how sections apply in such cases.

32 days internship is the great experience in my first year, it boost and enhance my thinking and caliber in
law field and helps to put a keen interest in law specially in practical field.
