This refers to Formal Letter of Demand issued to Ms. Racquel Tuazon De Leon
involving the amount of P507,362.75 as deficiency income tax for taxable year 2014.
In reply, we are protesting the said assessment / demand letter and we replead /
reiterate the contention contained in our letter-request filed with your office on
November 27, 2017 that Republic Act No. 9504 as implemented by Revenue
Regulations No. 10-2008 exempts minimum wage earners from income tax and
consequently from withholding tax on compensation. Our payroll records also show that
employees under IYA TO STORE are all minimum wage earners. It is also our firm
belief that our letter should have been merited with a reply, hence, the issuance of BIR’s
Formal Letter of Demand is premature. A copy of said letter is hereto attached for your
reference. Thus, the Formal Letter of Demand issued by the BIR on December 21,
2017 for collection of the amount of P507,362.75 based on the attached Details of
Discrepancy is of doubtful validity and therefore should be set aside for lack of merit.
