COMPLAINT
I, ROMEO A. UMAGAT, of legal age, married, and a resident of Brgy. III,
#157 Bonifacio St. Laur, Nueva Ecija, after having been duly sworn to in
accordance with law, do hereby depose and state:

1.) That I am formally filing a complaint for grave misconduct (for

committing estafa as defined and penalized under Article 315 of the
Revised Penal Code and Section 3(c) of R.A. No. 3019 or the Anti-Graft
and Corrupt Practices Act) against MR. RAMIL MIGUEL, an employee
of the City Engineering Office of the Science City of Munoz, Nueva
Ecija;

2.) That I bought a parcel of residential land covered by Original

Certificate of Title No. P-11369 owned by Engracia Antolin. The Deed
of Sale is hereto attached as Annex “A”;

3.) That on June 27, 2019, because of my desire to make less

troublesome the transfer of title to my name, I went to the City
Engineering Office of the Science City of Muñoz, Nueva Ecija to seek
assistance;

4.) That MR. RAMILO D. MIGUEL accommodated and eventually

convinced me to let him facilitate the transfer of title;

5.) That MR. RAMILO D. MIGUEL proposed that I will pay the amount of
Php 97,000.00 for payment of capital gains tax and other processing
fees. Finding the proposal reasonable, I paid the full amount and was
issued a receipt from CM Palomeno
 Surveying Office signed by the respondent. Copy of the receipt is hereto
attached as Annex “B”;

6.) That in the early part of September, 2019. I returned to the office of
MR. RAMILO D. MIGUEL to get updates regarding the transfer of title.
To my dismay, MR. RAMILO D. MIGUEL told me that there is yet no
progress;

7.) That because of my disappointment, I asked MR. RAMILO D. MIGUEL

to just return the full amount I paid him so I can personally process
the transfer. However, he told me that he cannot return the money
since it was already used. Because he was not able to do anything to
facilitate the transfer, I reiterated my demand for him to return the
money;

8.) That I have given him several oral demands but to date, he has not
returned the money;

9.) That it is clear and without doubt that MR. RAMILO D. MIGUEL has
defrauded me by misappropriating the amount I gave to him;

10.) That it is prayed of this Honorable Commission that the appropriate

case be immediately filed against MR. RAMILO D. MIGUEL for grave
misconduct.
