EXECUTIVE ORDER NO. 2018-07

EXECUTIVE ORDER REORGANIZING THE BARANGAY ECOLOGICAL

SOLID WASTE MANAGEMENT COMMITTEE (BESWMC) AND DEFINING
ITS FUNCTIONS.

WHEREAS, The Local Government Units is responsible for the implementation and enforcement of
the provisions of R.A. 9003 otherwise known as the Ecological and Solid Waste Management Act
of 2000 with in their respective jurisdictions;

WHEREAS, Section 389 (b) (9) provides that, for efficient, effective and economical governance,
the purpose of which is the general welfare of the Barangay and its inhabitants pursuant to Section
16 of the Local Government Code of 1991, the Punong Barangay shall enforce laws and
regulations relating to pollution control and protection of the environment

WHEREAS, Sections 6 and 7 of IRR of R.A. 9003 provide the creation of Barangay Solid Waste
Management Committee and its functions and responsibilities;

WHEREAS, Section 10 of R.A. No. 9003 stipulates that segregation of solid waste shall be conducted
at the barangay level specifically for biodegradable, compostable and reusable wastes;

WHEREAS, DILG MC No. 2001-38 dated April 10, 2001 provides the creation of the Ecological Solid
Waste Management Committee (ESWAC) at the barangay level;

NOW THEREFORE, I, RUBIROSA L. PABILONA, Punong Barangay of Barangay Tambunac, San

Enrique, Iloilo, by virtue of the power vested in me by law, do hereby order:

SECTION I. COMPOSITION. There is hereby created a Barangay Anti-Drug Abuse Council, which
shall be composed of the following:

SECTION II. BESWMC FUNCTIONS & OBLIGATIONS. The functions and obligations of the BADAC shall
be as follows:

a. Formulate a community solid waste management program consistent with that of the
municipality;

b. Be responsible for the segregation and collection of solid waste specifically for
biodegradable, compostable and usable waste;

c. Establish within the barangay or cluster of this barangay a Materials Recovery Facility
(MRF), a redemption eco centers in the barangay owned or leased land or any suitable
open space to be determined by the Sangguniang Barangay. The MRF shall receive
recyclable waste for final sorting, segregation, composting and recycling in an efficient
and environmentally sound manner and to be sold in bulk to buy-back center or "junk
shops". The remaining residual wastes shall be collected by the municipality; In establishing
the MRF the building and/or land layout and equipment must be designed to
accommodate efficient and safe materials processing movement, and storage.

d. Allocate funds for the barangay ecological solid waste management program, approved
by the Sangguniang Barangay;

e. The BESWMC shall organized a Core of Area/ Zone/ Purok Coordinators thru the conduct
of trainings for barangay residents on segregation, composting, recycling and livelihood
opportunities from use of recyclable waste and to monitor their implementation;

f. Integrate the Ecological Solid Waste Management program in the Barangay

Development Plan and/or Annual Investment Plan;

g. Find alternative sources of funds other than the regular barangay budget;

h. Submit monthly report to the municipal ESWMC on the progress of the program copy
furnished the local DILG office;

SECTION III. EFFECTIVITY. This Executive Order shall take effect immediately.
