It is humbly submitted that:

The Father of Indian Constitution decorated with National awards after his demise, hence no violation
of the terms and conditions of the Bharat Ratna at the level awardees, if we prefix or suffix Bharat
Ratna with his name, same points needs to be examine legally, if any hitch then Constitution can be
amended to avoid contempt of Hon'ble Supreme Court of India.

We are jointly in the opinion that if any decoration or National awards are being awarded
posthumously, that can be exempted and allowed under article 18 (1) of Indian Constitution, which is
the only solution to avoid further litigation's in relation with the functioning of Bharat Ratna Dr. Baba
Saheb Ambedkar Udyog Uday Yojana for SC / ST Entrepreneurs of MSME, which was introduced
vide Government Resolution No. MSM-102017-332-CH, Dt. 24-10-2017.
Ministry of Home Affairs intimated vide No. 24/134/2019-Public dated 8-8-2019 as under:
“In terms of the directions of the Supreme Court of India, “the National Awards do not
amount to “titles” within the meaning of Article 18(1) of the Constitution”, and they should not
be used as a suffix or prefix to the name of the recipient in any manner whatsoever.

1. Both petitioners are dedicated to the ideology of father of the Constitution & believe – faith in
his theory & philosophy.

2. Article 18 (1) of Indian Constitution defined as National awards can’t prefix as title read with
the orders passed by the Hon’ble Supreme Court of India, besides it terms and conditions of
the Bharat Ratna prohibit the misused of this decoration, keeping in view the life time
achievements and performances of a particular person in different fields.

3. There are no clarification if National awards prefixed by any other person with the name of
awardees, after his death as Govt. of Gujarat notified as Bharat Ratna Dr. Baba Saheb
Ambedkar Udyog Uday Yojana for SC / ST Entrepreneurs of MSME, which was introduced
vide Government Resolution No. MSM-102017-332-CH, Dt. 24-10-2017.

4. The Govt. of Gujarat allocated budget provisions & disburses accordingly its sanction under
the name & style of approved scheme as per Government Resolution No. MSM-102017-332-
CH, Dt. 24-10-2017.

5. The Govt. of Gujarat sanctioned assistance of capital investment subsidy, interest subsidy to
MSMEs for manufacturing and service Industries & CGTMSE fees for MSEs

Bharat Ratna Dr. Baba Saheb Ambedkar Udyog Uday Yojna for SC/ST Entrepreneurs of
MSME, introduced and passed vides Government Resolution No. MSM-102017-332-CH, Dt
24-10-2017, which is unconstitutional, contempt of Court as well, because Bharat Ratna
prefixed as title, violating abolition of title under article 18 (1) of Indian Constitution, which is
not a political tool, publicity as well.
Besides it official website of the Gujarat Commissioner of Industries, insulted State Emblem of
India, placing without Devnagiri word Satyamev Jayete, which also can be prosecuted, hence
Mrs. Sukanya Berwal, Commissioner of Education, Scouts & Guides for Animals & Birds
place this legal Notice upon the Ministry of MSME, to direct their field functionaries, to abide
Indian Constitution, keeping in view the pride and dignity, whereas till today, implementation
and budget provisions along with utilization of funds under Bharat Ratna Dr. Baba Saheb
Ambedkar Udyog Uday Yojna for SC/ST Entrepreneurs of MSME, invites Audit para, holding
responsibility of the tainted officials, withdrawing Bharat Ratna as title at once, vide
Resolution amendment, within 15 days, hereafter, to avoid unnecessary litigation. Aghishek
Kadyan with Mrs. Suman Kadyan from Canada also raised said grievances in past but

Govt. of Gujarat considering towards removal of Bharat Ratna as title, if it’s happen then sharp
reaction may begin at the part of the Society, CID reports must be obtained before taking any action.

Petitioner (s) prayers that:

1. Amendment in the article 18 (1) of the Indian Constitution, clarifying the use of National
award as title with name after the demise of awardees as posthumously.

2. Legalize the functioning of Bharat Ratna Dr. Baba Saheb Ambedkar Udyog Uday
Yojana for SC / ST Entrepreneurs of MSME, which was introduced, vide Government
Resolution No. MSM-102017-332-CH, Dt. 24-10-2017.

3. Any other orders deems fit.
