CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


This Contract of Lease, made and entered into by and between:
DELIA R. MACASO, of legal age, Filipino, married, and a resident of 140 K-4 th Street,
Kamuning, Quezon City, Philippines, (hereinafter referred to as the “LESSOR”);
-and-
_________________________, of legal age, Filipino, __________, with residential address at
________________________________________________________; (hereinafter referred to as
the “LESSEE”);
WITHNESSETH:
WHEREAS, the LESSOR is the owner of a two-bedroom apartment located at 140 K-4 th Street,
Kamuning, Quezon City.
WHEREAS, the LESSEE desire to occupy the above-named apartment and one space car
parking and the LESSOR is willing to lease the same unto the LESSEE, subject to the terms and
conditions hereinbelow set forth.

1. PURPOSES: The apartment shall be used exclusively for RESIDENTIAL PURPOSES


only and shall not be diverted to other uses.

2. TERM: The term of the lease is for ONE (1) YEAR from
______________________________________________________________.

3. RENTAL RATE: The monthly rental shall be TWENTY-THOUSAND (P20,000.00)


PHILIPPINE PESO both for the apartment and one space cark parking.

4. ADVANCE PAYMENT AND SECURITY DEPOSIT: A one-month advance, and one-


month deposit shall be given before the LESSEE can occupy the apartment and one space
car parking. The one-month advance shall serve as payment for the first month of stay,
while the two-month deposit serves as payment for the last month’s utility consumption,
i.e., electricity, water, cable, etc. which will be billed by various utility companies after
the LESSEE’ stay. Any damages to the apartment, and/or violation of the terms and
conditions stated herein shall also be shouldered by the deposit (partially or fully). The
excess in the security deposit paid, if any, shall be returned to the tenant, through their
bank account, within a month after leaving the apartment/premises or once all the utility
bills, and damages to apartment have been paid.

5. SUCCEEDING PAYMENTS: Succeeding monthly rentals shall be paid through


cash/post-dated checks, PAYABLE TO NIRVANA JOY R. MACASO, dated a month
after the LESSEE’ first day of stay, and a month thereafter, and so forth, to be given upon
contract signing. Hence, if the first day of the LESSEE’ stay is on the ______________,
the checks shall be post-dated ________________ and a month thereafter and so forth or
until __________________ pursuant to this contract.
6. SUB-LEASE: The LESSEE shall not directly or indirectly sublet, allow or permit the
leased apartment to be occupied in whole or in part by any person, and neither shall they
assign or transfer their right hereunder to any person without the LESSOR’s
consent/approval. Only the registered tenants shall occupy the apartment.
7. PUBLIC UTILITIES/FACILITIES: The payment of the utility consumption during the
duration of the lease, such as electricity, water, cable, common dues, etc. shall be for the
account of the LESSEE and NOT INCLUDED IN THE MONTHLY RENTAL RATE.
The LESSEE hereby guarantees the prompt payment of all charges heretofore mentioned
as they fall due. Any delay in the payment thereof shall constitute a material breach of
this agreement.
8. REPAIRS: The LESSEE shall, during the duration of the lease, make all minor repairs on
the leased premises to preserve the same in serviceable or tenantable conditions at the
LESSEE’ expense except replacement of parts due to natural wear and tear. The LESS
