CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made, executed and entered into by and between:

____________________________, of legal age, Filipino citizen, with


residence and postal address at
_______________________________________, hereinafter referred to
as the “LESSOR,”
- AND -
____________________________, of legal age, Filipino citizen, with
residence and postal address at
________________________________________, hereinafter referred
to as the “LESSEE.”

WITNESSETH:

WHEREAS, the LESSOR is the owner of a residential premises situated at


Unit _______________________________________________________________, a
bare/full-furnished unit consisting of _______ square meters;

WHEREAS, the LESSOR agrees to lease out the property to the LESSEE and
the LESSEE is willing to lease the same;

NOW THEREFORE, for and in consideration of the foregoing premises, the


LESSOR leases unto the LESSEE and the LESSEE hereby accepts from the LESSOR
the LEASED premises, subject to the following:

TERMS AND CONDITIONS

1. PURPOSES: The premises hereby leased shall be used exclusively


by the LESSEE for residential purposes only and shall
not be diverted to any other uses. The LESSEE shall
not allow the premises to be used for any purpose
contrary to law and public morals. It is hereby
expressly agreed that if at any time the premises is
used for other purpose(s), the LESSOR shall have the
right to rescind this contract without prejudice to his
other rights and remedies under the law.

2. TERM: This term of lease is for _______ mos. Or ______

______________________. Upon its expiration, this
lease may be renewed under such terms and
conditions as may be mutually agreed upon by both
parties. Written notice of intention to renew the lease
shall be served to the LESSOR not later than thirty
(30) days prior to the expiration date of the period
herein agreed upon. Should be LESSEE withdraw,
retract and /or renounce her intention to renew after
the LESSOR’S prior acceptance of the same not later
than thirty (30) days prior to the expiration date, the

LESSEE shall compensate the LESSOR in the sum
equivalent to two (2) month’s rental as stated in
clause 3 below in lieu of the same or the deposit sum
in stated in clause 4 below, whichever is lower.

3. RENTAL RATE: The monthly rental rate for the leased premises
shall be in the amount of

________________________. All rental payments
shall be made payable to the LESSOR for the
aforesaid sum by way of twelve _____________ post-
dated checks issued from the LESSEE’s checking
account (or from another account issued on the
LESSEE’s behalf) payable on the ____________ day
of each month (save for the month of FEBRUARY,
which is to be dated FEBRUARY 28, 2018) to be
drawn in favor of the LESSOR’s account as follows:-

To the same end, the LESSEE shall ensure that there


would be sufficient funds maintained in the checking
account prior to the clearance of the check when it is
due and payable.

In the event that any of the checks is dishonored due


to insufficiency of funds, ordered stop payment and
/or for any other reason, the LESSEE is given a
THREE (3)-day grace period to pay the monthly
rental. In case of failure to pay within the grace period,
the LESSEE is liable to pay a TEN PERCENT
(10%) penalty charge without prejudice to any further
rights and remedies available to the LESSOR.

In the event of a dishonored check issued from a third


party account for and on behalf of the LESSEE for the
purposes of satisfying the rental payments and / or any
other monetary obligation arising from the lease due
to insufficiency of funds, ordered stop payment and
/or for any other reason, the LESSEE and the third
party shall be solidarily liable to the LESSOR without
prejudice to the LESSOR’S further claim for actual,
compensatory and exemplary damages. To the same
end, the LESSOR shall also ensure that the 3rd party’s
up-to-date and genuine contact particulars are
furnished to the LESSOR.

4. DEPOSIT: The LESSOR shall retain the sum of


___________________________________PESOS
(Php ___________________) or equivalent to two-

month’s deposit earlier paid by the LESSEE during
the signing of the initial LEASE CONTRACT
covering the period ___________________ to
_____________________________. The said
amount shall now serve as two-month deposit on
this renewal contract and shall be refunded to the
LESSEE Thirty (60) days after its termination less
payment of inter alia unpaid utilities such as water,
electricity, CATV, telephone, Internet charges and
for damages and any other obligation incurred during
the duration of the lease, if any. For the avoidance of
doubt, the deposit shall not be consumable towards
any advance rental payment without the express
consent of the LESSOR in writing.

5. DEFAULT PAYMENT: In case of default by the LESSEE in


the payment of the rent, the LESSOR at his option
may terminate this contract and eject the LESSEE
from the premises. The LESSOR has the right to
padlock the premises when the LESSEE is in default
of payment for One (1) Month and may forfeit
whatever rental deposit that have been given by the
LESSEE. The LESSOR further reserves his rights to
dispose of any furniture, appliance, personal
belongings and / or any other chattels left by the
LESSEE and / or to convert the same to satisfy the
outstanding due and payable as the LESSOR may
deem fit.

The TWO (2)-MONTH DEPOSIT shall be forfeited if the contract is


cancelled and / or repudiated as a result of breach by the LESSEE of any of the terms
stated is this Agreement.

6. SUB-LEASE: The LESSEE shall not directly or indirectly sublet,


allow or permit the leased premises to be occupied
in whole or in part by any person or corporation,
neither shall the LESSEE assign her rights
hereunder to any person or entity and no right of
interest thereto or therein shall be conferred on or
vested in anyone by the LESSEE without the
LESSOR’S written approval.

7. PUBLIC UTILITIES: The LESSEE shall pay for her water,


electricity, cable, CATV, telephone, Internet and
other public services and utilities during the
duration of the lease. For the avoidance of doubt, in
the event the LESSEE fails, omits or otherwise
refuse to pay the bills incurred for the item herein,
the LESSEE shall be wholly and absolutely liable to
pay the said dues without any liability whatsoever
to the LESSOR. The LESSOR hereby reserves his
rights under the law to claim the same against the
LESSEE on a full indemnity basis.

8. FORCE MAJEURE: If whole or any part of the leased premises
shall be destroyed or damaged by fire, flood,
lightning, typhoon, earthquake, storm, riot or any
unforeseen disabling cause of acts of God, as to
render the leased premises during the term
substantially unfit for use and occupation of the
LESSEE, then this lease of contract may be
terminated without compensation by the LESSOR
or by the LESSEE by notice in writing to the other.

9. LESSOR’S RIGHT OF ENTRY: The LESSOR or his


authorized agent shall, after giving due notice to the
LESSEE, have the right to enter the premises in the
presence of the LESSEE or her representative at any
reasonable hour to examine the same or make repairs
therein or for the operation and maintenance of the
building or to exhibit the leased premises to
prospective LESSEE, or for any other lawful purpose
which he may deem necessary.

10. TERMINATION OF LEASE: Either party may terminate the


Lease by giving two (2) month’s notice in writing,
with the party failing to give due notice shall
compensate the offended party in the sum equivalent
to two (2) month’s rental as stated in clause 3 above
in lieu of the same or the deposit sum in stated in
clause 4 below, whichever is lower.

11. EXPIRATION OF LEASE: At the expiration of the term of


this lease or cancellation thereof, as herein provided,
the LESSEE will promptly deliver to the LESSOR
the leased premises with all corresponding keys and
in as good and tenable condition as the same original
condition upon the original hand over, ordinary wear
and tear expected devoid of all occupants, movable
furniture, articles or effects of any kind. Non-
compliance with the terms of this clause by the
LESSEE will give the LESSOR the right, at the
latter’s option, to refuse to accept the delivery of the
premises and compel the LESSEE to pay rent
therefrom at the same rate plus TWENTY- FIVE
(25) percent thereof as penalty until the LESSEE
shall have complied with the terms thereof. The same
penalty shall be imposed in case the LESSEE fails to
leave the premises after the expiration of this
Contract of Lease or termination for any reason
whatsoever. Without prejudice to the foregoing and
for the avoidance of doubt, should the LESSEE fail
or otherwise refuse to return the premises in as a
good and tenable condition and / or otherwise as the
same original condition upon the original hand over,
the LESSOR shall be at liberty as he deems fit, to
restore and or repair the premises as necessary with

costs to be deducted from the deposit sum as stated
in clause 4 above.

12. JUDICIAL RELIEF: Should any one of the parties herein be


compelled to seek judicial relief against the other, the
losing party declared by Final Judgment, shall pay an
amount of One Hundred Percent (100%) of the
amount claimed in the complaint as attorney’s fees
in full indemnity basis but in no case be less than
Fifty Thousand Pesos (Php 50,000.00) in addition to
other cost and damages which the said party may be
entitled to under the law.

13. This CONTRACT OF LEASE shall be valid and binding


between the parties, their successors-in-interest and
assignees.
