GERD CONTE, under penalty of perjury, hereby affirms that the statements herein are

true.

1. Affiant is the mother of the alleged parole violator, Robert Conte.

2. Affiant has not given Robert any spending money in the form of cash currency since

he has returned home from prison. I do let him stay with me rent free, and I have bought him

clothes and meals because he has not yet been able to obtain a job, but I have never given him

cash spending money. Additionally, I did, while he was incarcerated use his money to pay his

bills, including his phone bill as well as some tickets that had accumulated. Since he has been

out, he has not had any bills (phone/credit card) which I have had to write checks for. When I

did pay bills for him, I used only Robert’s money (see below).

3. Robert Conte does have money of his own. He returned home with $1972.24 from his

property/commissary from when he was taken into custody. See enclosed pink receipt. This

money is what he has been living on.

4. Additionally, I have been holding money of his. The exact amount of this, with

interest included, is unclear as I have been mixing it with my own. Robert received a sizable
settlement while he was incarcerated in the amount of $10,270.00 as a result of a car accident.

See the enclosed letter. Because he was incarcerated, I received power of attorney to deposit the

settlement check into my account for safe keeping. See the enclosed power of attorney

authorization sheet. Also, I am holding the returned bail money and insurance money. I can say

that at least $15,000 in my bank account belongs to Robert.

5. There is no way that there can be any allegation that he lied about receiving money

from me. He just has not. He has his own money and has been living off of it.

6. I believe that this parole violation is retribution for my son taking on parole legally.

He has been using the ACLU to make sure that his methadone treatment was continued over the

objection of his parole officer. This action is noted in the several documents enclosed.
