MODEL RECRUITMENT CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This Recruitment Contract made this ___ day of _______________, by and


between (Name of Authorized Representative) , of legal age, single/married, with
postal address at _________________________________, a representative of
__(Name of Agency)_, with principal address at
__________________________________,hereinafter referred to as the AGENCY;

- and –

_________________________, born on _______________, single/married, with


postal address at ____________________________, hereinafter referred to as the
KASAMBAHAY, [being a minor is represented by _____________________
(indicate the Relationship) as the guardian];

WITNESSETH AND AGREED AS FOLLOWS:

1. That the AGENCY shall conduct an interview and verify the background of the
KASAMBAHAY to determine if the latter is physically fit, capable and willing to
render satisfactory service;

2. That upon agreement of the terms and conditions, the KASAMBAHAY shall
submit to the AGENCY the following documents:
a. Authentic birth certificate or if unavailable, voters identification card,
baptismal certificate or passport.
b. Medical Certificate or health certificate issued by the local government
health officer;
c. Barangay and Police Clearance
d. National Bureau of Investigation Clearance

3. That the AGENCY shall secure the best terms and conditions of employment
for the KASAMBAHAY;

4. That the AGENCY shall provide the KASAMBAHAY a pre-employment


orientation on the nature of the job, duties and responsibilities, monthly
salary, other benefits, and other terms and conditions of employment being
offered to the latter in accordance with the Implementing Rules and
Regulations of Republic Act No. 10361 or Batas Kasambahay;

5. That the AGENCY shall initially shoulder all the deployment expenses directly
used for the transfer of the KASAMBAHAY from the place of origin to the place
of work which include the following:
a. Cost of Transportation
b. Meals
c. Communication Expense
d. Other incidental expenses

Such expenses shall be charged to the employer by the agency. The employer
may recover deployment cost from the KASAMBAHAY whenever he/she leaves
without justifiable reason within six (6) months from employment.

6. That the AGENCY shall ensure that the KASAMBAHAY is not charged or
required to pay any recruitment or placement fees.

7. That the AGENCY shall accompany the KASAMBAHAY from the place of origin
to the place of the employer.

8. That in case the KASAMBAHAY is found to be not qualified to work, the


AGENCY shall contact close relative of the Kasambahay or if a minor,

accompany the KASAMBAHAY back to her residence/province at the expense


of the AGENCY, to be reimbursed by the KASAMBAHAY;

9. That the agency shall assist the kasambahay in filing his/her complaints or
grievances against the employer.

10. The terms and conditions of this contract shall not be modified or amended by
either party without the concurrence of the other party.
