E-Tender Notice No- 7/2019-20

Name of Work : Reconstruction of Bus Station with its sub work at Jejuri in Pune Division.

Following clauses are modified and same shall be adopted while submitting the tender.

1.4 ENVELOPE No. 1: (Documents Required)

e-Tender Documents shall contain Technical Bid Envelop & Financial Bid Envelop
1) TECHNICAL BID ENVELOP (Cover No.1)
a) Bidders should submit the document related to tender online only, however cost of tender
form and E.M.D. shall be paid through online payment gateway mode only, before due date and
time. & specifically note that no exemptions on account of payment of required EMD will be
allowed in MSRTC.

b) Scanned from original copy of Affidavit regarding completeness, correctness and truthfulness
of documents submitted on latest Rs. 500 /- Non Judicial Stamp Paper duly type as per
prescribed proforma given in Annexure-I, sworn before Executive Magistrate / Notary.

c) Scanned from original copy of valid GST Registration Certificate / Number.

d) Scanned from original copy of Professional Tax Certificate Number, in the name of bidder.

e) Scanned from original copy of Pan Card in the name of bidder.

f) Scanned from original copy of Latest Income Tax Return Certificate (for latest last three
financial years). If Latest Income Tax Return Certificate not available, supporting latest Tax
Audit Report duly certified by C.A. giving reasons for not submitting latest I.T. returns.

g) Scanned from original copy of Valid Solvency Certificate latest issued maximum One Year
old, Solvency Certificate of 20 % of the cost of works, issued by Nationalized /Scheduled Bank
Only. Requirement of solvency certificate,/bank cash credit certificate (issued by Nationalized
/Scheduled Bank Only), in case of Govt. Registered contractor will be decided by MSRTC.
Registration capacity will be up to tendered cost. Registration may be valid.

h) Scanned from original copy of list of similar works in hand and works tendered at present.

i) Scanned from original copy of list of similar works executed in last five years, in the name of
bidder (firm), as per prescribed proforma given in Form no.-II along with supporting certificates.
And in case of private work 100 % amount of Tender work with valuation certificate
showing name of work & amount, from Govt. Approved Registered Valuer, Architect along with
supporting documents related to work.
j) Scanned from original copy of list of plants and Machinery required for this work as per
prescribed proforma given in Form no.-III , along with supporting certificates .
k) Scanned from original copy of List of Technical Persons / Employees, as per prescribed
proforma given in Form no.-IV, along with supporting certificates.
l) Scanned from original copy of Registration of firm / Company / Partnership Firm with
supporting documents showing all partner with designation / post holding and with signature..
m) Scanned from original copy of latest Power of Attorney : If the tenderers are a firm or
company, they should in their forwarding letter (on latest non judicial bound paper) mentioning
the name of all the partners together with name of partner who holds the power of attorney
authorizing him (with signature of all partners ) to conduct all transactions on behalf of company
/ firm / body.
n) Scanned from original copy of hire agreement between machinery owner and the contractor
for hiring of required machinery on latest non-judicial bond paper (duly notarized ) for this
work.
o) Scanned from original copy of Valid Certificate of Registration under Contract Labour Act.
(R&A Act.1970) if available. if work allotted, required certificate /documents will have to be
submitted by the bidder.
p) Scanned from original copy of valid certificate as a Registered Contractor with the
Government of Maharashtra/ Central Govt. in appropriate class for the work having amount put
to tender upto Rs. 150 Lakhs.

Additional Eligibility criteria for the bidder

i) Financially sound and should have to submit the copy of list of similar works executed in last
five
years, out of which one work at least to the extent of 30 %,for amount of Tender work is 01 to 10
Crore and for amount of Tender work more than 10 Crore, 60% , in the name of bidder (firm),
along with supporting certificates.

ii) Having turn-over in terms of building construction activity for the last five years.
Turnover in last 5 year Maximium required = 75% Yearly cost of work
Yearly cost = Total cost of work
Time limit of work in years

iii) Having minimum tangible net worth at least 20% of estimated cost of project ,duly certified
by C.A.
as per the last audited balance sheet.
vi) In case of private work suporting certificate form concerned authority is essential. Necessary
certificate in case of won project will be accepted, but with commencement / occupation /
completion certificate from local authority ,supported with Valuation Report form Govt.
approved Registered Architect’s / Engineer’s / Valuer’s report. with Balance Sheet / Tax Audit
Report / Tangible Net worth /Annual Turnover duly certified by C.A.
v) Quantity Certificate: - Bidder /Contractor should submit certificate of concern authority for
whom works executed in last 5 years in single work indicating at least 30% of Major Quantities
of similar type which are required for this work.
vi) Bidders /Contractors who meet the minimum qualification criteria will be qualified only if
their available bid capacity is more than the total estimated value of works for which he has
offered his bid.
Note :- Even though the bidders meet the above qualifying criteria, they are subjected to be
disqualified if they have made misleading or false representation in the forms statement and
attachments submitted as proof of the qualification requirements and / or record of post
performance such as abandoning the works, not properly completing the contract, inordinate
delay in completion, litigation history or financial failures etc.

1.10 B. Condition for payment of additional security deposit, if offer quoted by the tenderer
is lesser
Additional Security Deposit (Performance Security) :
If the tenderer has quoted the offer below the estimated rates put to tender then the tenderer shall
have to submit Additional security Deposit (performance Security) in form of Demand Draft of
any Nationalized or Scheduled bank in favor of M.S.R.T.C. funds accounts, Pune.
The amount of the Demand Draft shall be calculated by the tenderer in accordance with the
following manner the sealed envelope mentioning name of work and name of tenderer should
have to submit as quoted in the government resolution (PWD) dated 26.11.2018.
1) If the offer below the estimated rates is up to 10% below then the amount of the demand draft
shall be of the value of 1% of the cost put to tender. (For example:- If the rates quoted is 7%
below, then the amount of Demand Draft should be 1% of the cost put to tender.)
2A)If the offer is lower than 10% below then the amount of the demand draft shall be of the
value of 1% of the cost put to tender plus the amount arrived by applying that percentage on the
cost put to tender which is difference of percentage quoted by the tenderer and 10. (For example
:- If the rates quoted is 14% below, then the amount of demand draft should be 5% i.e. 1% of the
cost put to tender plus (14 – 10) percentage of the cost put to tender).
2B) If the offer quoted by the contractor is lesser than 15% below then For remaining amount,
Double of the rate shall be paid by contractor in form of DD as Additional Performance Security.
The example is illustrated below.
Upto 10% Below Quoted offer - 1%
Upto 15% Below Quoted offer - (15%-10%=5%)
And similarly for (19-15)=4% (4x2=)8%
Hence Total (1+5+8)=14% to be paid.
3)The Demand Draft shall be valid up to 4 months from the date of submission of the tender. It
should be MICR and IFS code. After opening the envelope no. 1.
4) In case it is found that the Documents / Demand draft submitted by the tenderer are false, his
earnest money shall be forfeited to the M.S.R.T.C.. as well as his name / firms name will be
communicated to the registering authority for the suspension of registration of tederer for the
period of 1 year. In addition to the order legal action necessary to be taken as per the law.
5)The work order shall be given to the concerned tenderer after the clearance of the Demand
Draft submitted by him. The amount of' the performance security shall be refunded as per the
tender conditions, Non submission of additional security deposit / performance security or
submission of less amount of the additional security deposit shall be liable to summarily
rejection of his tender. This additional security deposit performance security shall be extendable
up to expiry of valid extensions if any and it shall be refunded, after satisfactory completion of
defect liability period of work.
