Purpose of the Generics Act

 To promote, encourage and


REQUIRE the use of generic
terminology in the importation,
manufacture, distribution, marketing,
advertising and promotion,
PRESCRIPTION and dispensing of
drugs.
Purpose of the Generics Act

 To ensure the adequate supply of


drugs with generic names at the
lowest possible cost and endeavor to
make them available free for indigent
patients;
Other Related Provisions
 Sec. 6. Who shall use generic Terminology. -
(a) All government agencies and their
personnel as well as other government
agencies shall use generic terminology or
generic names in all transactions related to
purchasing, prescribing, dispensing and
administering of all drugs and medicines.
Other Related Provisions
 (b) All medical, dental and veterinary
practitioners, including private practitioners,
shall write prescriptions using generic
name. The brand name maybe included if so
desired.
VIOLATIVE PRESCRIPTION
 Where generic name is not written.
 Where the generic name is not legible and a
brand name which is legible is written.
 Where the brand name is
indicated and instructions added (such as
the phrase "no substitution") which tend
to obstruct, hinder or prevent proper
generic dispensing.
VIOLATIVE PRESCRIPTION
 SHALL NOT BE FILLED.
 Shall be kept and reported by the
pharmacist of the drug outlet or any other
interested party to the nearest Department of
Health office for appropriate action.
 The pharmacist shall advise the prescriber
of the problem and/or instruct the customer to
get the proper prescription.
ERRONEOUS PRESCRIPTION
 Where the brand name precedes the generic
name.
 Where the generic name is the one in
parenthesis.
 Where the brand name is not in the
parenthesis.
 Where more than one drug
product is prescribed on one prescription
form.
ERRONEOUS PRESCRIPTION
 SHALL BE FILLED.
 Shall also be kept and reported by the
pharmacist of the drug outlet or any other
interested party to the nearest Department of
Health Office for appropriate action.
IMPOSSIBLE PRESCRIPTION
 When only the generic name is written but is
not legible.
 When the generic name does not
correspond to the brand name.
 When both the generic name and
the brand name are not legible.
 When the drug product prescribed is not
registered with the Bureau of Food and
Drugs.(now Food and Drugs Admn.)
IMPOSSIBLE PRESCRIPTION
 SHALL NOT BE FILLED.
 Shall be kept and reported by the
pharmacist of the drug outlet or any other
interested party to the nearest Department of
Health office for appropriate action.
 Prescriber shall be advised by the pharmacist
of the problem and/or instruct the customer to
get the proper prescription.
PENALTIES
 For the first conviction, he shall suffer the
penalty of reprimand, which shall be
officially recorded in the appropriate books
of the Professional Regulation Commission.

 The second conviction, the penalty of fine


in the amount of not less than two thousand
pesos (P2,000).
PENALTIES
 For the third conviction, the penalty of fine
in the amount of not less than five thousand
pesos (P5,000) but not exceeding ten
thousand pesos (P10,000) and suspension
of his license to practice his profession for
thirty days at the discretion of the court.
PENALTIES
 For the fourth AND subsequent
convictions, the penalty of fine not less
than ten thousand pesos (P10,000) and
suspension of his license to practice
his profession for one year or longer at the
discretion of the court.
