Ed 7: Independent Learning Activity


1. Compare and contrast Presidential decree and Republic Acts in terms of the
following:
a. Purpose
Presidential Decrees were an innovation made by President
Ferdinand E. Marcos with the proclamation of Martial Law. They
served to arrogate unto the Chief Executive the lawmaking
powers of Congress, while A Republic Act is a piece of
legislation used to create policy in order to carry out the
principles of the Constitution passed by the Congress.
b. Process
Only President Marcos issued Presidential Decrees. In the
Freedom Constitution of 1986, President Corazon C. Aquino
recognized the validity of existing Presidential Decrees unless
otherwise repealed, while Republic Act is crafted and passed by
the Congress of the Philippines and approved by the President
of Philippines. It can only be repealed by a similar act of
Congress.
c. Implementation
Presidential Decrees are implemented immediately and/or 15
days later upon publication of official gazette, while the Republic
Act must undergo readings and must be approved by the chief
executive before being implemented and be published 15-days
upon publication of official gazette.

2. Conduct a research on three landmark issues in the teaching profession


which lead to a creation of law or amendment of the same following the given
considerations:

a. Describe the issues or give a brief background about the issues or


cases
Lately, videos involving minors while committing crimes are
going viral - a 15-year-old beating to death with a piece of wood
another minor; a group of “street children” caught dragging an
old m an out of a public utility jeepney to get his purse; and
minors stealing jeepney driver’s income. Moreover, news
headlines in the recent years have the same tenor - 14-year old
boy beats older sister to death 1; youngest surrenderer started
drugs at 8; drug war lists 20,584 kids as users, pushers,
runners’. These current events put in the limelight the
implementation and effectivity of Republic Act No. 9344, as
amended, otherwise known as “The Juvenile Justice and
Welfare Act of 2006.” (Explanatory Note, S.B. 2026, V. Sotto III,
2018)

b. How do these issues being settled?


The President, Rodrigo Duterte calls on Congress to lower the
age of Criminal Liability “to ensure that the Filipino youth would
accept responsibility for their actions and be subjected to
government interventions programs”. This is consistent with
President Duterte’s goal to curb criminality in the country. (S.B.
No. 2026, Explanatory Note, Sotto III).

c. What laws are being legislated in response to these issues?


The amendments of this law by means of lowering the minimum
age from 12 years old to 9 years old and how it will lower the
crime rates of our country in a long term benefits. The Republic
Act 9344 has been in effect since its implementation but the
laws are being amended in order to protect the children from
being used, abused, and/or rehabilitate the juvenile delinquents.

d. Are these laws fully implemented today? Discuss briefly and cite
examples.
The RA 9344 has been implemented during the time of
President Gloria Macapagal-Arroyo in April 28, 2006. The
current law has already established rehabilitation such as the
‘Bahay Pag-asa’ that refers to a 24-hour child-caring institution
established, funded and managed by the Local Government
Units and Licensed and/or accredited Non-Government
Organizations providing short-term residential care for children in
conflict with the Law (RA9344, JJWA). This facility was
established in order for the child to go under rehabilitation so that
the Rights of the Children may not be neglected upon committing
such crimes under this law. One of the examples of these
facilities is the Bahay Pag-asa Dasmariñas, a transformation
center for children in conflict with the law.

3. Give a summary of meaningful learning experience you earned from this task.
How does this learning experience relate to teaching profession? In what
manner this learning experience will guide you in becoming an ideal teacher
in the future?
As I go on with my research, I have learned that the laws being implemented
by the legislation are laws that needs to be given importance especially for us
pre-service teacher like the Republic Act 9344. This law gives us a glimpse of
reality of those children in conflict with the law and how to help them legally. The
laws are important in order to protect the welfare of the children and the people
who will be handling these cases. This law clearly shows us that teachers, are
actually part of how we shape these children and how can we use this law to
prevent such tragedy. Giving importance to the children is important because we
are the ones who can influence them deeply as far as the laws, presidential
decrees, or any other republic acts are concerned. I am personally was able to
experience such programs from this Republic Act by means of our Area Work
program of XU-NSTP last year and I have been very careful in dealing with these
children. Let alone know their background for the reason of we are actually
prohibited to inquire such information due to this law as to protect their rights as a
child. I cannot then identify who are Juvenile Delinquents at that time but we were
briefly informed of what we are dealing with. This research relived my memories
of this kids whom I am rooting to and hoping for their rehabilitation be successful
so that this law may be a stepping stone for them to change for good and
become a more efficient member of the society.
